A hearing was held for reconsideration of Northern Pacific's Railways'
application to rezone the area between the alleys on each side of
California Street N.E. between the 37th and 40th Avenue, from M-1 Light
Industrial to M-2 Heavy Industrial. Mr. Russell Thompson from Northern
Pacific was present asking that they be allowed to construct an automatic
classification yard in the Columbia Heights area now occupied by the
north town yard. The yard would be expanded to provide an automatic
classification facility where cars would be controlled in speed by use of
retarders. He stated a retarder is a series of rail type equipment on which
pressure will be exerted on the wheels as trains are moving past to slow
them down to the speed desired to carry them to the end of the track. He
also stated an overpass would be constructed over the present 43rd Avenue
crossing, much of the noise from sudden stops and starts of engines would
b e eliminated, the switch men will have a safer place to work, the yard
will be fenced in to keep people from walking into the area, and the
industrial property west of California would be eliminated. He explained
by expanding the yard N.P. would be able to place themselves in a more
competitive industry with other means of transportation. A question was
raised as to this being a tax loss to the City of Columbia Heights and
Mr. Thompson said railroads do pay taxes based on their gross earnings.
He said they have checked into problems with property values going down
in the area and realtors indicated heavy industries would be more detrimental
than the railroad. A ledge of limestone rock 15 feet thick will have to
be bla~ed and the entire facility would be constructed within two years -
one-half the first year and the other half next spring. Residents of the
area present asked many questions about this becoming a grain sampling
section ad the problems of pollution. A gentleman from Great Northern
Railroad said he has seen no upgrading for a long time and would like to
see modernization of facilities. He also stated ther.~ is a minimal amount
of property involved ~nd is supporting N.P. in trying to improve the
Twin Cities Area. The Council members felt no action should be taken
until they see something in writing from the Planning and Zoning Commission
as to conditions and regulations. Motion by Heintz~.seconded by Jeska,
that the hearing be tabled until February 23, that the matter be referred
to the Planning and Zoning Commission for recommendation particularly with
regards to screening and the various points cuver~d tonight a~d the Pla,~ning
Com~ission be instructed to report back to the Council. Roll Call - All

A Resolution authorizing execution of a cooperation aggreement was offered
by Land, seconded by Jeska, WHEREAS, the Housing and Redevelopment
Authority proposes to develop and administer a low-rent housing project
or projects to consist of approximately 60 dwelling units; and WHEREAS,
the Housing and Redevelopment Authority desires to enter into a Cooperation
Agreement with the City of Columbia Heights in connection with such
project, NOW, THEREFORE, BE IT RESOLVED that: 1. The Housing and
Redevelopment Authority shall enter into a Cooperation Agreement with the
City of Columbia Heights in substantially the attached form. 2. That the
Chairman, Thomas Sherohman, be and he is hereby authorized and directed
to execute said Cooperation Agreement, in quadruplicate, in behalf of said
Authority and the Secretary is hereby authorized and directed to affix
the corporate seal of said Authority thereon and attest the same. 3.
This resolution shall take effect immediately. Roll Call - All Ayes.

Second rea~ing of Ordinance #722 vacating a section of street right-of-
way lying east of Royce and Leander Lane north of McLeod was held, which
also constitutes a public hearing. Mr. Frank Biedny who requested the
vacation was present as were several residents in opposition. The land
is actually in the public right-of-way and has been maintained by the
Park Superintendent. Before the ~cation is granted there would have
to be an understanding that the City would retain underground utility
easements. What Mr. Biedny probably intends to do is come in with a
lot subdivision request and build on the lot but this is another matter
and will be discussed at a different time if the Council approves the
vacation. Stu Kvalheim who lives at 4242 Reservoir was present and
stated his oppositions: This is the first time the City Council has
ever vacated a portion of right-of-way which would be of benefit to
only one property owner in the City. This is assuming many things
but it is benefiting Mr. Biedny for an additional building site and
construction of a house would be damaging asthetically to the area. Most
of the lots are in excess of 1200 feet and this would reduce the size and
be a change in the area. (The City Manager stated the size of the new
lot would be about average or a little larger than the others in the
area.) Mr. Kvalheim also said three years ago the City came in and
proposed the intersection of Leander Lane thus creating the area and
at that time the city put in sewer mains down both sides of the street
and sodded the boulevard, which the home owners maintained, except
for the portion to be vacated and he felt consideration is being given
to someone who has not done his fair share to maintain the property.
He also asked if this was a written request and was informed by the
City Manager it first came in verbally and then came in written on
the plans. Mrs. Biedny said she feels the reason for the opposition
is jealousy but Mrs. Kvalheim said they were not jealous but just
concerned about the looks of the neighborhood. One gentleman asked
if any thought had been given to a playground for this area but
the land is not adequate in size. Councilman Land stated this is an
emotional problem between the property owners and he feels a house
would look much better on the corner. Ordinance #722 was offered by
Land, seconded by Heintz. Roll Call: Land, Heintz, Logacz - Ayes.
Nawrocki - Nay. Jeska - Abstained from voting.
A Resolution approving application for preliminary loan for low-rent
public housing was offered by Logacz, seconded by Heintz, WHEREAS, it is
the policy of this locality to eliminate substandard and other
inadequate housing, to prevent the spread of slums and blight, and to
realize as soon as feasible the goal of a decent home in a suitable living
environment for all of its citizens; and WHEREAS, under the provisions
of the United States Housing Act of 1957, as amended, the United States
of America, Housing Assistance Administration (hereinafter called the
"Government") is authorized to provide financial assistance to local public
housing agencies for undertaking and c~rying out preliminary planning
of low-rent housing projects that will assist in meeting this goal; and
WHEREAS, the Act provides that there shall be local determination of
need for low-rent housing to meet needs not being adequately met by
private enterprise and that the Government shall not make any contract
with a public housing agency for preliminary loans for surveys and
planning in respect to any low-rent housing projects unless the governing
body of the locality involved has by resolution approved the application

