Roll Call - All Ayes. 59. Vacatin9 3rd Street South of 42nd Avenue. A hearing for consideration of vacating 3rd Street south of 42nd Avenue was continued from the last meeting. Representatives from the school were present including Howard Seim, School Board Chairman, Howard Jensen, School Superintendent, Tom Erickson, the School's Attorney, and the School's Architect to discuss location of the new school as near as can be determined at this time. A second reading of Ordinance #728 vacating this section of 3rd Street was held. The ordinance was offered by: Land, seconded by: Heintz. Roll Call - All Ayes. The ordinance was adopted. Councilm~'~tated his feelings saying he is a teacher and if he were teach~ng~ in that particular building and looked outside the window and saw a road separating the school and the playground area he would think someone was an idiot. There should not be a roadway there. Consideration of Improvements on 41st Avenue between 2nd and 3rd. Councilman Jeska suggested tabling consideration of improvements on 41st Avenue indefini~ly, but the City Attorney said why not just deny the request. There is no reason for platting and opening 41st Avenue between 2nd and 3rd Streets. Motion by Jeska, seconded by Heintz to deny the request. Roll Call - All Ayes. Acquiring an easement. Motion by Jeska, seconded by Land to authorize the Mayor and City Manager to enter into an agreement with the School Board to purchase for the sum of $1.00 certain easements, utility and right of way easements, on the south side of the proposed school site at 42nd Avenue and 2nd Street and that the easement shall be more particularly described in the Engineer's layout. Roll Call - All Ayes. Ordinance #724 - Sale of Property to School District 13. A second reading of Ordinance #724 for sale of Lot Il, Block 2, Re-arrangement ~ KX~KXZ~X~Block D, Columbia Heights Annex to Minneapolis, was held. The ordinance was offered by Jeska, seconded by Logacz. Roll Call - All Ayes. The ordinance was adopted. Ordinance #725 - Sale of Property to State of Minn. for re-sale to School District. A second reading of Ordinance #725 for sale of Lot 5, Block i, Re-arrangement of Block D, Columbia Heights Annex to Minneapolis, to the State of Minnesota for ultimate re-sale to the School District, was held. The ordinance was offered by Logacz, seconded by Jeska. Roll Call - All Ayes. The ordinance was adopted. 60. Request to Hang Banner Across Central. Motion by Heintz, seconded by Jeska, that the Jaycees be allowed to hang a banner across Central Avenue north of 40th Avenue for the purposes of reminding people to vote May 19th and that proof of insurance be shown. Roll Call - All Ayes. Request for Private Sewer at 545 - 37th Avenue. A request was received to extend the existing sewer to serve the Ganzer Building at 545 37th Avenue. The City Engineer stated this has not been assessed and therefore we should charge Ganzer $250 for the hook-up. Motion by Jeska, seconded by Heintz that the request be approved, upon payment of proper fees. Roll Call - All Ayes. Request to allow house to be located over sanitary sewer at 2217 - 40th. A request was received for a waiver or a resolution allowing a house to be located over the sanitary sewer at 2217 - 40th Avenue. The Council asked how this could have happened? Apparently the house was not built according to the permit layout. A gentleman p~sent said when the sewer originally went in, nothing was built in the area and no easement was granted. The abstracts did not show any easements. When the Building Permit was requested there was a requirement that the house be built 2 feet larger than originally requested by the builder and the house was therefore built over the sewer. The Council members felt the land owner should assume responsibility for anything caused by the house being on the sewer and anything caused ~to the pipe after the City Engineer stated the basement is 9 feet above the pipe and there should be no problems in the future. Motion by Jeska, seconded by Logacz that the City Attorney adopt a resolution permitting the location of this home as it has been built which does ~Xfringe upon a sanitary sewer easement and that the owner and his assigned will enter into an agreement with the City of Columbia Heights that the owner will hold the City free and clear from liability as a result of the location of this home and the location of the sanitary sewer. Further, that if any damage does occur to this home as a result of anything going wrong with the sanitary sewer the City will not be liable because of the location of the sanitary sewer. This reso~tion must come back to the City Council for a vote. Roll Call - All Ayes. The resolution relating to the above request~was adopted later in the meeting. Request from Shell Oil to construct a new station at 37th and Central. A request was received from Shell Oil Company