Hotion by Jeska~ seconded by Heintz that the Citf Attorney be authorized
to attend Legal Education Course April 2nd and 3rd at the Thunderbird

Proclamation Designating Athletic Boosters Month.
A Proclamation Designating May, 1971 as Columbia Heights Athletic
Boosters Month was read by Mayor Nawrocki: WHEREAS, the Athletic
Boosters Club of the City of Columbia Heights has at all times worked
for the Youth of our comm~ity in promoting and supporting athletes
and athletic events by: Purchasing of all typesof athletic uniforms
and special equipment, Financing various items such as lighted softball
fields, entry fees, and banquets, and in a continued effort making
their time a~lc~talents available to every worthy youth-oriented
activity in our City, NOW, THEREFORE, I, Bruce G. Nawrocki, Mayor of
the City of Columbia Heights do hereby proclaim the month of May, 1971
as "ATHLETIC BOOSTERS MONTH" and encourage the citizens of our
community to support the unselfish endeavors of our Athletic
Boosters Club.
Police Car Bids.
Bids were received from the following on two police cars:
Central Motor Sales, Fury I Plymouth, $6,899.74 less $1,100 trade-in
of two 1969 Plymouths, for a net bid of $5,799.74. Delivery: 40-60 days
Midway Ford, Ford Custom, $6,968.00 less $1,328.00 trade-in of two 1969 Plymouths, for a net bid of $5,640.00. Delivery: 60 days.
North Star Dodge, Dodge Polara, $6,829.48 less $900.00 trade-in of two
1969 P~ymouths, for a net bid of $5,929.48. Delivery: 40-60 days.
Motion by Land, seconded by Heintz that the bids be turned over to the
City Manager for tabulation and report back at the next regular meeting.

Presentation of Certificate of Appreciation.
A Certificate of Appreciation was presented to Burton Klietz who has
served on the Columbia Heights Recreation Commission for the last five
years and who was unable to accept reap~ointment to the Commission
ar another term due to job conflicts.
Award of Bids on Hart Boulevard Lighting.
Motion by Logacz, seconded by Heintz that the bid be awarded to Hoffman
Electric in the amount of $2,552 as per bid tabulation attached, with
the understanding that General Electric fixtures will be provided
instead of Westinghouse as indicated on their bid. Roll Call - All Ayes.
Award of Bids on Plant Mixed Bituminous.
Motion by Heintz, seconded by Land that the bid on plant mixed bituminous
be awarded to Dunkley Surfacing for both picked up and delivered
stan d~rd mix, fine mix, and fine mix and mineral filler as per bid
tabulation attached, with H. & S. Asphalt Co. as an alternate on
picked up standard mix, fine mix, and fine mix andmineral filler.
The Engineering Department is also authorized to use the low county
bid for these materials where practical. Roll Call - All Ayes.

Motion by Jeska, seconded by Land that the bid on road aggregates
be awarded to:

Class 3; delivered F^2; and picked up and delivered sanding sand and

Motion by Jeska, seconded by Logacz that the tabulation of bids on
equipment rental be placed on file for the Engineering Department's

Motion by Heintz, seconded by Jeska that the tabulation of bids on
miscellaneous sewer and water materials be placed on file and the
Engineering Department be authorized to purchase as necessary from