of the public housing agency for such preliminary loan; and WHEREAS
the Housing and Redevelopment Authority (herein called the "Local
Authority") is a public housing agency and is applying to the
Government for a preliminary loan to cover the costs of surveys and
planning in connection with the development of low-rent housing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Columbia Heights as follows: 1. There exists in the City of Columbia
Heights a need for such low-rent housing at rents within the means of
low-income families; 2. The application of the Local Authority to the
Government for a preliminary loan in an amount not to exceed $1,500.00
for surveys and planning in connection with low-rent housing projects
of not to exceed approximately 60 dwelling units is hereby approved.

The meeting was called to order at 10:55 p.m.
A discussion was held on the sewer cleaning machine for which bids were
received at the last meeting and a representative from Myers-Sherman
Company was present to clear up the point about the two identical bids
and answer any questions. He stated the reason for the identical bids
was they wanted to be sure to get a bid in so had Minar Ford su~it an
identical bid. The City Manager pointed out in the general sewer fund
we have $76,863.22 as of December 31, 1969 and from that a total amount
that was estimated to pay Minneapolis for sewer services was $36,000 leaving
$40,000. There is enough in the budget to purchase the machine. Mayor
Nawrocki again raised a question as to why we are only looking at one
piece of equipment and how do we know we are not paying a premium for
the equipment. The City Engineer stated the bid price as compared with
other cities is about the same. Motion by Land, seconded by Heintz
that the bid for the sewer cleaning machine be awarded to Minar Ford
and the Mayor and City Manager be authorized to enter into a contract
for same, all subject to the review and approval of the City Attorney.

Second reading of Ordinance #723 adopting the Pollution Control Agency
regulations by reference, was Offered byLogacz, seconded by Jeska.

Mayor Nawrocki reported on a lady who thinks the pick-up service we have
offers possibilities but she has some very sharp raspberry bushes with
thorns and wonders if they could be burned. Apparently there is something
in the law about special waivers for agricultural purposes.
The City Manager reported when the weather dropped below 30° below zero
many of the plastic cans cracked. He also reported on problems of
people filling the cans with waste paper and the plastic bags with
garbage which can be a problem in the warmer weather. A discussion was
held on pick-up of bo×es at the curb line.
Motion by Land, seconded by Logacz that the bid on dog catcher services
for 1970 be awarded to James Dooley, the low bidder, for the sum of
$3800 and the Mayor and City Manage!r be authorized to enter into a
contract for same. Roll Call - All Ayes.

No action was taken on a resolution setting 1970 salaries for Street and
Park Department personnel.
Motion by Heintz, seconded by Jeska that the Mayor and City Manager
be authorized to enter into an agreement for the Joint Law Enforcement
Council for various municipalities in Anoka County. Roll Call - All
Ayes. It was stated the purpose of this organization is to work
together in a more formalized body on matters of mutual concern. This
was not intended to set up a county Police Department.
The City Manager requested to meet informally with the Council at 7:00 p.m.,
February 9th before the ~gular Council meeting to view a film and a
presentation on "Remote Reading Meters"
The City Manager reminded the Council of a meeting Tuesday, January 27th
with A1 Kordiak at 8:00 p.m. to discuss the Rice Creek Watershed District
and a meeting Wednesday night, January 28th at 7:30 p.m. with the School
Board and Recreation Commission.
Motion by Land, seconded by Heintz that up to two people from the
Engineering staff be authorized to attend the short course at Purdue
University February 25 and 26th. Roll Call - All Ayes.
Motion by Land, seconded by Jeska that up to two people be authorized
to attend land surveys descriptions course given by the Anoka County
Surveyor that runs one night a week for II weeks and that expenses
be authorized. Roll Call - All Ayes.
Motion by Jeska, seconded by Logacz that the license applications as
per list attached be granted upon payment of proper fees. Roll Call -
All Ayes.
