Bids on City Truck.
A discussion was held on the bids for a new heavy duty truck which
were opened at the last meeting. There apparently was some confusion
about the type of truck asked for in the specifications and we had
asked for a Model F-800 truck. We found when the bids were opened
that five of the bidders bid on an F-750 or the L-8OO. The City
Engineer explained the main difference in the models is in the cabs.
The Council then asked for a legal opinion as to the acceptability
of the bid from Bill Boyer Ford which had been opened late in the
meeting. The City Manager explained the truck was bid without the
hydraulic system but was the low bidder. Motion by Land, seconded
by Logacz, that consideration of award of bids on trucks be tabled
until later in the meeting when the City Attorney would be present.

Bids for a bath house at Silver Lake Beach were received from the

Motion by Jeska, seconded by Heintz that the bids be turned over
to the City Manager for tabulation and report back later in the
meeting. Roll Call - All Ayes.
Agreement for Development of City Square Park.
Mr. A1 Kordiak was present requesting execution of agreements for
construction of the proposed pool at the city square park at 41st
and Central. He said the Chamber of Commerce will donate $4,000
for the work, Judge Joseph Wargo has already given $3,000 and
$3,000 more was presented at the meeting from Judge Wargo. This
project will be a patented process and there is no need to take
bids for any of the work. The Resolution authorizing the lease
agreement with the School for the property was offered by Land,
seconded by Jeska, BE IT HEREBY RESOLVED by the City Council of the
City of Columbia Heights, that WHEREAS, arrangements have been made
for financing and lease agreements proposed for a city square park in
· e northwest corner of Central Avenue N.E. at 41st Avenue, and that
the Mayor and City Manager be and they are hereby authorized to
enter into an appropriate lease agreement for this site. Roll Call-
A11 Ayes.
Motion by Land, seconded by Heintz that the Mayor and City Manager
be authorized to enter into an agreement with Landscape Construction,
Inc. for construction work on the city square park at 41st and
Central in the amount of $3,880. ($3,000 for the pool, and $880.00
for the si ds~alk.) Roll Call - All Ayes.
Motion by Jeska, seconded by Logacz to accept the check in the amount
of $3,000 from Judge Joseph Wargo to be applied to the development of
the park on 41st and Central. Roll Call - All Ayes.
First Aid Service with Hilltop Village.
The Village of Hilltop has asked that we would consider first aid
service to them. Motion by Jeska, seconded by Heintz, that in
accordance with a request of Hilltop Village and a recommendation
by the Fire Chief we propose to provide emergency first aid service
to the Village on the basis of an annual retainer of $100/month or
$1200 per year plus $30 per emergency first aid call including our
Police coordination and $60 per call if it is the type of call where
it is necessary to send a pumper truck along with the first aid rig.

Ordinance #728 "Vacating 3rd Street South of 42nd Avenue.
No one from the School District was present and the resUents from
the area who came for the continuation of the hearing said they would
like to table the matter until the school could present the plans
as to building location, etc. Motion by Heintz, seconded by Jeska
the second reading of Ordinanc~ #728 and the hearing thereon be
tabled until the next regular meeting and that the School District
be requested to have representation at that hearing to answer
questions as they relate to the school. Roll Call - All Ayes.
Hearing for Consideration of Improvements on 41st Avenue Between
2nd and 3rd Street.
Motion by Land, seconded by Heintz that the hearing to consider
improvements on the platting and construction of 41st Avenue
between 2nd and 3rd Street be tabled until the next regular
meeting. Roll Call - Ail Ayes.
Ordinances #724 and 725 - Sale of Property to School District.
Motion by Heintz, seconded by Logacz that the second reading of
Ordinances #724 and 725 be tabled until the next regular meeting.
Roll Call: All Ayes.
Ordinance #726 - Control of Unreasonable Acceleration.
Second reading of Ordinance #726 was held after being recommended
by the Police Chief, and the Traffic Commission. The ordinance
was offered by Logacz, seconded by Heintz, Roll Call - All Ayes.
The ordinance was adopted.
Resdution from Housing Authority Approving Application for Low-Rent
Public Housing.....
A Resolution approving application for preliminary loan for low-
rent public housing was Offered by Land, seconded by Logacz,
WHEREAS, it is the policy of the locality to eliminate substandard
and other inadequate housing, to prevent the spread of slums and
blight, and to realize as soon as fea~ble the goal of a decent home
in a suitable living envrionment for all of its citizens; and
WHEREAS, under the provisions of the United States Housing Act of
1937, as amended, the United States of America, Housing Assistance
administration (hereinafter called the "Government") is authorized
to provide financial assistance to local public housing agencies
for undertaking and carrying out preliminary planning of low-rent
housing projects that will assist in meeting this goal; and
WHEREAS, the Act provides that there shall be local determination
of need for low-rent housing to meet the needs not being adequately
met by private enterprise and that the Government shall not make any
contract with a public housing agency for preliminary loans for
surveys and planning in respect to any iow rent housing projects
unless the governing body of the locality involved has by resolution
approved the application of the public housing agency for such

