The City Manager presented one other resolution directing delinquent
assessments to the County Auditor, Offered by Heintz, seconded by Jeska,
BIZ IT HEREBY RESOLVED by the City Council of the City of Columbia Heights,
that the County Auditor be, and he is hereby directed to levy the delinquen't
special assessments on the properties in the City of Columbia Heights as
submitted on the duplicate statement form with the amount to be levied
indicated opposite the stamp ~'Certified to County Auditor". BE IT FURTHER
Rt--SOLVED, that the foregoing amounts shall be included in the individual
real estate tax statements for the current year and identified thereon as
special assessments. Said levies shall be enforced and collected in the
manner provided for the enforcement and collection of state and county
taxes under and in accordance with the provisions of the general laws
o'F the state. All assessments with penalties and interest as indicated
thereon pai.d to the County treasurer shall belong to the City of Columbia
Heights and shall be turned over to the City Treasurer in the manner
provided by the City Charter' and Ordinances. The City of Columbia Heights
shall accept payments on these levies until the end of the calendar year.
Upon receipt of said payments the County will be notified to remove this
levy from the tax rolls. Roll Call - All Ayes.

Regular Meeting

The regular meeting of the City Council was held Monday, October 13, 1970.
The meeting was called to order at 8:12 p.m. Roll Call: La nd, Heintz,
Jeska, Logacz, Nawrocki - present.
Motion by Heintz, seconded by Land that the minutes of the last regular
and special meetings be approved as presented in writing and the reading
dispensed with. Roll Call - All Ayes.
Payment of Bills.
A ~scussion was held on payment of two bills to Orfei & Sons.
Concern was expressed over the street restoration work on the watermain
project and it was suggested we should maybe withhold payment to Orfei
until restoration is at a better stage of completion. Motion by
Jeska, seconded by Logacz that the following bills be paid out of
their proper funds with the exception of 10068 and 10069 to Orfei,
that ~these two bills be again looked at and report back. Roll
Call - All Ayes.

Remote Readers.
A discussion was ~Xheld on the remote reader bid by Badger Meter Co.,
the low bidder. Mr. Radmer, representing Badger, was present to answer
questions on the telephone conversion system, and after a lengthy
discussion it was decided to move on in the meeting and come back to
the award of bids after more discussion and a brief demonstration of
the Badger unit.
Award of Bids on Industrial Tyle Tractor.
Motion by Jeska, seconded by Heintz that the bid on the industrial type
tractor for the Park Department be awarded to Midway Ford on the basis
of low bid on Model #31023C in the amount of $3,294.00. Roll Call -
All Ayes.

Ordinance #740 - Sale of Property--
A second reading was held on Ordinance #740- sale of property to
Rand Realty, a copartnership, consisting of Albert V. Rosenbower and
Iven Dostaler. All that part of Lot Three (3), Block One (1),
Apache Heights, described as follows: That part of vacated 40th
Avenue Northeast and of vacated McKinely Street Northeast which
accrued to Lot Three (3), Block Ten (10), Auditor's Subdivision of
Waltonls Sunny Acres Fourth, according to the plat thereof on file and
of ~record in the office of the Register of Deeds ~within and for
Anoka County, Minnesota, by reason of the vacation thereof, which lies
within the boundaries of Lot Three (3), Block One (1), Apache Heights,

Ordinance #741 amending #700 - Sale of Property.
A second reading was held on Ordinance #741 amending #700, sale of
property to Andrew P. Ocel and Elizabeth Ocel, North 1/2 of Lot

the South 1/2 of Lot Eleven (11), Block Five (5), Valley View, according
to the duly recorded map or plat thereof on file and of record in the

Resolution Setting 1970 Salary for Police Chief.
A resolution setting the 1970 salary for the Police Chief of the City
of Columbia Heights was offered by Jeska, seconded by Heintz, BE IT
HEREBY RESOLVED by the City Council of the City of Columbia Heights
that the salary of the Police Chief be established at $1,O00 per
month for the calendar year 1970. Roll Call - All Ayes.
Resolution Authorizing Acce.ptance of Reimbursement Funds.
A resolution authorizing acceptance of reimbursement funds for basic
training of Police officers in the City of Columbia Heights was offered
by Logacz, seconded by Jeska, BE IT HEREBY RESOLVED by the City Council
of the City of Columbia Heights that the Mayor and City Manager be
authorized to accept reimbursement funds pursuant to Laws, 1969, Ch.
i139, Sec. 13, Subd. 4, and P.L. 90-351 for the defraying of costs of
salaries expenses and substitute protection during the basic training
of officers: John T. Downey, Thomas D. Larson, RichardXX~X~Schmidt,
James F. Kapala, and Leonard M. Olson. Roll Call - All Ayes.
Lot Subdivision, 349 - 42nd Avenue.
Mrs. Irene Jolly of 349 - 42nd Avenue was present requesting
consideration for a lot subdivision to allow a garage west of her home.
She indicated she would talk with some builders and would report back
at the next meeting. Motion by Jeska, seconded by Heintz that the
lot subdivision request be tabled until the next regular meeting.

