Regular Meeting
November lO, 1969
The meeting was called to order at 8:00 p.m. Roll Call: Land, King,
Jeska, Logacz, Nawrocki - present. The City Manager and City Engineer
were both out of town for this meeting and John Barna and Armond Borocki
held their positions respectively.
The invocation was offered by Rev. Doug Henderson of the People's Church.
Motion by Land, seconded by King that the minutes of the last regular
and special council meetings be approved as presented in writing and
the reading dispensed with. Roll Call - All Ayes.
Motion by King, seconded by Land that the bills be paid out of their
proper funds as follows: Roll Call - All Ayes.

Bids on $660,000 Permanent Improvement Revolving Fund bonds were received
from the following as per bid tabulation attached:

Motion by Jeska, seconded by Logacz that the bids be turned over to
the Assistant City Manager for tabulation and report back later in the
meeting. Roll Call - All Ayes.
A hearing was held on proposed sidewalks for the south side of 49th
Avenue between University and Monroe Street and approximately 20 citizens
were in attendance. Armond Borocki from the Engineering staff
explained the engineering part of the project stating a 5' sidewalk
would be built immediately behind the curb, the south side chosen
because the present sidewalk in Hilltop was on the south side as were
the schools, and sloping problems on the north were greater than
those on the south. Retaining walls may have to be built on Jefferson
and Madison Street but the project will include restoration of what-
ever changes in grade wQuld be done. Mayor Nawrocki stated 60% of
the cost would be picked up by the city in general taxes as people
from other areas would be using the sidewalks, and the remaining 40%
would be assessed back in the same manner as an improvement of this
kind usually is. The total cost of the project will be around $9500.
A question was raised on who would maintain the sidewalks. Most of
the residents felt the city should handle snow removal. Mayor Nawrocki
said no firm promise could be made at this time but if the city did
handle the snow removal it would be done the same as is done in the
business district. Concern was expressed over children crossing at
49th and Monroe and one resident asked if the city could install a
four-way stop at the intersection. The Mayor recommended this be
taken up at the next Traffic Commission meeting and he stated he
would ask the Police to patrol the area more often to control drag
racing. A vote of persons present showed 10 in favor and 7 opposed
to the project. Motion by Land, seconded by Jeska that the City
Manager be authorized to proceed with the construction of 5' sidewalks
on 49th Avenue from Monroe to University in the 1970 constru~ction
season. Roll Call - All Ayes.
A Resolution ordering improvements was offered by Logacz, seconded
by Jeska, BE IT HEREBY RESOLVED by the City Council of the City of
Columbia Heights, WHEREAS, the City Council of the City of Columbia
Heights by Motion on the 22nd day of September, 1969 ordered notice
of a hearing to be given to property owners, and WHEREAS, pursuant to
a notice of hearing certain residents appeared at a Council meeting
on the 10th day of November, 1969, and WHEREAS, the Council determines
to proceed with this local improvement, a portion of the cost being
defrayed by special assessments, under Charter provisions. NOW,
THEREFORE, IT IS HEREBY RESOLVED: 1. That the location and extent
of such improvements is as follows: 49th Avenue (South side) from
University to Monroe Street N.E. 2. That the materials to be used
are as follows: Concrete. 3. That a careful estimate of the

cost of the improvement has been made by the City Manager and the
several lots and parcels of land fronting upon and adjacent to such
proposed improvement, which he deemed benefited thereby, were properly
notified of said hearings, and 4. That the City Manager shall also
list the names and owners of the several parcels so improved as nearly
as can be ascertained. 5. These improvements shall also be known as
Project No. 642. Passed this 10th day of November, 1969. Roll Call -

Resolution awarding the sale of $660,000 Permanent Improvement Revolving
Fund Bonds was offered by Land, seconded by King, BE IT RESOLVED by the
City Council of the City of Columbia Heights, Minnesota, that the bid
of First National Bank of St. Paul and associates named therein, to
purchase the $660,000 general obligation Permanent Improvement
Revolving Fund Bonds of the City to be dated November 1, 1969, and to
be issued in accordance with the published notice of sale therefor, at
a price of $212,581.25 and accrued interest, the bonds maturing in the
various years shown below to bear basic interest from date of issue to
maturity at the respective rates per annum shown opposite such years
of maturity, as follows:

is hereby found and declared to be the highest and best bid received
pursuant to said notice of sale, and is hereby accepted. The Mayor and
City Manager are authorized and directed to endorse an acceptance on
said bid, and ~n a copy thereof, and to return such copy to the
successful bidder. The good faith check of said bidder shall be
retained by the City Treasurer pending completion and delivery of
the bonds, and the good faith checks of other bidders shall be
forthwith returned to them. Roll Call - All Ayes.
The second reading of Ordinance #694 on snowmobiles was held. The
ordinance was offered by Land, seconded by Jeska. Roll Call - All Ayes.
Councilman Jeska stated he was entirely happy with the ordinance and
asked why the section on noise of operation was taken out. The
City Attorney explained this was notin t~state law, but it might be
in direct conflict with the state law. Also, the noise problems
would probably be covered in Section 4.
A discussion was held on Ordinance #696 - conduct in schools.
Councilman Land read two letters from the teachers organizations
opposed to adoption of this ordinance. The City Attorney stated he
feels this is unnecessary as we have other ordinances on record that
are certainly sufficient to prosecute anyone who is disorderly.

