Special Meeting
May 17, 1971
The meeting was called to order at 8:15 p.m.

Roll Call: Land,
Mayor Nawrocki announced that the purpose of this meeting was a
hearing on the installation of curb, gutter and blacktop on all or
any part of 42nd Avenue from University to Central Avenue N.E. The
City Engineer and City Manager presented slides showing cross sections
of the avenue and gave a cost breakdown indicating a total estimated
cost of $3.00 per foot on an avenue basis and residents within ½ block
of 42nd Avenue. A further discussion was held regarding the cost
where curbs presently exist. On this the cost breakdown was $1.66
for blacktop and $1.36 for curb. Several individuals in the audience
were heard from objecting to the costs and asked that the project be
delayed due to other as~ssments for watermains that were assessed
last year. A number of individuals expressed the opinion that the work
should be done now since the cost of construction is continually
rising and it will cost much more money to do the work later.
Councilman Land pointed out the desirability of having good ~Jstreets
by a person's home and indicated that people expect to have good
streets to drive on in all neighborhoods and it is unfair to expect
some people to pay for good streets which are available to everyone
and others to leave their streets in poor condition because they do
not wish to pay the cost of desirable street surfacing. At this point,
Councilman Land moved to deny the proposal for construction on 42nd
Avenue. Councilman Jeska seconded t~ motion. Roll Call - All Ayes.

Bids on Black Dirt and Sod.
The Park Superintendent was present at the meeting and reported to
the Council he was mt ready to make a recommendation for award of
Xbids on black dirt and sod at this time. Motion by Land, seconded by
Heintz to postpone consideration of the bids until the next regular
meeting ~'a special meeting to be called by the City Manager Roll
Call - Ali Ayes. '
Hearing on Curb, Gutter and Storm Sewer in Main Street, 37th to 40th Ave.
A hearing was held on proposed municipal state aid street construction
including curb, gutter and storm sewer for Main Street from 37th to
4Otb Avenue N.E. Residents from the area were present for the advertised
hearing.
The City Manager explained the street will be a 9 ton design with two
traffic lanes and two parking lanes with the cost of paving to be paid
out of municipal state aid funds. The total cost of the project is
estimated at $96,OO0. Curb and gutter will amount to approximately
$14,OOO. Storm sewer is estimated at $30,000, $15,O00 of which will
be paid from State aid funds, $10,O00 from City storm sewer fund, and
$5,000 to be assessed. It was reported a credit will be given for an
assessment on storm sewer back in 1953 in the amount of $5,000.

The City Engineer said he has determined about 15 water services in
the ground are not copper and it would be his recommendation 'to replace
them at this time. He said there are ten vacant buildable lots
remaining and recommended utility stubs be installed to those lots
at a cost of $150 each.
A discussion was held on problems with off-street parking in the
neighborhood and the possibility of putting in an alley if a petition
were received.
A poll was taken of the residents present and the n~jority were in favor
of the project. Motion by Heintz, seconded by Jeska to authorize
the project with the stipulation that the maximum assessment per
utility stub out be $75.00. Roll Call - All Ayes.
Councilman Heintz said by establishing this $75.00 utility stub out,
it will encourage property owners to do it now. Councilman Land
said this $75.00 should be set as a precedent and not only for Main
Street.
Resolution Authorizing Hain Street Project.
Resolution was offered by Logacz, seconded by Jeska, BE IT HEREBY
RESOLVED by the City Council of the City of Columbia Heights, WHEREAS,
the City Council of the City of Columbia Heights by Motion on the 26th
day of April, 1971 ordered notice of a hearing to be given to
property owners, and WHEREAS, pursuant to a notice of hearin9 certain
residents appeared at a Council meeting on the 24th day of May, 1971,
and WHEREAS, the Council determines to proceed with this local
improvement, a portion of the cost being defrayed by special
assessments umder Charter provisions, NOW, THEREFORE, IT IS HEREBY