A second reading was held on Ordinance #753 authorizing sale of

parallel with N. line thereof a distance of 129.6'; thence continuing

Side Yard Waiver, 4116 Quincy Street.
Motion by Land, seconded by Heintz that the request for a waiver to
place a garage 2' from side lot line on 40' lot be granted for
4116 Quincy S£reet as recommended by the Planning and Zoning
Commission. Roll Call - All Ayes.
Side Yard Waiver, 3816 Polk Street.
Motion by Land, seconded by Jeska that the request for a waiver to
place a garage 2' from side lot line on 40' lot be granted for
3816 Polk Street as recommended by the Planning and Zoning
Commission. Roll Call - All Ayes.
Side Yard Waiver for 4141 Arthur Street.
A request was received from 4141 Arthur Street for a side yard
waiver for the purpose of building an attached garage to within 4'
of the side lot line, as recommen~ied by the Planning and Zoning
Commission. The next door neighbor has signed an agreement
indicating no objections. Another neighbor behind 4141 Arthur
was present at the meeting objecting to the proposed garage saying
the plan would affect his property, that he would be landlocked,
and would have a drainage area on his back lot. He requested someone
from the City Engineering Department come out and check the area
before the waiver is granted. Motion by Land, seconded by Heintz
~at the request be granted for a waiver subject to the approval
of the Engineering Department on the drainage question. Roll
Call - All Ayes.

Front Yard Waiver, 1304 - 42nd Avenue.
A request was received from 1304 - 42nd Avenue for a waiver to
expand the kitchen on the front of the home similar to a neighbor's
house that has already made this change several years ago. The
request was recommended by the Planning Commission and both adjoining
neighbors have signed approval. Motion by Heintz, seconded by Land
that the waiver be granted for 1304 - 42nd Ave. Roll Call - Ail Ayes.
Front Yard Waiver, 641 - 51st Avenue.
The owner of 641 - 51st Avenue was present requesting a waiver to
build an entry way on the front of their colonial home. She explained
the interior of the house is such that the front door cannot be
opened to its full width because it is blocked by the stairway
going upstairs and felt this was a fire hazard. Signed approval
has been received from the neighbors and the waiver was recommended
by the Planning Commission. Motion by Land, seconded by Heintz
that the request for a waiver be granted. Roll Call - All Ayes.
Mayor Nawrocki said he would like a report on why this door arrangement
was allowed in the first place.
Petition Requesting Hearing on Alley Paving and Grading.
A petition was received requesting a hearing on alley grading and
paving of the alley between 45th Avenue and 46th Avenue between
6th and 7th Streets. The petition asked that the alley grade be
lowered sufficiently on the 46th Avenue end to permit effective
drainage to 46th Avenue and that 45th Avenue be lowered between
6th and 7th Streets to provide improved drainage. Motion by Jeska,
seconded by Heintz that a hearing be set for the next regular Council
meeting, April 26th, that the City Manager be authorized to advertise
for the hearing. Roll Call - Ali Ayes.
Planning Commission Vacancy.
Appoinl~ent to Recreation Commissi°n~L
-- Motion by Heintz; seconded by Logacz that Gordon Schelde be appointed
to the Recreation Commission for a three year term. Roll Call -

A letter was received from John Hemak, Planning Commission member,
indicating he does not wish to serve another term on the Commission.
The City Manager was directed to contact all applicants for the
Planning Commission informing them of the vacancy and interviews
will be set up.
Appointment of New Charter Commission.
A letter was received from Judge Keyes indicating he will re-activate
the Charter Commission and would appreciate having the City Manager
submit names of qualified persons to him. The Council members
suggested the City Manager put together a list of past Councilmen,
Mayors and Attorneys for consideration.

The meeting reconvened at 9:25 p.m.
Traffic Commission Recommendation to Re-route Bus.
It was reported the ~affic Commission held a lengthy hearing on
April 5th for consideration of a petition request rerouting the
M.T.C. bus from Upland Crest to Stinson Boulevard. The discussion
centered primarily around moving the bus on to a heavy duty street,
and eventually the rerouting request was unanimously recommended by
the Commission members.
The City Manager reported he received a call from Mrs. Kruse, ~Z~
4720 Stinson Boulevard, who could not be present at the Council
meeting who voiced objection to the change-over to Stinson Boulevard
stating a safety problem would result from the bus traffic. She
indicated, however, if it appears that Stinson is to be used for
bus service that the Council consider having the bus go north on
Stinson instead of south elim~ting the blind corner problem at
45th Avenue and have the bus travel alongside a fenced area instead
of going in front of houses. Mr. Ben Lumm, who also lives on Stinson,
was present stated his objections to the proposal.
Motion by Jeska, seconded by Heintz to recommend that the request
be favorably acted upon by the Metropolitan Transit Commission.

