The City Engineer stated-~at the grade is extremely flat and it ~Lll have t,o be staked very carefully. He e~stimated a cost of $5 per assessable front foot for~ this lC' ~de alley. (5) These improvements shall alse be known as Project No. 649. passed t5is 25th day of May 19~7~. Roll Call All Ayes. 69. Request for rezonin~ 3738 Reservoir Blvd. (Shell Oil Co.) Mr. Robert Guzy represented °hell Oil Company in their re_~uest for rezoning of Lot 12 Spains Addition fran R-3 to C-2. A rezoning ordinance #711 had a first reading last Septenber but lost for lack of a second. Several residents from the area were present with their attorney ~r. James Tuzinski 6bjecting to the rezoning, the expansion of the station facility, and the vacating of the east-west alley. A petition was presented signed by many property owners within 300 feet. Motion by Land seconded by Heintz that the petition as regards the 37th and Central rezoning be accepted and placed on file. Ail ayes No action was taken on the rezoning or on the vacatin~ of the alley. Cbuncil- men Land, Heintz, and Losacz stated their disapproval of both r~quests, although Councilman Jeska still favors the rezoning. Second R6adin$ of Ordinance 731~ Sale .of Property Orddnance 731 was offered by Jeska seconded by Logacz, authorizing the sale of ~the northerly 25 feet of Lot 13 Block 9 Hilltop to Mr. and Mrs. Jack Keller. Roll call - all ayes Drivewa~ access for 4720 Stinson Blvd. 4726 Stinson Blvd. does not have suf{{cient side yard for a driveway, nor legal access to the pub$ic alley~ich serves lots to the south. Motion by Heintz seconded by Jeska that the City Manager and City Attorney be instructed to in- vestigate the off street parking (or the lack of it) for 4720 Stinson Blvd. and report back as to the manner in which the city might enforce the off stre&t p4rking ordinance with respect to-pFoviding thS parkin~. Ail ayes. Second readin~ of Ordinance 732 - Resulatin[ Use of Alcoholic Beverages The City Attorney reco~r~ended adding a phsase or clause which would fo~,id minors to sell alcoholic beverages. Ordinance as corrected offered by Land seconded by Heintz. Ail ayes. Minneapolis-St.Psul sanitar~ district sewerage works .~ The Minneapolis-St,Pa~l sanitary district suggested thab a resolution be adopted authorizing/~u~d ~e~of the sewers. Howewr this would be only a temporary contract running until August !st, 1970, and no action was taken. Lot subdivision - 4230 Reservoir Blvd. Mr. Frank Biedn¥ was present. The wo~-ding of the legal description for hi~ lot subdivision has now been corrected. No action was ~ecessary. Retainin$ wall - 580 - 43rd A~. ~4.E. Mr. Michael Simons .home at the above address on the southwest corner of 43rd and Washington is on an extremely high bank, and the foundation of the house is in need of same additional support. He wishes to erect ~ retaining walle, east and north of his home. There is no problem with the ~.~all on the ~ashington street side, as that can be erec'bed on his own land; however the wall on the north side along 43rd ~enue would, encroach on ~.~at is now the city's right-of-way. Motion by Land seconded by Jeska th~ the City Attorney be i'~structed t o draft an ordi~auce wb. ich would convey-15 feet of the city property on 43rd Avenue to Mr. Simons allotting him to build a retaining wall as recommended by the City Engineer. Roll call, all ayes. City Property .a.d. jacent £o 18~8 - 39th Avenue Mr. Gary Tra~rse had asked to buy 30 feet of city property adjacent to his ~ home at 18~8 - 3?th Avenue. He already has a driveway easement over part of this l~and, and now he ~Jishes to make a lawn, and~to fence-in the 30 feet. However he is not in a~reement to t~he appraisers valuation of $2,250.00. Mayor Nawrocki exTress~d the city's unwillingness to give up too much of its property in that area since it provides access to Hart Lake. Mr. Traverse inquired as to whether he could then install a fence on the city property for privacy. The City Attorney will investigate the easement which exists, and inform Mr. Traverse and the City C_ouucil. Resolution setting 1970 salaries for Fire Department emp.lp.~ees Reso]~ution offered byHeintz seconded by Jeska BE IT HEREBY RESOLVED, by the City Council of the City of Columbia Heights, ~hat the following salaries be established effective JanUary 1,-19?O for the calendar year 19?O. The s~lary figures do not ~nclude the individual hospitalization plan premiums which are to be paid by the cit~. The monthly salary for each position shall be as follows: Fire Chief $1,000 per month. Deputy fire chief $900 per month. Captains $87h.00 per month. Fire fighters (top scale) $82~.00 per month. The step scale System to reach top firefighter grade~shall be the same as previously established to wit: 1st 6 months -' 7~/hr below top firefigh~er scale 2nd 6 months - 50~/hr below top firefighter scale 2nd year - 30~/hr below top firefighter scale- 3~d year - 20~/hr below top firefighte~ scale hth year - lO~/hr below top firefighter scale ~th year - Top firefighter scale All other fringe benefits as previously set forth in Council r~soi~tions referring to the Fire Department ~o remain in,effect in 1970..Roll 'call, all ayes Solicitors License a~plication - Youth In~entive Mr. Don Templ~n was present requesting a Solicitors License for Youth Incentive~ which he states is a national non-profit organization. They wish to s ell candy from door to door, the $1.30 price being divided as follows: 30~ to 6he child, 37~ to Youth Incentive,. and 63~ for overhead (candy~ office, salari$s, etc.). He was told that each individual solicitor~ should apply for a~ license to~ ell from door-to-door~ and if the organization is really cha~i~bablethe $~/~Spos- .sib!ybe waived, however this could not be done if the sales are forthe p%rpose of dispensing merchandise. Mr. Nawrocki s~ggested that the organization give the .council the names of local people involved in the management of the c ompanY'on a voluntary basis, or the names of known people ~no are affiliated with the 0r- ganiZatio~. Extension of time on Orfei & Sons contra Ct~(H.U.D.)