A petition had~been receive~d signed by ~ prope~t,~ o~mers ~requesting that this alle~ be platted and~ opened, and. at this meeting a p&tition was~ 'turned in signed by l~ prbperty owners starting,that although %~y some of them have %~anted au alley sometime in the past: they do not need nor want an alley now. ~iotmon by Land sec~onded by Hgintz that this pet~ition be placed on file. An ~nusual circumst~ance, is that this alley wag authorized by City Council action on August 8: 1760~ however the project was never ~cempleted although preparatory YJo~rk was don9 and surveys made. 'Mr. Brovrn explained t~st one of the re~asons why it was never put in ~was %hat because of condemnation some of tfe land wag going to be' very costly, s. tso the~re would have tp be ~fences moved and trees ~to come down. At different~ t~nes during the~ past severa~l years people have built home~ in the bloc~k and have been ~informed that there wou~ld be an ~alley, or there would not b~ an alley. Most of the ~eople have now arr. anged for garages fa~cin~ th+e s~eet: but t~o houses: 4327 and ~329 Jefferson, were bui~lt with the assumption that there would be ~an alley. I~ is these two houses who are unable to get their cars off the street. The~e was some question raised as to whether or ~not the 1~60 counci~ action imposes any liability on the city to put in an alley. Mr. ~Sokolowski star, ed that he is not aware of ?ny such liabiIity. Between 4327 aud. 432~ there is enough room for a common driveway: however the~e is as much as 6 feet vaEiatiou in the grade of the two backyards, ~nd. construction of garages and a drive- wax would be diffi~cult and costly, it was retognized t~hat there will have to ~e some follow up: and the City?ttorney was instructed t6 'do some~daecking as to whether the city does have an obligation. Motion by Heintz seconded by Logadz that boulevard par~king be temporarily allowed for the two ho~ses~ and further that the City Manager be instructed to see if something else can be%~orked out. Seekon, 4927 Madison Street, requests a ~ome Occupation Pei~it to ~ operate a mobile appliance repair business from his home. Mr. Ted Brovn~ who ovrns the tot an~. operates Northeast Body Shop, has failed to comply with a directive of the Planning Commission regarding some type of landscaping or planting screen. This was set~ forth as a~ conditio~ for renewal of his Special Use permit for 1970. This proposed ordinance ~ll be prepared by the ~ity Attorney and submitted first to the Planning and Zoning Commission at~ its July meet%ng. The~ Commission has recognized the need for rules governing truck and trailer rentals, and ~Rll probably rec~ommen& that the~ b~ hl%owed o~ly in C-2 or Industrial zones, and then with a Special Use Permit. The Planning Com- mission at their last me'ting have set a limitgtion of 8 trailers and 2 trucks for this station. Cit~ Attorney ReppM%s Mr. Sokolowski reported that he has prepared an ordinance goversing the construction of s,dmming pools, it will be referred to the Planning ComDission for recormuendatioh. He has called the Abstract Office and finds no easement of record on the property at 1848 - 39th Avenue (Gary Tra~rse). (Refer to item of discussion at May 25th meeting). Mr. Sokolowski has studied the communication received from the Metrgpolitan ~wer ~Board, in %~ich the date of our original contract was to b~ inserted. He finds that our contract with the Miune~ olis-St. Paul Sanitary District is perpetual, and that it wa, began in 1942. We are to continue payments to the Minneapolis-et. Paul Sanitary District thru December 1970 after which the Metropolitan Se~mr Board ~,ill take over. City Manager Reports Mr. Wateea reported-that he would like tc take bids on remote registers for water meters. It was decided that he should draw up s!eeificaticns which would cover the various t$~es of equipmeut available~ mud at the June ~2nd meeting a date can be set to receive bids. Special meeting is set for next Monday ever, i~g, when the council can meet at 6:30 ~.rith the labor negotiator, and ab 8 P~Z. :~_th the George M. Their ori~_inal intent wa~= to erect a new chain link fence with slats, but ap- parently they changed their r~inds because of the costs, involved, and have now made repairs on the existing board fence. The residents near McKenna Park (hTth and Seventh Street) have requested a meeting ~_th the .Park Board to discuss park planning.
