Special recognition was given to Miss Linda Johnson of Columbia Heights who has won the Miss Majorette of America contest. Mayor Nawrocki presented her with the following Proclamation: WHEREAS, that Linda Johnson has received the honor ~of being named Miss Majorette of America at the age of 12 years being the youngest girl ever to receive this honor, and WHEREAS, through her endeavors in nation-wide contests she has gone on into our community through publicity in all news media, NOW, THEREFORE, as Mayor of the City of Columbia Heights, I do hereby take this means of officially extending the congratulations of our community to a most worthy young representative of our community of whom we are all justifiably proud. Appointment of Dr. Williams to Health Board. Motion by Heintz, seconded by Jeska, that Dr. Paul Williams be appointed as Health Officer of the community and that he serve on the Health Board. Roll Call - All Ayes. Ordinance #735 regulating truck and trailer rentals, and Ordinance #736 licensing truck and trailer rental sites. Second readings of Ordinances #735 and 736 were held but the ordinances were not offered, seconded or voted upon. A number of people were present for a public hearing on the proposed ordinances and a discussion was held on the sections relating to size of the trailers, parking requirements and accessories. The Attorney for U-Haul discussed sections 5 and 7 and Section 10 of #736 which he felt were objectionable. As far as Section 5 was concerned, he said there should be a given location where the trailers would go beyond the building line but set back ~r enough so as not to obstruct traffic view and not bother the neighbors. Section 7, size of trailers, the attorney felt the sizes were unreasonable as they can show the size of the trailers in the metro area go from 6' X 14' as the maximum to 4' X 6' He said the accessories are always stored inside the station at night but for display purposes they should be outside, therefore, Section 10 is unreasonable. Councilman Jeska proposed a change in Section 7 as follows: He said he would like to eliminate all of Section 6 and make Section 7 into Section 6 which would then read "That the plot plan shall designate the areas in which trailers and/or trucks for rental shall be parked with a proposal as to the number and types of units to be parked therein;" I The Council also proposed changes in Section 4, hard surface, asking to make it cement or bituminous and not the crushed rock, and asking that the language in Section 5, 6, 7, 9, and 10 on size and location of trailers and accessories be cleaned up. Several people who live near the two service stations effected by the ordinances, Skelly on 51st and University, and DX on 50th and Central, were present and talked of the pros and cons of the ordinances and a petition signed by people who feel Skelly is being operated in a reasonable manner was presented. Motion by land, seconded by Heintz to accept the petition on Jerry's Skelly Service, and place it on file. Roll Call - All Ayes. Motion by Land, seconded by Heintz, to continue the hearing on Ordinances #736 and #735 until the next regular meeting, Monday, August 24, 1970 and the City Attorney is hereby instructed to revise the ordinances according to the suggestions above. Roll Call - All Ayes. Lot Subdivision Request. Motion by Jeska, seconded by Heintz that the lot subdivision request for 808- 4~.th Avenue and 4455 Quincy Street be tabled until such time as a Surveyor's Certificate is brought in. Roll Call - All Ayes. Fence Waiver for 1910 Fairway Drive. for a waiver A request was received~for a basket weave fence from Mr. Kinkle of 1910 Fairway Drive. Mr. Kinkle's neighbor has a similar fence which was put up before the fence ordinance became effective and on this basis the waiver was recommended by the Planning Commission. Motion by Land, seconded by Jeska to grant the request for an air passage waiver and a 2½' height waiver to allow the fence as constructed on the basis of~a letter from the neighbor indicating he has no objection to this. Roll Call - All Ayes. Fence Height Waiver for 411 - 40th Avenue. A request was received for a fence height waiver at 411 - 40th Avenue as recommended by the Planning Commission. The salesman from Sears Roebuck who will sell the fence was present and stated they would like to replace the existing picket fence with a 42" high chain link fence and since this is a corner lot a 6II height waiver is required. Motion by Heintz, seconded by Land to grant the waiver. Roll Call - All Ayes. Home Occupation Permit for 4055 - 6th Street. Mrs. Almay Edwards was present requesting a home occupation permit to operate a beauty shop in the basement of her home at 4055 - 6th Street. The request was recommended by the Planning Commission. Councilman Jeska said the only thing he doesnIt want is the 104. proposed awning over the sidewalk saying a canopy gives it a commercial lo°k. Motion by Land, seconded by Heintz to grant the request for a home occupation permit but that the proposed sidewalk canopy not be put in place. Roll Call - All Ayes. Home Occupation Permit for 3720 Jackson. Mr. Ray Pearson was present requesting a home occupation permit to do small automobile repairs in his garage at 3720 Jackson. The permit was recon~nded by the Planning Commission and a petition was presented signed by his neighbors indicating they have no objections to the operation. Motion by Heintz, seconded by Land, that the request be granted based on the petition signed by his neighbors, and that the operation be restricted to the hours of 8:00 a.m. ~X~X to 9:00 p.m. Roll Call - All Ayes. Request to Purchase City Owned Property. A letter was received from Mr. Ray Sowada, 4113 - 6th Street, to purchase the south 165 feet of the west 50 feet of Lot 8, Block 3, Reservoir Hills on which he plans to build a single family