to construct a new service station at 37th and Central Avenue. (This is actually re- consideration of their rezoning request from last fall.) Mr. Bob Hynes was present at the meeting representing Mr. Bob Guzy, the Attorney for Shell. It was stated normally a request like this would 61. go to the Planning Commission first, but since there is no change in the request from last time and the Planning Commission did recommend granting the request, it is not necessary to go back. Motion by Jeska, seconded by Logacz that the City Manager be instructed to draft the necessary ordinance, or since the request is the same, prepare the same ordinance which would allow the rezoning as requested, a first reading to be held at the next ~gular meeting. Roll Call - All Ayes. The second reading of the Ordinance would constitute a public hearing. Request for an alley between 4th and 5th Street, 48th to 49th Avenues. A petition signed by 53% of the property owners was presented requesting the City to pave the alley between 4th and 5th Street between 48th and 49th Avenue N.E. Motion by Land, seconded by Heintz that the City Manager be authorized to advertise for a hearing on alley paving to be held at the next regular meeting, May 25th. Roll Call - All Ayes. Renewal of Lease Agreements for Barber shop, and Kordiak Bldg. The City Manager stated the lease agreement for the Kordiak Building goes for three years and was signed last year, so no action need be taken for two more years. Motion by Jeska, seconded by Land that the Barber Shop lease with Edward Carlson at 558 - 40th Avenue, be renewed and the rental rate for the following year be set at the rate of $70 per month. Roll Call - All Ayes. Appeal Denial of Rezoning Request for 5098 Central. Mr. Kolsrud of A. D. Strong Realty was pre~tto appeal the Planning Commission denial of their request to rezone 5098 Central for a fish and chips restaurant. Councilman Jeska explained why the Planning Commission denied the request because we have so many eating places already on Central Avenue. The petition presented at the Planning Commission meeting, stated the people in the area would rather have the restaurant than the Honda Sales establishment who requested a special use permit for the property if the restaurant request was denied. Motion by Land, seconded by Heintz that the request for rezoning by the H. Salts, Esq., for 51st and Central be denied. Roll Call - All Ayes. Councilman Land said he feels pretty much the way the Planning Commission feels that we do have plenty of eating spots along Central. This would be better than an empty filling station but he is hoping that maybe we can get something better than an eating place or a filling station. It may not come for a year or two, or even three years, but he would XXK~rather risk waiting for something better to come in. Roll Call - Ail Ayes. 62. Request for Special Use Permit for 5098 Central. A request was received for a special use permit for N.E. Honda Sales at 5098 Central Avenue if the fish and chips establishment proposal was denied. A petition was received signed by four residents in the neighborhood in opposition to the permit for Honda Sales. Motion by Heintz, seconded by Logacz to deny the request for a special use permit by N.E. Honda Sales for 5098 Central. Roll Call - All Ayes. The City Attorney said he heard that N.E. Honda Sales have now relocated on old Central near 79th Avenue. Building Permit Request, 2301 No. Upland Crest. Mr. Harold Montzka was present asking for a building permit to construct a 24 X 24 addition to his home at 2301 No. Upland Crest. The request was unanimously recommended by the Planning Commission. Mr. Montzka has special use permit to operate a fish business in his home and for this reason, it takes Council approval for a building permit. Motion by Heintz, seconded by Logacz that the request be granted. Roll Call - All Ayes. Request for Home Occupation Permit and Fence Height Waiver at 4712 Stinson Boulevard. Mr. & Mrs. John Henricks were present requesting a home occupation permit to operate a beauty shop at 4712 Stinson Boulevard, and a fence height waiver to construct a 6' high fence between the houses for pr~cy for their neighbor. The requests were unanimously recommended by the Planning Commission. seconded by Heintz, Motion by Land,~that the request for a home occupancy permit be granted. Roll Call - All Ayes. Motion by Jeska, seconded by Logacz to grant the waiver for a 6' high fence at this property. Roll Call - All Ayes. Request to hold Jamboree Parade. The Activities Committee requested permission to hold the annual Jamboree Parade on Sunday afternoon at 2:30 p.m. on June 21st, 1970. The parade route will be north on Quincy Street to 45th Avenue, (originating at Shoppers City), east on 45th to Central Avenue, south on Central to 40th Avenue, west on 40th to 5th Street, south on 5th Street to Mill Street