Call for Bids on Paver Laid Bituminous.
Motion by Logacz, seconded by Jeska that the City Manager be
authorized to call for bids on paver laid bituminous surfacing for
certain park areas, bids to be opened April 26th Roll Call - All
Ayes. '
Request Expenses For Attendance at Emergency Care Seminar.
A request was received from Officer Donald French for necessary
expenses incurred when he attended an Emergency Care Seminar at
North Memorial Hospital April l, 2, and 3, 1971. Motion by Land,
seconded by Heintz that the request be granted. Roll Call ~ All Ayes.
Request Expenses for Attendance at Mechanics Training Session.
A request was received from the City Shop for two employees to attend
a mechanics training session Monday evenings from March 29th and
lasts for eight weeks. Motion by Jeska, seconded by Heintz that
the request for expenses be granted. Roll Call - All Ayes.
Request to Open Bids on Paving.
The City Engineer requested ~ZN~X~X~authorization to call for
bids on bituminous paving~as needed. Motion by Jeska, seconded
by Heintz that the City Manager be authorized to advertise for bids
for paving, bids to be opened at the next regular meeting, April 26th.

Request Authorization to Purchase Black Dirt and Sod.
Motion by Heintz, seconded by Jeska that the City Manager be authorized
to purchase up to $1,000 worth of black dirt for use in the Parks.

Motion by Jeska, seconded by Heintz that the City Manager be authorized
to purchase up to $1,000 worth of sod for use in the Parks. Roll

Rental Agreement for Quonset Building, 3841 - 3rd Street.
The City Manager reported the lease for the quonset building at
3841 - 3rd Street, used for storing sewer and water department
equipment, expired April ist. He said he has talked with the owners
of the quonset who request an P$8.00 per month increase in rent over
1970 based on higher taxes. Motion by Land, seconded by Jeska
that the City Manager and the Mayor be authorized to enter into a
new rental agreement For the quonset building at a rental rate of
$93.00 per month and that an attempt will be made to negotiate
a six month agreement with a six month option for the same price.

Ordinance #754 Relating to Diseased Trees.
A second r~ding was ~ld on Ordinance #754 relating to the control
and prevention of tree diseases in the City of Columbia Heights.