dwelling. Motion by Land, seconded by Heintz that the City Manager be authorized to secure appraisals on the mentioned parcels. Roll Call - All Ayes. Resolution Appropriating Funds for Construction of Footbridge. A Resolution appropriating municipal state-aid funds for trunk highway project was Offered by Land, seconded by Jeska, WHEREAS, it has been deemed advisable and necessary for the City of Columbia Heights to participate in the cost of a construction project located on Trunk Highway No. 65 within the limits of said municipality, and WHEREAS, said construction project has been approved by the Department of Highways and identified in its records as No. 0207-27 (T.H. No. 65-5), NOW THEREFORE, BE IT RESOLVED that we do hereby appropriate from our Municipal State-Aid Street Funds the sum of $45,300 to apply toward the construction of said project and request the Commissioner of Highways to approve this authorization. Roll Call - Land H~XHeintz, Jeska - Ayes. Nawrocki - abstained. Taxi Cab Discussion. A number of representatives from cab companies were present at the meeting. Some misunderstandings apparently existed between these cab representatives and a question was raised regarding the former Council action. After discussing the problems briefly the Council stated that the actions taken at the special meeting wauld remain in effect and Mr. Lamont's cab company would take over the licenses after midnight, Monday, August 10, 1970. 105. Swimming Pool Ordinance. A discussion was held on the proposed swimming pool ordinance. Some of the points raised were the use of woven wire mesh type of fencing, the requirement of a daily record, the location of pools and mechanical units, the 50' requirement from adjacent property owner lot lines, and the requirement of buoys. It was stated that the State code is at the printers but since it only refers to public pools, we can pattern our ordinance after our own needs and requirements. Motion by Heintz, seconded by Land to refer the proposed swimming pool ordinance back to the Planning Commission ~X~X~for review especially on the points as listed. Roll Call - All Ayes. Advertise for bids on remote reading meters. Motion by Jeska, seconded by Heintz that the City Manager be authorized to advertise for bids on remote water meter readers, the bids to be opened September 14, 1970. Roll Call - All Ayes. Request to Purchase Radio. A request was received from the Civil Defense Department to purchase a portable two-way radio to be used by all city departments. The cost is estimated at $650.00 and has been budgeted for in 1970. Motion by Land, seconded by Jeska that the City Manager be authorized to spend up to $650 for a portable two-way radio. Roll Call - All Ayes. Request to Attend I.C.B.O. Conference. Mr. Sonnenberg requested authorization to attend the I.C.B.O. convention in Portland, Oregon, September 6-10, 1970. Expenses will be approximately $490. Motion by Land, seconded by Heintz that the Building Inspector be authorized to attend the I.C.B.O. in Portland, September 6-10 and the necessary expenses be authorized. Roll Call - All Ay es. Appointment of Election Judges. Motion by Jeska, seconded by Heintz that the election judges as listed be appointed for the primary election, September 15th and the general election, November 3rd, 1970. Roll Call - All Ayes. (List attached.) Resolution endorsing Amendment 1 on Tax-exempt property. The resolution was offered by Jeska, seconded by Heintz, WHEREAS, the City of Columbia Heights is by law almost totally dependent on the property tax to finance municipal services; and WHEREAS, the City Council is acutely aware of the burden which property taxes impose on property owners, particularly those individuals living on fixed incomes; and WHEREAS, the City Council 106. is concerned about the steady growth in tax-exempt property which serves to increase the burden of taxpaying property owners; and WHEREAS, the City Council is not unmindful of the valuable services performed by many tax-exempt organizations, particularly religious and educational institutions; and WHEREAS, the Minnesota Legislature has thoroughly studied this problem and expressed its concern through the passage of Laws 1969c.925, which proposes to amend Article 9, Section 1 of the Minnesota Constitution to permit the Legislature to define or limit the classes of exempt property, except clutches, houses of worship and property used solely for educational purposes; and WHEREAS, the City Council believes the proposed amendment to be in the best interests of the City of Columbia Heights and the state as a ~whole, and represents a reasonable means of meeting the need to more equitably spread the burden of financing local government services while at the same time avoiding imposing undue financial hardship on educational and religious institutions; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Columbia Heights endorses the principles of equitable tax policy and reform exemplified in Amendment No. 1 relating to tax-exempt property and urges its ratification. Roll Call - All Ayes. 1971 Budget. A discussion was held on the initial draft of the 1971 budget as presented by the City Manager. It was decided to meet Wednesday, August 12th to go over the entire budget with the City Treasurer. Advertise for Hearing on 4" Watermain. Motion by Land, seconded by Jeska that the City Manager be authorized to advertise for a hearing on replacement of a 4" watermain on Gould Avenue from Central Avenue to the alley west of Reservoir Boulevard,~to be held at the next regular Council meeting, Monday, August 24, 1970. Roll Call - All Ayes. Request to Purchase Curb forms and tools. Motion by Jeska, seconded by Heintz .that the City Manager be authorized to make an expenditure of up to $800 for curb forms and miscellaneous tools provided that the funds are available in the existing budget.