and break up at the field house. The Police Department should be notified as well as the Highway Department. Motion by Jeska, seconded by Heintz that the Activities Committee be granted approval to hold a parade Sunday, June 21st at 2:30 p.m. Roll Call - All Ayes. P~quest Permission to Block off Mill Street for Street Dance. The Activities Committee requested permission to block off Mill Street from the Fire Station to 5th Street for a street dance June 19th in conjunction with the annual Jamboree. Motion by 63. Jeska, seconded by Logacz that the request be granted, with the cooperation of the Fire Department. Roll Call - All Ayes. Request from VFW to be open Sunday, June 21st. A request was received from the Activities Committee to allow the VFW to be open Sunday, June 21, 1970 for club members and guests participating in the Jamobree Parade. Motion by Jeska, seconded by Logacz to allow the VFW Club to be open for operation from noon to 1:00 a.m., Sunday, June 21, 1970. Roll Call - All Ayes. Appointments to Commissions and Boards. Motion by Jeska, seconded by Land, that the following people be re-appointed to serve on various boards and commissions in Columbia Heights: Mrs. LeRoy Smith, William Henschel and Vicki Wilson be re-appointed to serve on the Human Rights Commission, Jim Williams be re-appointed to serve on the Planning and Zoning Commission, upon the MayOr's recommendation Rawland Connor be re-appointed to the ~lice and Fire Civil Service Commission, Bill Hollom be re-appointed to the Park Board, Ethel Dedering and Claude Johnston be re-appointed to the Library Board, John Davvitt be re-appointed to the 'Traffic Commission, and Clarence L. McCline be re-appointed to the Housing and Redevelopment Authority. Roll Call - All Ayes. Someone from the 2nd precinct will be appointed to fill the unexpired term of Gloria Chadwick on the Human Rights Commission and the City Manager was instructed to contact former Councilmen and ask if they would be willing to accept appointment to two positions on the Merit Commission. These appointments will be made at the next regular meeting. Request Authorization to Attend Lea.gue Convention. The City Manager, Merle Glader, George Brown, Russ Sonnenberg, Councilman Heintz, and Mayor Nawrocki have all indicated they would like to attend the League of Minnesota Municipalities Convention in Duluth, June lO-12th. Motion by Jeska, seconded by Heintz that the necessary expenses for attendance for six people at the League Convention be approved. Roll Call - All Ayes. Request Authorization to Purchase Piping. The Park Department requests authorization to purchase polyvinyl chloride, Cretex Type W-1 piping to be used for drainage at Memorial Park in the amount of $650.00. Motion by Jeska, seconded by Heintz that the request be granted. Roll Call - All Ayes. Request Authorization to Attend Seminar on Storm Sewer Retention Ponds. Motion by Land, seconded by Logacz to authorize necessary expenses for the Assistant City Engineer to attend the "Esthetic and Technical Innovations in Storm Water Systems" seminar at Madison, Wisconsin May 19th and 20th. Roll Call - All Ayes. 64. Request to Purchase Pipe for Huset Park. Motion by Land, seconded by Jeska, that the City Manager be authorized to spend up to $600 for drainage pipe at Huset Park. Roll Call - All Ayes. (This is in the picnic area.) Discussion on Clean-up for the City and Help for the Health Department. Elliott Groth from the Jaycees was present stating at the burning barrell pick-up sponsored by the Jaycees he was very unhappy at the number of yards in the City cluttered with junk cars and debris. He felt some steps ought to be taken to increase the force on the Health Department to enforce the regulations we have on junk cars, etc. He also suggested establishing some sort of commission somewhat like the Planning Commission to work on these problems. Alley between Jefferson and Madison, ~N~XX~ 43rd to 44th. Dick Borchardt, 4327 Jefferson was present and submitted a petition asking for an alley at the above location. Motion by Jeska, seconded by Heintz that the City Manager be authorized to advertise for a hearing June 8th for all or part of the alley between Jefferson and Madison Streets, 43rd to 44th Avenue to consider opening and surfacing not necessarily the two are tied. Roll Call - All Ayes. Items for the Traffic Commission Consideration. Councilman Jeska said he had two requests for items to be placed on the Traffic Commission agenda. These are for a stop sign at 43rd and Washington and a stop sign at Fairway Drive and East Upland Crest. These will be placed on the Traffic Commission agenda for June 1st. Meeting with Hilltop Village. A meeting was set with Hilltop Village Council for Monday, May 18th at 7:30 p.m. to discuss various items. Agreement for Bus Shelter at 44th and Central. Motion by Jeska, seconded by Logacz, that the