this function, NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Columbia Heights does hereby indicate its opposition to
H.F. 1678 and S.F. 1237 and recommend the following actions be taken in
its place:
That the Metropolitan Council be authorized to prepare a metropolitan
park system plan.
That any funds which are, or become available for park purposes be
channeled to those units of existing local government for
facilities which conform to said park system plan.
BE IT FURTHER RESOLVED that copies of this resolution be submitted to
Re appropriate Legislators. Roll Call - All Ayes

Motion by Land, seconded by Heintz, that the bids be turned over to
the City Manager for tabulation and report back at the next regular
meeting. Roll Call - All Ayes.
Hearing on Alley Paving and Grading Project Between 45th and 4~h Avenue
6th to 7th Street.
The City Manager reported at the last meeting a petition was received
signed by a majority of the affected property owners requesting an
alley grade and paving for the alley between 45th and 46th Avenue from
6th to7th Street. He said the alley, as the property owners are aware,
has a flat grade and is a bad drainage problem. He said an informal
meeting was held wi~ the City Engineer and residents and a solution
was reached which seemed reasonable, that being to set a catch basin
in the alley back to a point that is about 150' north of 45th Avenue
which would pick up the water from the alley and icarry it south to
45th Avenue, and ultimately there would be a storm drain in 45ti~.
The total estimated cost for this project would be $5.50 per foot
for concrete paving, and $1.50 per foot for the drain to handle the
water in the alley, or a total of $7.00/assessable foot. The City
would pay $4,500 out of the storm sewer fund for the ~X~Xsection
on 45th Avenue. Motion by Land, seconded by Logacz that the City
Manager be authorized to proceed with construction of a concrete
alley between 45th and 46th Avenue from 6th to 7th Street, and
the necessary storm drain for that alley in the 1971 construction
season with an estimated cost of $7.00 per foot assuming the City
will spend money for a storm sewer on 45th Avenue. Roll Call -

Resolution Authorizing Alley Paving and Grading Project.
A resolution ordering improvements was offered by Logacz, seconded by
Jeska, BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights, WHEREAS, ~e City Council of the City of Columbia
Heights by motion on the 12th day of April, 1971 ordered notice of a
hearing to be given to property owners, and WHEREAS, pursuant t~a
notice of hearing certain residents appeared at a Council meeting on
the 26th day of April, 1971, and WHEREAS, the Council determines
to proceed with this local improvement, a portion of the cost being
defrayed by special assessments under Charter provisions. NOW,
THEREFORE, IT IS HEREBY RESOLVED: 1. That the location and extent
of such improvements is as follows: Alley Grading, Drainage, and
Paving between 6th and 7th Street, from 45th to 46th Avenue.
2. That the materials to be used are as follows: Concrete. 3.
That a careful estimate of ~e cost of the improvements has been made
by the City Manager and the several lots and parcels of land fronting
upon and adjacent to such proposed improvement, which he deemed
benefited thereby, were properly notified of said hearings, and
4. That the City Manager shall also list the names and owners of
the several parcels so improved as nearly as can be ascertained.
5. These improvements shall also be known as Project No. 653.

Petition Requesting Curb & Gutter on 42nd Avenue.
A petition was recei~i requesting curb and gutter to be installed
on 42nd Avenue. It was reported the last hearing held on this
project was in 1962 but authorized construction was withheld due
to pending watermain installation. The City Engineer requested
a hearing be held on the request on 42nd Avenue from Central to
University. Motion by Jeska, seconded by Logacz that the
City Manager be authorized to advertise for a hearing for the
curb and gutter as needed and street re-surfacing on 42nd Avenue
between Central and University, such hearing to be held at a
special meeting hereby called for 8:00 p.m., Monday, May 17, 1971.

