Regular Meeting
January 12, 1970
The meeting was called to order at 8:13 p.m.

The Invocation was given by Rev. Doug Henderson of the People's Church.
Mayor Nawrocki welcomed the new Council member E. "Sebe" Heintz.
Motion by Jeska, seconded by Land that Janet Christenson be appointed
Secretary to the Council. Roll Call - All Ayes.
Motion by Jeska, seconded by Logacz, that Councilman Land be named
President of the Council. Roll Call - All Ayes.
Motion by Land, seconded by Jeska that the 2nd and 4th Mondays of the
month at 8:00 p.m. be designated as Council meeting night for this
Council and the 3rd Monday be used as an extra meeting night at such
time as the City Manager deems to be in order. Roll Call - All Ayes.
Motion by Heintz, seconded by Land that Councilman Jeska be re-appointed
to the Planning Commission, Councilman Logacz be appointed to the Library
Board and re-appointed to the Human Rights Commission, Councilman Heintz
be appointed to the Recreation Commission, Councilman Land be re-
appointed to the Traffic Commission. Roll Call - All Ayes.
Motion by Jeska, seconded by Heintz that the minutes of the last regular
and special meetings be approved as presented in writing including the
minutes of December 30th as amended, and the reading dispensed with.

Mayor Nawrocki presented the following Proclamation:
WHEREAS: The life of a community is enriched through activities which
enable its citizens to participate together, and WHEREAS: The Columbia
Heights Jaycees have planned a full week of activites for young and
old alike during the week of January 17-25, 1970, and WHEREAS: KSTP Radio
and TV along with the Columbia Heights Sun, are participating with
area merchants to publicize our community including events of the
week, and WHEREAS: Nationally, the Jaycees are this week celebrating
their 50th Anniversary as a group of young men of action, dedicated
to community service, and NOW, THEREFORE, I Bruce G. Nawrocki, Mayor
of the City of Columbia Heights, do hereby proclaim January 17-25 as
1970 JAYCEES WINTER JAMBOREE WEEK. I do hereby urge every citizen,
civic organization, and business establishment within our community,
to participate in the various events planned for this week. I do
further commend the Jaycees for their tremendous contribution of time
and effort in this, as well as many other projects throughout the
year, which help to make our community a better place in which to live.
A copy of the Proclamation was given to Elliott Groth, Jaycees
President.
One bid on legal publications was received from Sun Newspapers. They
submitted an affidavit of paid circulation along with their bid.
Motion by Land, seconded by Heintz that the bid of the Sun Newspaper
for legal publcation for the City in 1970 be accepted. Roll Call -
All Ayes.
Bids on dog catcher services were received from the following:
Tonka Kennels Per hour for regular hours - $6.80/hour
Boarding any animal - 1.25/day

Motion by Land, seconded by Jeska, that the bids be turned over to the
City Manager for tabulation and report back at the next meeting.

Bids on 1 truck mounted sewer maintenance unit combining a vacuum type
catch basin cleaner and hydraulic sewer rodder were received from the
following:

Since~only two bids received were exactly alike, Mayor Nawrocki questioned
when the specifications were made up was anyone written out? The City
Engineer reported this was the only combination unit that had been
advertised. Motion by Jeska, seconded by Logacz, that the bids be turned
over to the City Manager and he will check if anyone else was written
out of the specifications. Roll Call - All Ayes.
A Resolution requesting technical services from the State was Offered
by Logacz, seconded by Jeska, BE IT HEREBY RESOLVED that pursuant to
statutory authority, the City Engineer for and on behalf of the City
of Columbia Heights is hereby authorized to request and obtain from
the Minnesota Department of Highways, needed engineering and technical
services during the year of 1970; for which payment will be made by
the City upon receipt of verified claims from the Commissioner of
Highways. Roll Call - All Ayes.
PLANNING AND ZONING COMMISSION RECOMMENDATIONS:
Ron Blair was present requesting to do light welding work at 4040 Van
Buren in the garage. ~is building is owned by the People's Church
but is on the tax rolls. A question was raised about hazards as
far as the Fire Department was concerned but the building is a cement
block structure. Motion by Land, seconded by Heintz that the Home
Occupancy permit be granted to Ron Blair. Roll Call - All Ayes.
Mr. Frank Biedny, 4230 Reservoir Boulevard, was present requesting
vacating the street right-of-way east of Royce Street north of
McLeod for a building site facing south on McLeod or east on Royce.
The city would retain a permanent underground utility easement.
The request which had been denied on two p~revious occasions was
recommended unanimously by the Planning Commission. First reading
of Ordinance #722 vacating the street was held with the 2nd reading
on January 26, which will constitute a public hearing.
John Hemak, 811 44th Avenue, was present requesting renewal of his special
use permit to repair radios, televisions and phonographs and the sale of
foreign language records. In addition this year he would like to include
radio, television and phonograph sales. Mr. Hemak stated he has had no
complaints in 1969 and will certainly comply with all the regulations.
He included the following statements in his permit application:
1. Selling now. No expansion of any kind is planned.
2. No complaints in 1969 with p~esent operation.
3. No visible evidence of cartons, signs, posters, etc. has been
shown or will be shown.
4. Disposition of cartons, etc., conducted inside.
5. It will be easier, conscientiously to serve on the Planning
Commission.
6. C-1 and M-1 uses are now permitted in Home Occupations, as long
as "home occupations" are confined to the rules and regulations
permitted in the ordinance and no complaints were presented.
The Council members felt it would be wise to call for a hearing to find
out how the neighbors feel about selling. A lengthy discussion was held
and the Council said Mr. Hemak had one of two choices: either amend
the application to continue what he has been doing in the past or
leave the application as it is and a hearing will be called for to
find out how the neighbors feel. Motion by Land, seconded by Heintz
that the amended home occupancy permit application to repair radios,
televisions and phonographs and sell foreign i~guage records as in the
past at 811 - 44th Avenue N.E. be granted. Roll Call - All Ayes.
A lot subdivision request was received from Peter Janeczko to split
Lots 3, 4, and 5, Block 6, Sheffield's 2nd Sub. into two lots.
Motion by Jeska, seconded by Logacz that the request be referred to
the Planning and Zoning Commission for recommendation and Mr.
Janeczko be instructed to present a surveyorls certificate showing
the property to the Commission. Roll Call - All Ayes.
A letter was received from Mel Aanerud requesting a change in the City
Charter recommending the City adopt the ward system of electing its
Council. Mr. Aanerud was present at the meeting and said this was
discussed at the Policy & Goals Committee meetings and they too
recommended the Council look into the matter. This would relieve some
problems of small pressure groups on the Councilmen and that one
Council member from a particular area would represent the people and
the pressure would be on only him and not the whole Council. A lengthy
discussion was held and questions were raised on how the City would be
divided up into wards. Mayor Nawrocki stated the Council cannot just
change the charter and that it is up to the State Legislature or a
vote of the people. He also said we do have a Charter Commission
for the purpose of reviewing the Charter and making recommendations.
This Commission is appointed by the District Judge. Motion by Land,
seconded by Logacz that Mr. Aanerud's letter be placed on file.
Roll Call - All Ayes. It was stated that a request of this nature
be presented in the form of a petition.
Motion by Jeska., seconded by Land to allow expenses for the Building
and Plumbing Inspector to attend the 14th Annual Institute for Building
Officials January 19-21, 1970 at the Pick-Nicollet Hotel. Roll Call -
All Ayes.
Motion by Jeska, seconded by Heintz that the City Engineer, Assistant
City Engineer and Street Forman be allowed to attend the City and
Village Engineers and Public Works Officials conference January 29-30,
1970 at the University of Minnesota and expenses be allowed. Roll
Call - All Ayes.
A Recess was called at ii:O0 p.m. The meeting was called to order
at i1:14 p.m.