Side Yard Waivers 4609 Poll~ Street.
Mr. Wayne Matterson of 4609 Polk Street was present requesting a
side yard waiver for an enclosed step down side entry three feet
off the lot line he constructed without a bdlding permit
He stated the steps lead down to his ~tuck-under garage and the
problem is snow and rain falling on the concrete steps. Motion by
Heintz, seconded by Land that based upon the recommendation of the
Planning Commission, that the lot side yard waiver of 2' be granted
for construction of an enclosed stairway on the side of the house,
and that the letter submitted from his neighbor stating no objections
to the enclosure be placed on file. Roll Call - All Ayes.
Request for Rezoning 4201 Jefferson.
Mrs. Florence Dzuik and her attorney, Lester Sokol, were pre~nt to
appeal the Planning Commission denial of her rezoning request for
4201 Jefferson to C-1 to operate a catering kitchen in the old
Schultz grocery store. It was explained that Mrs. Dzuik will not
do any selling or baking in the building, that this is only for
assembly of her catering business, and a petition signed by 100~
of the neighbors was submitted stating no objections to the operation~.
The Building Inspector stated the building was up to code and is in
sound condition. The Council members did not seem to favor rezoning
to C-1 but said they would consider a special use permit in R-C
zoning. Motion by Heintz, seconded by Land that the request be
referred back to the Planning Commission with a request for them
to reconsider the rezoning for R-C. Roll Call - All Ayes.
Request Renewal of Used Car License, 4042 Central.
Mr. Gaylor~submitted a request for renewal of his used car lot
license ~ 4042 Central, the request being unanimously recommended
from the Planning Commission. Motion by Jeska, seconded by Logacz
X~X~X~X~X~X~that the used car lot license renewal be
granted upon payment of proper fees. Roll Call - All Ayes.
Request Special Use Permit, 700 - 40th Ave.
Mr. Gerald Johnson, Johnson Bros. Oil Co., 4043 Central Ave. requested
a special use permit ~ operate an office at 700 - 4Otb Avenue as
recommended by the Planning and Zoning Commission. Motion by Jeska,
seconded by Heintz that the request to operate a fuel oil sales
office be granted with the provision that no fuel oil trucks will
be ~parked on the ~te. Roll Call - All Ayes.

137.
Truck and Trailer Lot License Request, 5101 University.
A request was received from Duffy's Skelly, 5101 University Ave.,
for a truck and trailer lot license as recommended by the Planning
Commission. Skelly is now in the process of remodeling the station
and the blue prints were presented to the Council members, as were
the proposed layouts ~Kshowing where the trailers would be parked
along the north property line. Motion by Heintz, seconded by Logacz
that the license be granted subject to the following conditions
laid down by the Planning Commission: That landscaping, screening
fence and blacktopping, as indicated on the remodeling blue print,
must be done. The fence must be finished by January 1, 1971,
and the blacktopping and landscaping must be finished by June 1,
1971. Roll Call - All Ayes.
Truck and Trailer Lot License Requ.est,. 4200 Central.
Mr. Dwight Sundee~ and Mr. Robert Nelson were present requesting a
license to operate a rental business at the old tavern and Buchta
garage at 4200 Central as recommended by the Planning Commission.
Concern was expressed over the use of the house at the rear of the
garage and whether the area would be blacktopped. Motion by Jeska,
seconded by Heintz that the truck and trailer license be granted
subject to the following conditions:
1. That the house at the rear be used only in conjunction with
the rental business by the operator of the business, the
change to take place at the consummation of sale.
2. That the firm proposal for remodeling of the property be
presented by December 31st for consideration by the Planning
Commission and the City Council and that such remodeling work
as approved by the Council be completed by June 1st, 1971.
3. That the operation, in accordance with the lay-out as
presented, that none of the grassed area at the rear of the
tavern and garage be used for any part of the rental operation.
Roll Call - All Ayes.
Chatham Road and Fairway Drive Vision Hazard.
The Traffic Commission has recommended that the Council instruct
the owner of a spruce tree in the south east corner of Fairway Drive
and Chatham Road to remove the tree as it blocks motorists vision.
The City Engineer stated he spoke with the owner of the tree who ~X~
said he would like to save the tree if possible. The question of
signing the intersection was brought up as an alternative but the
Engineer said he has gone over this with the County and they are not
in favor of signing. Mayor Nawrocki suggested exploring the
possibility of the County handling the problem as a part of the
clean-up work on the project of widening the street and find out
how much money we are talking about to get a new tree ~XKfor the
owner or possibly re-locating the existing one.
138.
Award of Bids on Remote Readers.
A lengthy discussion was held on the Badger unit and the cost of
ins~ ling the equipment was gone over by Mr. Radmer, representative
of Badger. Motion by Jeska, seconded by Heintz that we accept the
low bid of B~tger Meter Co. at the rate of $15.65 per unit for
mechanical units, and $18.65 per unit for magnetic units as needed,
that the Mayor and City Manager be authorized to enter into a contract
for same. Roll Call - All Ayes.
Request from Jaycees to Hang Banner Across Central Ave.
Motion by Land, seconded by Heintz that the Jaycees be authorized to
hang a banner across Central Avenue near 40th, u~ing people to vote
on November 3rd and that the necessary certificates of insurance be
filed with the City. Roll Call - All Ayes.
Request to Cancel Check.
Motion by Jeska, seconded by Land that check #9377 in the amount of
$15.60 issued to Joe Rak be cancelled. Roll Call - All Ayes. This is
the check cashed at MJim's Barber Shop in Skywood Mall where a break-in
and fire were involved.
Request to Conduct Auction at 3960 Central.
A request was received from Wally Laumeyer Auction Co., to conduct
an auction at R & R Equipment, 3960 Central, October 18th, 1970.
Motion by Jeska, seconded by Land that the license be granted upon
payment of proper fees. Roll Call - All Ayes.
Appointment to Library Board.
Motion by Land, seconded by Heintz that Donna Ingvarsson, 4354 Royce
Street N.E., be appointed to the Library Board to fulfill the
unexpired term of Claude Johnston. Roll Call - All Ayes.
Request for Special Council Me~in~.
The City Manager requested a special Council meeti~ be held Thursday,
October 15th at 8:00 p.m. to discuss watermain, restoration projects.
The contractor, Mr. Orfei, will be contacted and asked to be present
at that time.
Agreement for Custodial Services.
M~ion by Jeska, seconded by Heintz that the Mayor and City Manager be
authorized to enter into an agreement to extend the option for custodial
services for the library building and municipal building for an
additional year in accordance with the contract dated October 29, 1969.

