Shell Oil Proposal. A lengthy discussion was held on consideration of Ordinance #746 vacating Spains Alley for Shell, and a resolution authorizing an agreement with Shell relating to a proposal for construction of a new service station at 37th and Central. Mr. Guzy, Attorney for Shel 1, Mr. Illstrup and other representatives from Shell were present at the meeting. Mayor Nawrocki reported the matter was referred to the Planing Commission for a report, and discussions were held on the recommendations from the Commission and the City Planner as follows: Lights: No light or any combination of lights which cast light upon a public street shall exceed 1 foot candle meter reading ~ measured from the center line of said street nor shall any light or combination of lights cast light upon residential property exceeding 0.4 foot candle meter reading as measured from any part of a residential lot or structure. Fence and screening: Indicated on the plot plan. (Mr. Guzy reported that for the most part screening they propose would be artifical plants.) Parking: The Council members favored seven automobile to be parked for no more than five days and included this item in the agreement. Sign: The proposed sign would not exceed 4'. Mr. Illstrup said visually you will get the effect of a 7' sign as the intersection is 3' below grade of the location of the proposed sign. Refuse: Councilman Heintz expressed concern over refuse pick-up and requested the City Attorney to amend Ord. #472 to cover trash and refuse pick-up for commercial and industrial users. A second reading was held on Ordinance #746 Vacating Spains Alley from Central ~venue N.E. to Reservoir Boulevard N.E. and Platting a new Public Alley along the northerly 20 feet of Lot 12, Spains Addition for access from the north-south public alley north of lot 12 to Reservoir Boulevard. The ordinance was offered by Heintz, seconded by Land, Roll Call - All Ayes. Ord. #746 was adopted. Resolution authorizing agreement was offered by Land, seconded by Jeska, WHEREAS the City Council of the City of Columbia Heights has had extended discussions and hearings with Shell Oil Company, and WHEREAS, an agreement attached hereto has been proposed, NOW, THEREFORE, BE IT HEREBY RESOLVED by th City Council of the City of Columbia Heights that the Mayor and City Manager be authorized to execute me agreement for and on behalf of the City of Columbia Heights. A first reading was held on Ordinance #752 - Authorizin~l Sale of that part of Lot 3, Com. at SW Cot. of Lot 3; th. N. a'long W. line to a pt. 135' S. of NW cor; th. E. & par. with N. line along a line hereinafter referred to as line "A" a dist. of 129.6' to A~act. pt. of beg. of line a dist. of 60'; th. E. a par. with N. line to a pt. of intersection with l~e W. line of E ½ of L. 3; th. S. along said w. line of E ½ to a pt. of intersection with the E'ly of aforesaid line "A"; th. French, ~I~X~ Along Side 4525 University. A first reading was held on Ordinance #753 - Authorizing Sale of that part of Lot 3 described as follows: beginning at the SW corner of said Lot 3; thence N. along W. line thereof to a point 135' S. of N.W. corner; thence E. & parallel with N. line thereof a distance of 129.6'; thence continuing E. in a straight line along an extension of last named course to a point of intersection with the W. line of the E½ of Lot 3; thence S. along said W. line of E½ to the S. line of said Lot; thence W. along the S. line thereof t° the point of beginning, Block 3, Columbia Heights Acres, to Leonard H. and Frances E. French, for $125.00. Commercial Building at 945 - 4Oth Ave. A discussion was held regarding proposed commercial development at 945 - 40th Avenue. The area development plan from Midwest Planning was reviewed and the projected land use at that location discussed. Mayor Nawrocki expressed concern about having adequate parking for development in that area. The parking for the Post Office development east of the apartment building was also reviewed. In view of the proposal not conformingwith any of our zones the Council directed the City Attorney to prepare an ordinance amending our present zoning ordinance creating the appropriate zone which would conform with the city comprehensive plan which would allow dwelling units in conjunction with a commercial establishment. Petition For Removal of Bus Route from Upland Crest. A petition was received signed by the residents on Upland Crest requesting removal of the bus route from Upland Crest be~een Fairway Drive and Heights Drive. The petition indicated they wish to maintain bus service in the area but feel the community can be served better by using Stinson Boulevard and thus relievethe home owners from direct assessment for street breakdown caused by heavy~ buses. Motion by Jeska seconded by Heintz to refer the petition to the Traffic Commission. Roll Call - All Ayes. The Council expressed the desire for the Commission to hold a hearing on the matter and notices will be sent out to affected residents. Mayor Nawrocki reported he was reappointed to the Transit Commission and will bring the matter up at the next meeting. 