~~ A letter was received from Orfei & SonS reporting that due to strikes all of their work is being curtailed for several weeks. They may require an extension ~of the completion date on their contract, Waich is July 12, 19?l. No action was deemed necessary at this time. 71. Human Bights Commission and i%rit Commission appointments Mrs. Gloria Chadwiek has withdrawn her resignation from the Human Rights Commission, therefore she will fill out her term. Former Councilman Joe Orendorff has stated that he is honored to be considered for appointment on the Merit Commission. Motion by Land seconded by Heintz confirming his appointment. All ayes. Lot Subdivisions Notion by Jeska seconded by Logacz to grant the Subdivision request for Lot 5 )ex. E. 59') (Subj. to road and utility easements over S. 30' of No. 10') Block 2, Reservoir Hills, the outstanding assessments having been paid in full. All ayes. Motion by Heintz seconded by Land to grant the subdivision request for Lot 12 (Ex. E. 50') (Subj. to road and utility easements over N. l0T and S. 30') Block 2 Reservoir Hills, and the special assessments in the amount of $~63.6~ to be divided. Roll call, all ayes. Labor conciliatorls retainer Motion by Jeska seconded by Logacz that expenditures amounting up to $900 be allowed for a labor conciliator for the period from July l, 1970 to July l, 1971. All ayes. Minnesota State Firements Conference~ Fairmont~. Minn. Motion by Jeska seconded by Heintz that expenses for up to 5 men be authorized for the Minnesota State Firemen~s Conference to be held at Fairmont, Minn. on June 12, 13, and l&, 1970. Expenses estimated to be $290.00. All ayes Call for bids on blacktoppin~ at city parks Motion by Heintz seconded by Logacz that the City Manager be authorized to call for bids to be opened at the regular meeting on June 8, 1970, for blacktopping in two areas at the City Parks (1) Astro City area in Memorial Park, and (2) parking lot in the picnic grounds near Quincy Street. Roll call, all ayes. Resolution setting 1970 salaries for employees in the Public Works Department R~sented by Local 66& Teamsters Union, through unilateral action. B~ IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the following salary and fringe benefits be established effective January l, 1970 for the calendar year of 1970 for the members of the public works department not previously covered by salary adjustments for 1970. The monthly s~laries shall be: Heavy Equipment operators $778.00 per month; Sewer and water maintenance men $725.~0 per month; The foregoing salaries do not include the individual hospitalization premiums which shall be paid by the city. It is understood that these salaries conform to the salaries established for s~milar positions in the suburban metropolitan area. Said salaries constitute the final proposal of the collective bargaining committee to Local 66&. All existing fringe benefits shall continue in effect for 1~70. Passed this 25th day of May, 1970. Call for bids on Concrete work and Bituminous work Motion by Jeska seconded by Heintz that the City Manager be authorized to ad- vertise for bids for concrete work (sidewalk, curb and gutter, and alley paving) and for bituminous work for the 1970 season, bids to be opened at the June 22nd meeting. Roll call, all ayes. 9.~ty Attorney Reports Mr. Sokolowski reported that a contract has been-received~£or signature,. in regard to t he bus shelter at ~th and Central Avenue~, and that thera is one new Stipulation, i,e.~in the event of removal of the structure, MTC may also remove the concrete pad upon which the shelter is constructed, but it shall have no o~ligation %o do so.~ The City Attorney stated that a property owner,~or the City, can post property at the entran6e if he wishes to keep people out, such as the noisy dune buggies or mini-bikes. In that event the Police Department can make.an arrest and ~ specific ~omplaint need not be signed. He also reported that he is' working on two ordinances (1) referring to the allowable location of a barbecue burner in a yard and (2) a swinrging pool ordinance for the Planning Commission's June 2nd meeting. Easement for walkway~ Madison Circle to Monroe St. Motion by Heintz seConded by Jeska that the City Manager~be instructed to proceed with securing easements for the walkway between Madison Circle.and Monroe Street~ south of ~6th Avenue. This is the surface rights above the storm sewer easement which we already have4~.Rol!.ca~l'- all ayes Hearing on curb repair work The City Engineer reported a need for curb correction and repair~a distance 'of about 160' on ~3rd Avenue between Quincy and Central along the south side of the Shoppers City property. Licenses An application for a Solicitors License.wa~ received .~rOm .Mr...Lar.ryLitman who wishes to supervise sales of hand crafted jewelry from door to door. The" proper license fee has been paid and PoliceChief Glader reports no evidence of crime or misdemeanor. No action was taken on this application as the Council -wishes to~ have more information on the people who would be doing.the Selling, and individual applications from them. Motion~by Land seconded by Heint~ that the list of'license applica6i0ns'b~ 'approved upon payment .of the proper fees. Ail ayes Old and new business Mayor Naw~ocki's attention has been called to t he number of trailers and trucks which are for rent at the service station at 4955 Central Avenue. There is a question as to whether this~constitutes an accessory to a Service stati~n~ or whether it is a spparate endeavor.