Street Lighting on Hart Boulevard.
The City Engineer reported he has contacted the neighbors along
Hart Boulevard regarding paying for street lighting and they agree
to the proposal.
Call for Bids on Vertical Power Drill.
Motion by deska, seconded by Meintz, that the City Manager be
authorized to advertise for bids for a vertical power drill, bids
to be opened October 26, 1970. Roll Call - All Ayes.
Rental of Ganzer Building on 39th Avenue.
Motion by Jeska, seconded by Heintz that the Mayor and City Manager
be authorized to enter into an agreement with Mr. Ganzer for use of
his building on 39th Avenue N.E. for storage of sewer and water
department equipment. Roll Call - All Ayes.
Defensive Driving Course.
Mayor Nawrocki presented a booklet describing the defensive driving
course sponsored by the Minnesota Safety Council and suggested
interested employees take the course on their own time.
Licenses.
Motion by Jeska, seconded by Heintz, that the licenses as listed be
granted upon payment of proper fees. Roll Call - All Ayes.
Field House Sound System.
M~ion by Jeska, seconded by Land, that the expenditure of $645.00
for a speaker system in the field house be approved. Roll Call -
All Ayes.
Garbage Complaints.
Mayor Nawrocki asked if the garbage collection people were leaving
no pick-up reports at homes they refuse to pick up and reported a
no pick-up complaint he received from 39th and Tyler. Councilman
Jeska reported the collection people missing a home across from him
on Forest Drive.
Educational Assistance Allotment.
No action was taken on Police Officer Stroctman's request for
educational assistance and the City Manager stated he would get
something from Prof. Smythe in this regard.
140.
Tuition P~ments for Human Rights Commission Members.
Motion by Logacz, seconded by Land, that the tuition payments for
Mrs. Harold Wilson, William Henschel, and Gloria Chadwick for an
In-Service Training series sponsored by the State Department of
Human Rights Community Services Division, and Mr. William Craig's
honorarium of $25 be approved subject to their ~ng funds available
within the Human Rights Commission budget. Roll Call - Land, Heint~
Lbgacz, Nawrocki - Ayes. Jeska - Nay.
Councilman Jeska stated he would prefer to send only one person to
the In-Service Training Series.

Also in attendance were City Manager Watson, City Engineer Brown,
City Attorney Sokolowski, Assistant City Engineer Gustafson, Les Proper
from the Engineering Department; Ron Orfei, Orfei & Sons, contractor;
and Mr. Bill Miller from Dunkley Surfacing, subcontractor.
Mayor Nawrocki stated 1he purpose of this meeting is to consider a
claim for payment to Orfei & Sons for watermain work, payment which
was denied at the last regular Council meeting because of considerable
concern expressed over restoration work. The Council members felt
the restoration work should have been done in the same order as the
watermain installation work and that the contractor should have
brought in more crews to do restoration work. Other concerns expressed
by the Council included dust control, barricading streets, and
bringing the surface of the streets back to as close as they were
before excavation as promptly as possible. Mr. Gustafson and Mr.
Orfei explained their work procedures and reported on some of the
difficulties encountered since the beginning of the project.
Mr. Gustafson stated he has pushed the contractor very hard to get
the work done as fast as they have and said all of the mains are now in
so only restoration work remains and with good weather should be ·
done before freezing. Mr. Orfei stated "In three weeks time, weather
with him, the job will be restored. The roads will be pretty well