36. Request Reduced Utility Rate. A request was received from Joseph E. Couillard, 4235 Washington appeali denial of his request for hardship classification on utilities. His application form indicates he is age 72 and his wife age 62 ~with a total household income of $3,786.00 which exceeds the limits set u f~n the guidelines. The Council members indicated we set up the guidelines and should stick with them. Motion by Jeska, seconded by Logacz that the request be denied. Roll Call-All Ayes. Appointment to Boards and Commissions. Motion by Land, seconded by Jeska that Carl Caskey be reappointed to the Human Rights Commission. Roll Call All Ayes. The City Manager reported Mr. Burton Klietz who served on the Recreation Commission has indicated that due to job conflicts he cannot accept reappointment to the Commission. A certificate of appreciation will be made up for him. A new appointment will have to be made to the Commi ss ion. Request Expenses For 3 to Submit H.U.D. Application in Chicago. The City Manager requested expenses for three people to go to Chicago and submit our H.U.D. storm sewer application on Thursday, March 25th, the major expense to be round-trip plane fare. Mayor Nawrocki suggested a follow-up also be made on the senior citizen housing application while City staff members are in Chicago. Motion by Heintz, seconded by Jeska that the request for necessary expenses be granted. Roll Call - All Ayes. Request Attendance at Fire School. Motion by Logacz, seconded by Jeska that the request for two members of the Fire Department to attend the Minnesota State Fire School April 26-29 in the Twin Cities be granted, registration fee of $25.00 each be authorized. Roll Call - All Ayes. Request Release from Easement. Art Porter was present requesting the City ~void an easement on the south side of his property on 40th Avenue that was granted in 1941. The easement was to put fill in and keep the street from eroding and now that the lot is filled up there is no need for the easement. Motion by Land, seconded by Jeska that the City Manager and City Attorney prepare the proper ordinance to release the easement on the property on 40th Avenue. Roll Call - All Ayes. 37. Ordinance #754 Relating to Tree Diseases. A first reading was held on Ordinance #754 relating to the control and prevention of tree diseases in the City of Columbia Heights. A discussion was held on who would pay for removal of diseased trees in the boulevard, who has authority to give notice to remove diseased tree, transporting diseased wood. Resolution Supporting Proposals for Relief of Fiscal Disparities. A resolution supporting legislative proposals for relief of fiscal disparities conditions in the Metropolitan Area was offered by Logacz, seconded by Jeska, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heighls that the Legislature of the State of Minnesota be, and they are hereby respectfully urged, to pass legislation to relieve the fiscal disparities condition which exists between taxing districts in the Seven county metropolitan area. BE IT FURTHER RESOLVED that tax adjustments and distributions of revenues as recommended be instituted during this term of the legislature to become effective at the earliest possible date. Roll Call - All Ayes. Resolution Authorizing Joint Use Rental Ag___~reement with Metro Sewer Board. Resolution offered by Land, seconded by Jeska, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the Mayor and City Manager be authorized to enter into a joint use rental agreement with the Metropolitan Sewer Board for interceptor sewers 1-C0-442 serving north end of Hilltop, 1-C0-443 serving south end of Hilltop, and 1-C0-444 in the vicinity of 40th and Main Street in Fridley. Roll Call - All Ayes. Resolution Authorizi'.n~ Interceptor