A discussion was held on the request to operate a popcorn wagon from
Francis Seward, 4550 Central. It was decided that the same restrictions
placed on the ice cream wagons last summer be placed on the pop corn
wagon. Motion by Heintz, seconded by Jeska to grant the request
subject to the following restrictions:
1. Adequate insurance is required $50,000 liability, $100,000
accident, $5,000 property damage.
2. They may not operate on arterial streets (a map will be furnished
indicating where the arterial streets are.)
3. They may not cover any area more than two times daily.
4. They may not park within 50 feet of any street intersection.
5. They may not park beside~any park or recreation area.
6. They may not cause a sound or visual nuisance in violation of
Ordinance ~01.
7. They may not operate on streets before 8:00 a.m. or after
9:00 p.m.

Motion by Jeska, seconded by Heintz that the Jaycees request to place
a banner across Central in the usual location advertising the Winter
Jamboree Week be granted upon presentation of proof of insurance coverage.

Motion by Logacz, seconded by Jeska to concur in the Mayor's appointment
of Robert King to the Housing and Redevelopment Authority. Roll Call -
All Ayes.
Mayor Nawrocki presented a resolution to go on record supporting the
establishment of a Metro Aire Fire Service Training Center - the
Resolution was prepared by the Metropolitan Section of the League of
Minn. Municipalities. A Resolution supporting in principle the
establishment of a Metropolitan Area Fire Service Training Center was
offered by Jeska, seconded by Logacz, WHEREAS, the general public safety
is partially dependent upon the ability of local fire departments to
reduce and eliminate the threat of fire to life and property; and
WHEREAS, this capability is achieved primarily through training
exercises; and WHEREAS, the adequate training requires suitable
facilities for the teaching of fire prevention and fire fig~ing
techniques and methods; and WHEREAS, an adequate training facility
does not now exist in the Twin Cities Metropolitan Area; and WHEREAS,
the need of such a fire training facility is increasing with the
continuing growth and industrialization of the metrppolitan area; and
WHEREAS, the fire training center and its staff would serve all fire
prevention and fire fighting agencies in the metropolitan area; NOW,
THEREFORE, BE IT RESOLVED by the City Council of the City of Columbia
Heights that it supports in principle the establishment of a Metropolitan
Area Fire Service Training Center. BE IT FURTHER RESOLVED That
authorities of all interested jurisdictions join together to plan the
facility, determine its location and determine a method of financing
its construction and operation which can be accepted by the participatin
sponsors. Roll Call - All Ayes.

The City Attorney presented copies of a letter he will be sending to
Dean Nyquist, Attorney for the Columbia Heights Apartment Owners
Association in regards to garbage pick-up service.
The City Attorney presented Ordinance #723 adopting all of the State
Pollution Control Agency regulations by reference. A first reading
of the Ordinance was held.
A discussion was held on a lease agreement for court room facilities
with the County of Anoka. The City Attorney will go over this and
a contract or agreement will be made up.
A discussion was held on the Snowmobile Ordinance and the City Attorney
said our ordinance does not conflict with the State Laws in any way but
he will get copies of the Attorney General's Opinions on this and will
advise the Council if there is anything different.
Motion by Jeska, seconded by Logacz that the license applications as
listed ~e approved upon payment of proper fees and that the special
use permits and home occupancy permits as listed be approved upon
payment of proper fees with the same restrictions as applicable during
the last calendar year be included. Roll Call - All Ayes.
A discussion, was held on the proposed fountain at 41st and Central.
Motion by Jeska, seconded by Logacz, that the Mayor and City Manager
be authorized to enter into an agreement to purchase the water
fountain for the proposed park site at 41st and Central. Roll Call -
All Ayes.