Petition Opposed to Continued' City Rental of Voss Lot
A petitioned signed by over 200 people was submitted ~~X~
~B~stating opposition to continued city rental of the Voss parking
lot on Van Buren Street near 40th Avenue. A lengthy discussion
was held on the amounts paid for rental of the lot and taxes,
and how parking meter money was used for parking lot purposes.
Motion by Land, seconded ~ Heintz tl~t the petition be placed on
file. Roll Call - Ail Ayes.
VFW Requests Permission to Hang Banner Across 40th Avenue.
Mr. James Nyman from the VFW Club was present and requested permission
for the VFW to hang a banner across 40th Avenue at 5th Street
advertising the 50th Anniversary of Adoption of the City 1Charter.
Motion by Jeska, seconded by Heintz that the request be granted
upon presentation of proper insurance coverage. Roll Call -
All Ayes.
VFW Requests to Place Buddy Poppy Cards in Municipal Buildings.
Motion by Land, seconded by Jeska to authorize the placement of
Buddy Poppy Cards in City Buildings with the provision that no
City funds be expended for that purpose. Roll Call - All Ayes.
Ordinances #755, 756, 757~ and 758 relating to Drugs.
A second reading was held on Ordinance #755 relating to the ~X~
sale and possession of barbiturates and other prohbited drugs.

A second reading was held on Ordinance #757 relating to
regulation of inhaling, breathing, drinking, purchase, sale
and possession of glue and certain other substances. Offered
by Logacz, seconded by Jeska. Roll Call - All Ayes. Ordinance
#757 was adopted.
A second reading was held on Ordinance #758 regulating the
sale and possession of codeine. Offered by Heintz, seconded by
Land. Roll Call - All Ayes. Ordinance #75~ was adopted.
Resolution Relating to Northern States Power Co. Electric Rate Increase.
The resolution was offered by Logacz, seconded by Heintz, WHEREAS,
Northern States Power Company is the supplier of electric service
in this community, and WHEREAS, the rates and charges of Northern
States Power Com~ny for electric ~service are not subject
to effective regulation on a state or regional level, and
WHEREAS, Northern States Power Company has announced a general
rate increase for electric service of approximately eight
percent (8%), and WHEREAS, this Council believes that the basis
for such increase should be subjected to a detailed analysis by
persons skilled in utility rate-making, to provide assurance
to the City and to other consumers of electricity that the rates
and charges of Northern States Power Company are justified,
~and, WHEREAS, this Council believes that Northern States Power
Company should be willing to submit to such an examination of
its rates and charges, and WHEREAS, the costs of utility rate
analysis incurred in behalf of the public are customarily
borne by the utility being regulated; NOW, THEREFORE, BE IT
RESOLVED by the City Council of the City of Columbia Heights,
Minnesota, as follows: 1. This Council objects to any increase
in the electric rates of Northern States Power Company in this
community until such timeas Northern States Power Company
submits to a detailed professional analysis of such rate increase,
by such persons, acceptab ~ to this Council with the costs of
such analysis being borne by Northern States Power Company.
2. A copy of this Resolution shall be sent to Northern States
Power Company with the request for a response from Northern
States Power Company. Roll Call - All Ayes.
Motion by Heintz, seconded by Jeska that copies of this re~ution
and a cover letter be sent to all Mayors, Councilmen and Managers
in communities served by N.S.P. in the 7 county metropolitan
area. Roll Call - All Ayes.
Ordinance #759 - Rules and Regulations Pertaining to Parks.
A request was receivedfrom the Park Board to adopt an ordinance
containing the rules and regulations pertaining to parks and
parkways in the City, similar to an ordinance in the City of
Minneapolis. A first reading was held on Ordinance #759 and
the City Attorney will go over the ordinance to be sure it is
totally applicable to Columbia Heights.