Acquisition Agreement with Metro Sewer Board. The resolution was offered by Jeska, seconded by Heintz, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the Mayor and City Manager be authorized to enter into an agree- ment with the Metropolitan Sewer Board for the acquisition by the Board of the interceptor sewer 4FR-440 serving 45th Avenue and 2nd Street to Marshall and 37th Avenue. Roll Call - Ali Ayes. Mayor Nawrocki said he wanted to know if we are being charged fairly on these two agreements with the Metro. Sewer Board. Resolution Setting 1971 Salaries for Fi refighters. A resolution setting 1971 salaries for fire department employees represented by Local 1216 was offered by Land, seconded by Heintz, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the following salaries be established for employees in the Fire Department represented by Local 1216, effective January 1st, 1971. The salary figures do not include the individual hospitalization plan premiums which are to be paid by the City. 38. $890.00 per month for a first grade firefighter. Captains: $55 per month over salary for a first grade firefighter. The step scale system to reach first grade firefighter shall be the same as previously established. All other fringe benefits as previously set forth in Council resolutions referring to the Fire Department shall remain in effect~in 1971. Roll Call - A11 Ayes. Resolution Authorizing Transfer for Library Purposes. Resolution was offered by Jeska, seconded by Heintz, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the City Treasurer be, and he is hereby authorized to transfer from the contingency general fund $16,4OO to the library fund in accordance with the agreement to qualify for MELSA retirements in establishing the appropriate expenditure levy for 1971 Roll Call - All Ayes. ' Ordinances Relating~o Sale and Possession of Prohibited Drugs. The City Attorney reported he is preparing several ordinances the Police Chief is interested in relating to sale and possession of prohibite~ drugs and glue sniffing. These will be presented at the next regular meeting. The ordinances are similar to those in Blaine and Anoka. Resolution Increasing Length of Trucks on 4 Lane Highways. Resolution Supporting the Adoption of Senate File 588 and House File 655 Increasing the Length of Trucks Permitted on Four Lane Highways was offered by Jeska, seconded by Heintz, WHEREAS, efficiency in transportation is vital to the economy of the State of Minnesota, and WHEREAS, Minnesota truck length laws are substantially more restri~ive than the laws of the majority of other states, and WHEREAS, these variations affect efficiency in operations and result in increased transportation costs thereby putting Minnesota industry at a competitive disadvantage; and WHEREAS, the business and commercial economy of Columbia Heights is highly dependent upon efficient and economical truck transportation, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Columbia Heights as follows: 1. The City Council endorses and supports Senate File 588 and House File 655 which, when adopted, would authorize 65 foot combinations of truck-trailer, semi-trailer, and trailer to operate on four lane highways in the State of Minnesota. 2. The representatives of the people of Columbia Heights are herewith called upon to support the work for the adoption of this legislation and the Clerk is hereby directed to transmit copies of this resolution to the aforementioned representatives, the Chairman of the appropriate legislative committees, and to the Governor of the State of Minnesota. Motion by Jeska, seconded by Heintz that the City Attorney be authorized to attend Legal Education Course April 2nd and 3rd at the Thunderbird Motel including registration fee of $35.00. Roll Call - All Ayes. Request Attendance at Sewer & Water Maintenance School. Motion by Heintz, seconded by Logacz that four men from the Sewer & Water Department be authorized to attend maintenance school in April, registration fee of $20 each. Roll Call - All Ayes. Licenses. Motion by Heintz, seconded by Jeska that the licenses as listed be granted upon payment of proper fees. Roll Call - All Ayes. Motion by Heintz,. seconded by Land that the solicitors license request from the Council for Corporate Review to sell balloons on street corners for American Friends Service Committee's Quang Ngai Hospital Project be granted and the fee waived on the basis of a charitable organization.