Ordinance #754 was adopted.
Ordinances Relating to Use of Drugs.
A series of four ordinances relating to use of drugs was presented
on the mcommendation of the Police Chief, based on ordinances
adopted in neighboring communities, and the County Attorney's office.
First reading was held on Ordinance #755 relating to the sale and
possession of barbiturates and other prohibited drugs.
First reading was held on Ordinance #756 relating to the possession,
sale, distribution, administration, dispensation, furnishing, use
and prescription of certain drugs.
First reading was held on Ordinance #757 relating to the handling,
the regulation of inhaling, breathing, drinking, purchase, sale, and
possession of glue and certain other substances.
First reading was held on Ordinance #758 relating to the regulation
of sale and possession of codeine.
48.
Resolution Vacating Easement on 4Oth Avenue.
A resolution vacating a construction easement on the south fifteen
(15) feet more or less of Lot Six (6) in Block Two (2) Rearrangement
of Block "D", Columbia Heights Annex, was offered by Logacz, seconded
by Jeska, BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights that, WHEREAS, there is on record an easement
document No. 102265 on file dated May 29, 1941 from Arthur S. Porter
and Julia A. Porter, his wife, executed in favor of the City of
Columbia Heights, and WHEREAS, said easement was granted for the
purpose of maintaining fill thereon during the construction of
4Oth Avenue N.E. which purpose has now been satisfactorily fulfilled.
NOW, THEREFORE, it is determined by the City of Columbia Heights
that said easement is no longer necessary or of benefit to said
City and the Mayor and City Manager are hereby authorized to
execute a release of said easement. Roll Call - All Ayes.
Resolution Setting 1971 Liquor Store Employee Salaries.
A resolution setting 1971 Liquor Store employees salaries was offered
by Logacz, seconded by Jeska, BE IT HEREBY RESOLVED by the City
Council of the City of Columbia Heights, that the following changes
in salaries and fringe benefits as negotiated be effective retro-
active to January 1, 1971 for the Municipal Liquor Stores.
1. Liquor Store Manager to receive $11,600 plus hospitalization.
Assistant store manager to receive $11,370 plus hospitalization.
2. Regular bartenders to receive $4.02 per hour plus hospitalization.
Part-time bartenders to receive $4.02 per hour. New bartenders
to be paid 25¢ per hour under scale for a 30 day probaticnary
period. 3. Waitresses to receive $2.70 per hour plus
hospitalization, with a $50 per year uniform allowance. 4.
All three (3) regular off sale clerks to receive $3.35 per hour
plus hospitalization. Part-time off sale clerks to receive $3.22
per hour. Regular janitor to receive $3.60 per hour plus
hospitalization. Part-time janitors to receive $3.00 per hour.
Glass washer to receive $2.75 per hour. Part-time custodians to
receive $2.48 per hour. 5. The union sponsored Health and Welfare
program is discontinued due to a duplication in coverage with the
City-sponsored Blue Cross and Blue Shield hospitalization plan.
6. All other fringe benefits as set forth in the 1970 Council
Resolution to remain in effect for 1971. BE IT FURTHER RESOLVED
that the foregoing changes be effective in accordance with the
schedule as listed herein for the calendar year 1971. Roll Call -

Resolution on Police Pensions.
Resolution requesting the Legislature of the State of Minnesota to
make certain changes in the pension program for members of the
Police Department of the City of Columbia Heights in recognition of
the excessive financial demands required to meet projected funding
requirements for the existing pension benefit schedule was offered
by Jeska, seconded by Land, WHEREAS, the City Council of the City
of Columbia Heights and the Columbia Heights Police Relief Associatio~
did in 1965, mutually agree to be bound by the laws relating to

Police Pensions governing cities of the third class, M.S.A. 423.37, and
WHEREAS, said laws specified a rate of contribution by both the City and
active duty members of said Police Relief Association into the fund,
and delegated sole responsibility for the proper management and control
of all funds of the Police Relief Association to the members of the
Association themselves, including the sole power via bylaw amendment,
subject to certain minimum and maximum limits, to adjust benefits so as
to maintain over-all solvency of the association, and WHEREAS, benefit
schedules have been set by the Association considerably in excess of the
ability of the prescribed funding to support, resulting in a considerable
actuarial deficit for fund balances of the association, and WHEREAS, the
"Guidelines Act" passed by the 1969 Session of the State Legislature has
resulted in a required Police Relief Association contribution for 1971
by the City of Columbia Heights in an amount equal to $1,674 per active
duty man in the department, and is projected to cost the City $3,900 per
man in 197~, and $10,400 in 1982 (City contribution was $1,250 per man
in 1970, the last year before the "Guidelines" formula became effective),
said projected costs to City will be approximately 50% of payroll,
whereas, active duty officers will only be required to put in 6% of salary,
and WHEREAS, the City Council of the City of Columbia Heights deems these
costs to be beyond the realm of reasonableness with respect to the ability
to the taxpayers of the City of Columbia Heights to be expected to pay,
and WHEREAS, extended negotiations over a period of several months between
the City Council and the Policemen has failed to produce a meaningful
reduction of these costs, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY
OF COLUMBIA HEIGHTS respectfully requests the State Legislature to enact
into law certain changes to existing law as pertains to the City of
Columbia Heights and the Columbia Heights Police Relief Association, as
follows:
Maximum allowable retirement benefit be based on following:
Minimum retirement age to be 58.
Minimum retirement benefit to require 20 years of paid-in service to
fund.
Retirement benefit not to exceed 30% of the top five-year average
salary of the t~p patrolman salary during the active duty years of
the officer receiving said benefit within an additional maximum
allowable benefit not to exceed 2% per year of said average salary for
each additional year of paid-in service beyond 20 years, but for no
years beyond a total of 30 years of paid-in service.
Members retired and drawing benefits as of July 1, 1971, or on
deferred benefit status on such date, shall be deemed to have 20 years
of paid-in service with a five year high average top patrolman salary
schedule equal to the 1968 salary schedule for top patrolmen. Said
members shall also be eligible for a retirement benefit not to exceed
50~% of said top patrolman salary and shall further be eligible for
said benefit at age 50.
Maximum allowable disability benefit shall be based on following:
A total disability benefit may be allowed not to exceed 30% of top
patrolman salary in department at time of disability, and commencing
from date of said disability, to any active officer of the department
with a minimum of ~ix months of full-time service.