as follows: Concrete curb and gutter and storm sewer on Main s~reet,
from 37th to bOth Avenue N.E. and utility stubs to vacant buildable
lots and replacement of old metal water lines with copper where needed.
2. That the materials to bBS§~e as follows: Concrete curb and gutter,
and standard concrete storm sewer pipes and copper utility fittings
and asphaltic materials for street surfacing (state aid project).
3. That a careful estimate of the cost of the improvement has been
made by the City Manager and the several lots and parcels of land
fronting upon and adjacent to such proposed improvement, which he
deemed benefited thereby, were properly notified of said hearings, and
4. That the City Manager shall also list the names and owners of the
several parcets so improved as nearly as can be ascertained.
5. These improvements shall also be known as Project #655 Curb, Gutter
and Utilities~ and #656 Storm Sewer. Roll Call - All Ayes.
Ordinance #762 Vacating Public Alley, ~7TH TO 47½ AVE., WEST OF MONROE.
Second reading was held on Ordinance #762 vacating the Public Alley
in Blocks 1 and 2, Pleasant View Addition from Monroe Street
westerly to the o~st line of Lots 6 and l l, in Block 2. . ~,

A second reading was held on Ordinance //760 establshing Residence-

Ordinance //760 was adopted.
Ordinance //761 Rezoning 945 - 40th Avenue to R-O-C Zone.
A second reading was held on Ordinance //761 rezoning Lot 36, Block 5,
Reservoir Hills, Anoka County, Minnesota (945 - 4Ot~ Avenue N.E.) from
C-2-S, General Shopping Center, to R-O-C ResidenCe Over Commercial.

Logacz -Ayes. Nawrocki - Nay. Ordinance //761 was adopted.
Ordinance //759 - Relating to Parks.
Councilman Heintz reported Ordinance //759 was reviewed by the Park
Board section by section. The board was satisfied with the wording and
unanimously recommended adoption of the ordinance by the City Council.
Attorney Sokolowski said he has not had a chance to personally go over
the ordinance to check for any conflicts or review it with the other
attorneys in his office. No action was taken.
Ordinance //763 - Relating to Commercial Garbage Co]ection.
Ordinance //763 was presented to the Council. Mayor Nawrocki questioned
whether or not the ordinance carried out the intent of the Council
which would establish certain standards for hauling waste and so forth
on commercial and industrial property. No action was taken.
Resolution Setting 1971 and 1972 Salaries for Employees Represented by
Local 49 and Local 664.
No action was taken on A resolution setting 1971 and 1972 salaries for
employees in the Street, Park, Shop, and Sewer & Water Departments
represented by Local 49 and 664. A question was raised on what
the Legislature would do on the property tax freeze bill and how this
would affect the City.
Jaycees Request to Sell Beer and Operate Food Concession.
Motion by Jeska, seconded by Heintz to grant the request from the Jaycees
for a license to sell 3.2 beer and operate a food concession stand
at the Jamboree upon approval of the Activities Committee. Roll Call -
All Ayes.
Appeal Planning Commission ~nial for Building Site, 4125 Polk.
Mr. Wyman Smith, Attorney, a~d Mrs. Vivian Ratliff were present to appeal
the Planning Commission denial of their request for a building site
at 4125 Polk Street. Mrs. Ratl iff proposes to construct a house 25' X
42' on the 35' lot.

Councilman Jeska said the Planning Commission denied this request on
the basis that 35' was too sma]] for a building site and that this
was the only a~o~ss to the interior of the block.
Mr. Smith said their basic argument is that the City has treated this
property as a parcel of land and have assessed it for special
improvements. If Mrs. Ratliff cannot use it for the purposes for
which it is zoned, then there is no benefit for the time it was
assessed. He said it is not fair to call a piece of property
benefited and not let the owner make use of it.
Councilman Land said if the owner would get a petition from the
people who surround the area with no objections, he would be in
favor of the proposal.
Motion by Jeska, seconded by Heintz to refer' the matter to the City
Attorney and report back at the next regular' meeting. Roll Call ~