Resolution Approving Plat for 556 - 40th Ave. N.E.
Resolution offered by Land, seconded by Jeska, BE IT HEREBY RESOLVED
by the City Council of the City of Columbia Heights, that
WHEREAS, a lot subdivision for the property described as Lots 1,
2, and 3, Block 66, Columbia Heights Annex, was granted on
February 23, 1970, and WHEREAS, all requirements of said lot
subdivision have been met including the proper platting for the
subdivision, NOW, THEREFORE, BE IT HEREBY RESOLVED that the Mayor
and City Manager be and they are hereby authorized to endorse
the plat as prepared in accordance with the original subdivision.

Ordinance Which Would Allow Commercial Building at 945 - 4Oth Ave.
A questio~was raised on the progress of a proposed zoning ordinance
referred to the City Attorney two meetings ago which would allow
a commercial building with two apartments at 945 - 40th Avenue N.E.
Resolution On Bill Imposing Metropolitan Sales Tax+
The City Manager presented a Resolution in support of a Bill
imposing a metropolitan sales tax offered by Land, seconded by
Jeska, BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights, that WHEREAS, for the past several years, the
City Council has had of prime concern the increased amount of
taxes imposed upon landowners within the Metropolitan Area and in
the City of Columbia Heights due to rising costs for municipal and
other governmental services; and WHEREAS, the City Council believes
that most taxpayers who own property in the City of Columbia Heights
or in other areas are of the opinion that their own real property
taxes have reached a level which is too high for the average
taxpayer; and WHEREAS, ~the City Council is of the opinion that
steps must be taken to remove the tax burden imposed upon the
owners of real property; and WHEREAS, the City Council has reviewed
a Bill pending before the 1971 Legislature, designated as House
File No. 2995; and companion Senate File 2636; and WHEREAS, the
City Co~cil is of the opinion that House File No. 2995, if enacted
by the Legislature, would provide a fair tax which woulud~benefit
property owners in the Metropolitan Area. NOW, THEREFORE, BE
IT RESOLVED by the City Council of the City of Columbia Heights
that the City Council of the City of Columbia Heights hereby
endorses House File No. 2995 and companion Senate File No. 2636
and urges the Legislature of the State of Minnesota to enact
it into law. BE IT FURTHER RESOLVED that the City Clerk of the
City of Columbia Heights cause a copy of this resolution be
delivered to the Honorable Jerome Blatz, State Senator, the
Honorable Dean Nyquist, State Senator, and the Honorable Spencer
Sokoiowski, State Representative, and that they are hereby rec~sted
to support House File No. 2995 and companion Senate File No. 2636
and to present a copy of this resolution to the Legislature of
the State of Minnesota. Roll Call - All Nays. Defeated.
Councilman Jeska stated he would support the theory of adding a
metropolitan sales tax on to the state sales tax if the state
Legislature in some way could put a requirement that the property
tax level cannot go beyond a certain level of assessed valuation.

Councilman Logacz said he agreed with Councilman Jeska, but felt
money shou~ d be raised from income taxes ~nd distributed in proportion
to population.
Resignation from Human Rights Commission~
A letter was received from James Heldenbrand who served on the
Human Rights Commission informing the Council of his intent to resign
from the Human Rights Commis~on. He is being transferred out of
the State on his job. Motion by Land, seconded by Heintz to accept
the resignation of James Heldenbrand from the Commission. Roll Call -
All Ayes.
Athletic Boosters 1971 Beer License.
Motion by Jeska, seconded by Heintz that a request for a 1971 beer
license from the Athletic Boosters be granted. Roll Call - All Ayes.
American Cancer Society Solicitors License.
Motion by Heintz, seconded by Jeska that a solicitors license be granted
to the American Cancer Society and the fee be waived on the basis of
a charitable organization. Roll Call - All Ayes.
Bids on Black Dirt & Sod for Park Department.
Motion by Jeska, seconded by Heintz that the City Manager be authorized
to call for bids for black dirt and sod for use in the Park Department,
bids to be opened May 10, 1971 at 8:00 p.m. Roll Call - All Ayes.
Purchase Agreement for Property on 38th Avenue.
The City Manager requested authorization to enter into a purchase agree-
ment for the Peter Tema property on 38th Avenue for 9530,000. He said
appraisals had been made and the price is in line with the appraisals.
Motion by Land, seconded by Heintz that the Mayor and City Manager be
authorized to enter into an agreement for the property, a house and
seven lots, and a lease be negotiated for the house. Roll Call -
All Ayes.
Pollution Control Regulations.
A discussion was held on a question raised at the last Council meeting
regarding burning in garages. The City Attorney said after checking
our ordinances and Pollution Control Agency regulations he finds
our ordinances are outdated. He will check the Agency amendments
for consideration of adopting same.
Bids on Utility Re-location for Shell Oil.
Motion by Jesl~a, seconded by Heintz that the City Manager be authorized
to advertise for bids on the utility relocations for Shell Oil
property upon obtaining final approval of available money from Shell,
the bids to be opened at the next meeting following the receipt of
formal notification that would allow proper time for legal advertisement
of the bids. Roll Call - All Ayes.