preliminary loan; and WHEREAS, the Columbia Heights Housing and
Redevelopment Authority herein called the "Local Authority,, is
a public housing agency and is applying to the Government for
a preliminary loan to cover the costs of surveys and planning in
connection with the development of low-rent housing; NOW, THEREFORE,
BE IT RESOLVED by the City Council of the City of Columbia Heights
as follows: 1. There exists in the City of Columbia Heights a need
for such Iow-rent housing at rents within the means of low-income
families. 2. The application of the Local Authority to the
Government for a preliminary loan in an amount not to exceed the
appropriate allotment as established by the State Planning Agency
~r surveys and planning in connection with low-rent housing projects
of not to exceed approximately I00 dwelling units is hereby approved

Ordinance #727 Establishing Fire lanes.
A second reading of Ordinance #727 establishing fire lanes was
held. The ordinance was Offered by Logacz, seconded by Heintz.
Roll Call - Ali Ayes. The ordinance was adopted.
Award of Bids on City Truck.
The City Attorney said since the bid from Bill Boyer Ford on the
city truck was opened late in the meeting April 13th, and since
there apparently was some confusion as to the model we wanted,
it was his recommendation to reject all bids. Motion by Land,
seconded by Heintz to reject the bids on a heavy duty truck that
were received April 13th. Roll Call - All Ayes.
Motion by Heintz, seconded by Land that the City Manager be
authorized to advertise for bids for a heavy duty truck, the bids
to be opened at the regular meeting of the Council on May llth
Roll Call - Ali Ayes. '
Award of Bids on Bath House.
Motion by Jeska, seconded by Logacz to award the bids on the bath
house for Silver Lake Beach to R'Lee Construction Company in the
amount of $17,898, the Mayor and City Manager be authorized to
enter into a contract for same. Roll Call - Ali Ayes.
Ordinance #729 - Adopting Highway Regi~ration Act by Reference.
The second reading of Ordinance #729, amending ordinance #597,
regulating the use of Highways within the City of Columbia Heights
Incorporating the provisions of the State Highway Registration Act
by reference and imposing a penalty for violation thereof was held.
The ordinance was offered by Land, seconded by Jeska. Roll Call -
All Ayes. The ordinance was adopted.

Ordinance #730 - Providing Notices to Home Owners on Garb~je Pick-up.
A second reading of Ordinance #730 providing notices to home owners
and all other users of municipal garbage and ~rubbish pick-up indicating
reasons a pick-up was not made, was held. The ordinance was offered
by Logacz, seconded by Jeska. Roll Call - All Ayes. The ordinance
was adopted.
Ordinance #731 - Sale of Property to Jack Keller, 4708 Stinson.
First reading of Ordinance #731, Sale of the Northerly 25 feet of
Lot 13, Block 9, Hilltop, was held. Mr. Keller indicated the
price after the appraisal had been made was acceptable to him.
Access on Back Yards on Stinson Boulevard.
Councilman Jeska said he had a complaint from a gentleman living
on Stinson Boulevard who said his neighbor does not have access
to the back yard except by going through his yard. The alley does
not go all the way through.
Recess was called at 9:57 p.m. The meeting was called to order at
10:~ p.m.
Resolution Adopting Revised 1970 Budget.
A Resolution authorizing re-allocation on an intra-fund basis and
adopting the 1970 budget as revised, was offered by Heintz, seconded
by Jeska, WHEREAS, based on changes in needs in various funds and
~rpluses anticipated in other funds, that certain intra-fund
transfers are desirable and expedient to our 1970 budget along
with the resolution passed October 30, 1969 authorizing the County
Auditor to levy taxes in the amount of $974,~5.O0. NOW, THEREFORE,
BE IT HEREBY ~SOLVED by the City Council of the City of Columbia
Heights that the City Treasurer by and he is hereby instructed
and authorized to make the following revisions by transfer in the
1970 City Budget, as follows: $10,000 from storm sewer construction
fund to the general fund, $45,000 from city shop fund to park
maintenance and building fund, $18,O00 from refuse collection and
disposal fund to the general fund. BE IT FURTHER RESOLVED that the
revised 1970 budget as prepared and presented by the City Treasurer
be, and it is hereby designated as the 1970 budget and said document
made a part hereof. Roll Call - Ail Ayes.
Use Of
Ordinance #732 - Regulating~Alcoholic Beverages.
The City Attorney presented Ordinance #732 regulating the purchase,
consumption, possession of alcoholic beverages and imposing a penalty
for violation of same. A first reading of the ordinance was held.
Resolution regulating Flood Plains.
The Resolution was offered by Jeska, seconded by Heintz, WHEREAS,
in order to implement the Policy of the State of Minnesota to
guide development of the flood plains of the State and to preserve