No disability benefit to be al l owed where disability was the result
of gainful employment outside of the department.
Maximum allowable widow and children benefit shall be based on the
following:
Deceased member to haYe had a minimum of six months of paid-in
service for benefit to apply.
Maximum allowable widow benefit not to exceed 20% of top patrolman
salary in department at time of death for remainder of life of
widow, or until she shall remarry.
Maximum allowable benefit for each child of a said deceased officer
shall not exceed 5% of top patrolman salary in department at time
of death and shall cease at age 18 of said child.
Total maximum allowable widow and children benefit of deceased member
shall not exceed 40~ of department top patrolman salary at time of
dea th.
Cost Participation by City and Members of Association.
1. Active duty officers of association shall contribute a minimum of
6% of salary to benefit fund during each payroll period.
2. City shall contribute an amount equal to 9% of salary for each active
member of association during each pay period.
3. Neither City or active duty officer shall be required to contribute
to fund for service of individual officers in excess of 30 years of
paid-in service.
4. An actuarial survey shall be made of fund on or before July 1, 1972.
Any deficit existing at such time shall be paid by the City in
equal installments over a period of 40 years. Subsequent actuarial
studies shall be made on or before July 1st of every fourth year
following. Any additional deficits brought forth by such actuaries
shall be made up by a contribution from both City and active
department officers in a 60-40 ratio.
5. City and active department officers shall have the right to negotiate
additional cost participation in fund on the basis of a cost sharing
not to exceed 60% of said additional costs by the City, and not
less than 40% of said additional costs by the active duty officers
of the association.
6. Should any additional sources of revenue be made available to the fund,
they shall just be used to reduce the City required annual contributi~
to fund the deficit until such deficit is eliminated.
BE IT FURTHER RESOLVED that the foregoing proposals be set forth as a Bill
For An Act by the 1971 Legislature and copies of this resolution be
submitted to ali members of the Legislative Retirement Study Commission

Resolution Opposing Metropolitan Park System Bill.
Resolution was offered by Heintz, seconded by Logacz, WHEREAS, Anoka
County has demonstrated its willingness and ability to plan, build,
and operate a county park system, subject only to current limitations
on funding, and WHEREAS, H.F. 1678 and S.F. 1237 would unnecessarily
set up a new level of government on a metropolitan basis to handle

this function, NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Columbia Heights does hereby indicate its opposition to
H.F. ]678 and S.F. 1237 and recommend the fo]iowin9 actions be taken in
its place:
That the Hetropolitan Council be authorized to prepare a metropolitan
park system plan.

That any funds which are, or become available for park purposes be
channeled to those units of existing local government for
facilities which conform to said park system plan.
BE IT FURTHER RESOLVED that copies of this resolution be submitted to