Hearing on Curb, Gutter and Paving in Hilltop Second Addition.
Motion by Jeska, seconded by Land that the City Manager be authorized
to ad~rtise for a hearing on curb, gutter and paving for Hilltop

the hearing to be held at the next regular meeting, May loth.

Hearing for Curb, Gutter and Storm Sewer on Main Street.
Motion by Jeska, seconded by Heintz that the City Manager be authorized
to advertise for a hearing for curb, gutter and storm sewer on
Main Street from 37th to 40th Avenue, hearing to be held May 24th.

Mayor Nawrocki suggested a letter type notice be sent to affected
property owners explaining what is involved in this work and what
they would be responsible for. He also suggested the same type
of notice be sent to people in Hilltop Second Addition .on their
hearing.
Hearing on Curb and Gutter - 39th Avenue, Central to Reservoir.
Motion by Land, seconded by Jeska that the City Manager be authorized
to advertise for a hearing for curb and gutter on 39th Avenue between
Central and Reservoir Boulevard, the hearing to be held I~y lOth.

Alley Between Reservoir & Tyl.er, 39th to 4Oth Avenue.
The City Engineer requested alley paving project for the alley
between Reservoir and Tyler from 39th to 4Oth Avenue. He reported
the residents petitioned for this work a few years ago but no work
could be done until the watermain was put in. Councilman Land
requested we hold off on this until a petition is received now and
he will talk to the residents about it.
'Storm Drain on 39th Avenue, Reservoir to Polk.
The City Engineer requested a hearing on storm drain for 39th Avenue
from Reservoir Boulevard to Polk Street. Councilman Land suggested
an informal meeting be held between the Engineers and the re,dents
and a report made at the next regular meeting.

Motion by Jeska, seconded by Heintz that the licenses as listed

Traffic Safety Award Dinner.
The City Engineer requested expenses be allowed for Traffic Commissior
~members to attend a Traffic Safety Awards Dinner at which Columbia
Heights will receive an award. Motion by Land, seconded by Jeska
that expenses for up to five people be authorized to attend the
dinner May 4th. Roll Call - All Ayes.
Recreation Commission Bus.
Councilman Heintz reported the Recreation Commission bus has been
in the garage for repairs for some time now and requested a report
on this at the next regular meeting.
Reception for Recreation Director.
It was reported a reception will be held for retiring Recreation
Director, George Kolesar, in the Field House on Friday, April 30th.

Invocation was given by Rev. Larry Johnson, Associate Pastor of
First Lutheran Church.
Minutes of last regular meeting.
One correction was made on the minutes of the last regular meeting
held April 26th, on the matter on the call for a hearing. The
streets were corrected to read Fo~st Drive instead of Fairway
Drive and the descriptions on Upland Crest were made stating
West Upland Crest and North Upland Crest. Motion by Jeska,
seconded by Logacz that the minutes be approved as corrected.