the capacity of the flood plain to carry Regional floods, minimize
flood hazards and regulate the use of flood plain lands, and
WHEREAS, the Department of Conservation requires that a letter of
intent must be submitted to comply with the flood plain Management
Act, Chapter 590, Section 1, Sub. 2 & 3. BE IT HEREBY RESOLVED,
that Malcolm O. Watson, City Manager, be and he is hereby authorized
as the proper official of the City of Columbia Heights to transit
said letter of intent. Roll Call - All Ayes
Appointment to Boards and Commissions.
No action was taken on appointments and re-appointments to boards
and commissions. The Mayor suggested we tabulate the names of
applicants by precinct and the appointments can then be made at the
next meeting.
Report on Alley North of 43rd Avenue east of Jefferson.
Mr. Brown, City Engineer, presented a lay-out of the block between
Jefferson and Madison Street from 43rd to 44th Avenue. Possible
alley locations were shown indicating properties presently deeded
for alley purposes and those needed ~ if an alley were to be
considered. Mr. Dick Borchardt,4327 Jefferson, said he would get
support from the residents on a petition before a hearing is called
for.
Space Rental of Mrs. Schwartz's Driveway.
A request was received from the Engineering Department to rent
parking space in Mrs. Schwartz's driveway to park city vehicles
during the day. This is not over night parking or even all day
parking, but just while the employees come and go from the Engineering
Department for a few minutes. The Council felt there was adequate
parking in the area on the street and in the municipal parking lot.
Motion by Land, seconded by Jeska to deny the request of the
Engineering Department to rent additional parking space. Roll
Call - All ayes.
City personnel are to be instructed not to park there as it would
be violation of city ordinances and a directive will be given out
to the employees.
Request Use of Recreation Bus.
A request was received from the Boos~rs Club to use the Recreation
Commission bus to transport participants of the finals of the
Olympic Wrestling Championship from the Paul Bunyan Motel, the
primary housing facility for the event, to the High School on
Saturday and Sunday, June ~h and 7th. The custodial personnel of
the High School have donated their time to drive the buses for the
event. A question was raised about insurance and the City Manager
was directed to contact the insurance committee and see what infor-
mation they might need. Motion by Jeska, seconded by Logacz,

to recommend to the Recreation Commission that they authorize the
use of the bus to appropriate personnel for the Olympic Wrestling
Championship finals on a no-charge basis. Roll Call - All Ayes.
Lot SubdivisionoRequest.
Motion by Land, seconded by Jeska that the lot subdivision request
for Lot 12, (Ex. E 50') Subj. to rd. ease over N 10' & S 30'
Block 2, Reservoir Hills be granted, the outstanding specials
in the amount of $463.64 be divided. Roll Call - All Ayes.
City Attorney Reports.
The City Attorney reported the City won the Asselstine-Thompson
case - The case against paying an assessment for opening McKinley
Street between 37th and 40th.
The City Attorney reported complaints from a citizen~ about a
B. B. Q. gas burner in his neighbor's lot. He will draw up an
ordinance regarding location of these burners.
The City Attorney presented the Council with copies of a letter
responding to Mr. Nyquist, attorney for the Apartment Owners
Association.
Licenses.
Motion by ~ntz, seconded by Land that the license applications as
per list attached be granted upon payment of proper fees. Roll
Call - All Ayes.
Taxi Company.
The City Manager reported the matter regarding the Taxi Company
has been referred to the Police Chief for a report.
Insurance.
Motion by Heintz, seconded by Land that the Council accept the
recommendation of the Insurance Committee authorizing the City
Manager to purchase workman's compensation, general liability, and
automobile liability as proposed from the NIowa National Mutual
Company. Roll Call: Land, Heintz, Logacz, Nawrocki - Ayes. Jeska -
Nay.
Councilman Jeska said the reason he is voting no on the motion is not
because Iowa National is not a good company or is not the best
offer, but it is because he has not got the information he asked
for. He said he has spent many nights on this and asked for
specific information which we does not have.

Request for Reduced Garbage Rates.
Mr. Paul Lobash, 4400 Jackson Street, requested a reduced senior
citizen hardship rate on garbage collection service. The City
Manager stated his daughter lives with him and she is working,
therefore the total household income exceeds $3,000.00. Motionby
Jeska, seconded by Logacz to ~deny the request, on the basis
that his household income exceeds $3,000 as set forth in the
ordinance. Roll Call - All Ayes.
The Council members wished Happy Birthday to Councilman Jeska who
turned "39" at 12:00 midnight.
Motion by Jeska, seconded by Logacz to adjourn at 12:37 p.m. Roll
Call - All Ayes.