Mayor and City Manager be authorized to enter into an agreement with the Metropolitan Transit Commission for a bus shelter to be placed at 44th and Central Avenue on the west side, the following items to be worked out with the Transit Commission: The understanding as to their paying for heating and lighting for the structure, in the event the structure is removed the Transit Commission is required to remove the slab and replace the property in its original condition. Roll Call - All Ayes. 65. Resolution Accepting Gift for City Square Park. The City Attorney stated at the last meeting the Council accepted a check in the amount of $3,000 from Judge Joseph Wargo for the City Square Park. This must be done by Resolution, not a motion. ~XX~The Resolution was offered by Jeska, seconded by Heintz, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the City of Columbia Heights herein accepts the sum of $3,000, a gift presented by Judge Joseph Wargo. Roll call - All Ayes. Resolution Regarding the House at 2217 - 4Oth Avenue Built over the S~itary ~er. A Resolution was offered byJeska, seconded by Land, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, 1. That the City of Columbia Heights through its City Council does not object to the location of thehome structure on Lot 2, Block 1, Apache Heights, according to the map or plat thereof on file and of record' in the Office of the Registrar of Title as it presently exists and its location in relation to a ~ility easement. 2. This approval is contingent on the fee owner entering into an agreement with the City of Columbia Heights to be approved by the City Attorney to include among other tlings (a) that the property owner and his heirs and assigns ~ve and hold the City of Columbia Heights and its officers, employees and agents from any and ali damages that may arise as a result of the location of the sewer in its relation to the home structure, (b) that if damage does occur to the home structure as a result of any negligence on the part of the City, that if the damage would not result but for the location of the home structure within the easement but for the fact that within 5 feet of the easement the fee owner and his heirs and assigns will hold the City harmless of any and all claims, (c) that the fee owner and his heirs and assigns will pay all extra costs incurred by the City for maintenance and/or replacement, (d) that the fee owner pay to the City of Columbia Heights the sum of $20.0 for all work that has been caused to be done to this date. Albert A solicitors license application was presented from Mr./iJohn Alman, of 1125 - 43rd Avenue, to sell Shaklee Company products (comparable to Watkins and Raleigh products). The Police Department has checked with the Crime Bureau and the ~iver's License Bureau and find no record on Mr. Alman. Motion by Jeska, seconded by Heintz that the application be approved. Roll Call - All Ayes. A solicitors license application was also presented requesting to canvass door to door to get signatures opposing the Cambodian situation. Mr. Richard Fuller, Blaine, Minnesota, is soliciting for the University of Minnesota Faculty Strike Committee. 66. Motion by Land, seconded by Jeska that the request be denied. Roll Call - All Ayes. Request for Waiver to Build l' fromthe side lot line. Mr. James Buzzelli, 4853 University, requests a waiver to build a garage l' from the side lot line next to a machine shop. Motion by Heintz, seconded by Jeska that the request be referred to the Planning Commission for recommendation. Roll Call - All Ayes. Ordinance #731 - Sale of Property to Jack Keller. Motion by Land, seconded by Heintz that the second reading of Ordinance #731 for sale of 25' of property next to 4708 Stinson Boulevard be tabled until the next regular meeting. Roll Call - All Ayes. Request to Purchase 30' of City Property adjacent to 1848 - 39th Avenue. Mr. & Mrs. Gary Traverse requested to purchase 30' of city property adjacent to their property at 1848 - 39th Avenue. He would then build a fence around their entire lot for privacy. Motion by Land, seconded by Jeska that the request be tabled until the next regular meeting and the City Manager be authorized to get an appraisal of the property. Roll Call - All Ayes. Letter from Fridle¥ Police Chief Re: John Marchiniak's Actions. Officer John Marchiniak was commended for his efforts in trying to save a Fridley woman's life at the scene of a car accident on Highway 47 and 61st Avenue N.E. by a letter from the Fridley Police Chief, Everett McCarthy. Complaint on Use of Motor Cycles at Sullivan Lake. The City Manager presented a letter from Mrs. Baker who lives near Sullivan Lake re: kids riding motor cycles and dune buggies around the area. Motion by Jeska, seconded by Heintz that the letter be referred to the Police Department for whatever action they may take. Roll Call - All Ayes. Buses on Highland Place.