Cat Situation at 4426 Jefferson Street.
The owner of 4426 Jefferson Street was present and expressed concern
over 'the number of cats running loose in his neighborhood. The
City Hanager reported B & E Patrol have picked up six cats in the
area over the past month, and that a represe, ntative from B ~ E Patrol
would be coming out to the home to get more information on the
situation.
Solicitors License Request.
A solicitors license request was received from Robert Morris Cook
who represents the "Boys of the City Junior Sales'~ group to sell
packaged candy door to door. Hr. Cook reported their group has
licenses in Crystal, and White Bear Lake. He said the money will
be used to build a youth center on Franklin Avenue. Motion by Jeska,
seconded by Logacz that the license application be granted and the
fee waived on the basis of a non-profit organization. Roll Call -
All Ayes.
Request to Keep VFW Open Sunday, June 20, 1971.
A request was received from the VFW Club to keep their club open
on Sunday, June 20, 1971 during the Jamboree for the convenience
of their members. Motion by Land, seconded by Heintz that the
request be granted to have the VFW Club open from noon until Hidnight
on Sunday, June 20th with same restrictions as in 1970. Roll Call
All Ayes.
Bingo License Request.
A representative of the Order of the Purple Heart was present requesting
a bingo license for their group in the old Anderson building on
Central. He said the games would be run four hours twice a week.
Mayor Nawrocki said he was not too keen on a general public bingo
operation and requested the City Attorney look at the bingo ordinance

before any action is taken. Motion by Jeska, seconded by Heintz
to refer the matter to the City Attorney and report back at the
next regular meeting. Roll Call - All Ayes.

Minnesota State Firemen's Association Conference.
Motion by Land, seconded by Heintz to authorize five members of
the Columbia Heights Fire Department to attend the Minnesota State
Firemen's Association Conference to be held in Bemidji, Minnesota
June 10th - 13th, expenses be paid. Roll Call - All Ayes.
Bids on Bulldozer.
Motion by Heintz, seconded by Land to authorize the City Manager to
advertise for bids for a used bulldozer, bids to be opereJ June 14, 1971
at 8:00 p.m. Roll Call - All Ayes.
Charter Commission Appointments.
It was reported Judge Keyes would be making Charter Commission
appointments soon. Councilman Land indicated he would be interested
in serving on the commission and requested his name be submitted
along with other names of interested former Mayors and Councilmen.
Human Rights and Planning Commission Appointments.
It was reported interviews will be set up soon for Planning and
Zoning Commission applicants and Human Ri~ts Commission applicants.
Bids on Towing and Gasoline.
Motion by Jeska, seconded by Heintz to call for bids on ~~
towing service and g~oline, diesel fuel and furnace oil, bid to
be opened June 14, 1971 at 8:00 p.m. ~11 Call - All Ayes.
Call for Various Hearings.
Motion by Jeska, seconded by Heintz that the City Manager be authorized
to advertise for hearings on blacktop overlay maintenance work on 45th
Avenue from University Service Road to Central; for curb and gutter on
Jefferson from 39th Avenue to 40th Avenue; and curb, gutter and
accessory utility work on 39th Avenue from 5th Street to Jefferson
such hearings to be ~ld at a Mspecial meeting hereby called for
Monday, June 21st at 8:00 p.m. in the Columbia Heights Field House.

Call for Bids on Various Items.
Motion by Jeska, seconded by Heintz that the: City Manager be authorized
to call for bids on concrete curb and gutter' and miscellaneous concrete
work on Main Street, 37th to 40th Avenue; concrete alley paving between
6th and 7th Street north of 45th Avenue; storm sewer on Main Street,
37th to4Oth Aven~; and water and sewer house services on Main Street
from 37th to 40th Avenue N.E., bids to be opened at the regular
meeting June 14, 1971 at 8:00 p.m. Roll Call - All Ayes.
Licenses.
Motion by Heintz, seconded by Land that the license applications as
listed be granted upon payment of proper fees. Roll Call - All Ayes.
Bids on Sale of Low Boy Trailer.

authorized to advertise for bids on the sale of a low boy trailer.

Hotion by Land, seconded by Jeska that Hrs. Nygaard be appointed
Secretary pro tem for this special meeting. Roll Call - All Ayes.
Award of Bids on Black Dirt & Sod.
The low bidder for black dirt was Donald Chies, however, he did not
submit a bid on the cultured sod. Low bidder for sod was W & G
Rehbein. Discussion followed as to whether the Chies low bid on black
dirt could even be considered, as he did not submit a bid on the sod.
Mr. Chies stated that khe City Engineer had indicated he could bid on
just black dirt. The CityAttorney's opinion is that since the
specifications did not clearly indicate the bids to be tied, they were
not, and the City could award each item to the low bidder or reject
all bids and call for new bids. Motion by Jeska, seconded by Land
that the award for black dirt ($1.99 per cu. yard) be awarded to