Motion by Logacz, seconded by Jeska that ordinance #696 be tabled
indefinitely. Roll Call - All Ayes.
Motion by Land, seconded by King that the two letters from the teachers
organizations concerning ordinance #696 be placed on file. Roll Call -
All Ayes.
A request was received from Donald Benny to rezone 528 - 40th from
C-l, Local Commercial, to M-l, Light Industrial to build a 30I X 50I
building to be used as a machine shop. This request was recommended
by the Planning Commission on a 3 to 2 vote. Mr. Benny presented
a letter he received from the bank stating it would be more favorable
to get a loan for the building if the property were rezoned. The
Council indicated some concern over patch-work zoning. Motion by
King, seconded by Land that the request be denied. Roll Call -
All Ayes.
A request was received from David Hansen for a home occupancy permit
to repair snowmobiles in his garage at 41OO - 7th Street N.E. The
request was unanimously recommended by the Planning Commission and
Mrs. Hansen presented a signed agreement from 64 neighbors saying
they have no objections. Motion by Jeska, seconded by King that
the home occupancy permit for 4100 - 7th Street to repair snowmobiles
be granted subject to the following requirements: That there be no
operation of business between the hours of 9:00 p.m. and 9:00 a.m.,
that there be no running of snowmobile engines on Sunday and the
parking requirements of the City of Columbia Heights be complied
with. Roll Call - All Ayes.
A lot subdivision request was received from Nicholas Kucisko to
divide 1021 - 41st into~rth and south parcels. The request was
unanimously recommended by the Planning Commission but the northerly
half would have to have street access. Motion by Land, seconded by
King to grant the request and the outstanding specials would be
divided according to the benefited lots. Roll Call: Land, King,
Logacz - Ayes. Jeska, Nawrocki - Nay. The subdivision was granted.
TRAFFIC COMMISSION RECOMMENDATIONS:
Motion by King, seconded by Jeska that the Council concur with the
Traffic Commission recommendation to move one of the two parking
meters between the alley between Central and Van Buren to facilitate
better bus movement and designate the spot no parking by painting
the space yellow. Roll Call - All Ayes.
Jack Meyer of the ~ansit Commission and the Commission's arc~tect,
Peter Hall, were present to show plans for a proposed bus shelter
on the corner of 44th and Central on the 15' easement as recommended
by the Traffic Commission. Mr. Meyer said the purpose of this
shelter is to encourage bus riding in the metropolitan area and
that four shelters like this are planned for the metro area, one
in Bloomington, St. Paul, Minneapolis and Columbia Heights.

Two sites were considered in Columbia Heights, one at 37th and
Central and the other at 44th and Central. The Transit Commission
decided on 44th and Central as two bus lines pass this corner and
on 37th there is a building where people can stand inside and wait
for the bus during bad weather. The shelter will be heated in the
winter, will have a pay telephone, tempered plate glass windows for
visibility, and news stands. Motion by King, seconded by Land
to authorize the Mayor and City Manager to enter into a lease
agreement with the Metropolitan Transit Commission to provide a
bus shelter on the corner of 44th and Central Avenue N.E. Roll Call -
All Ayes.
Motion by Land, seconded by King to table the second reading of
Ordinance #717 amending Ordinance #462 to allow a restaurant in a
C-2 zone until the next regular meeting of the City Council.
Roll Call - All Ayes.
First reading of Ordinance #720 amending Ordinance #462 rezoning
Lots 21 and 22, Block 2, Reservoir Hills (4341 Central) from C-2-S
General Shopping Center to C-2 General Commercial was held.
A discussion was held on the license renewal fee for multiple
dwellings and the Building Inspector was directed to obtain a
survey of what other communities charge on this.
No action was taken on consideration of a senior citizens garbage
rate for hardship cases.
Motion by King, seconded by Land that the City Manager be authorized
to call for bids on a used loader, the bidsto be opened November 24.

Motion by King, seconded by Land to authorize the taking of an option
for a one year extension on our sewer cleaning compound contract with
the Sanfax Company. Roll Call - All Ayes.
Mr. Barna reported the City Manager received a call from H.U.D. on
Friday and they concurred in the award of bids to Orfei & Sons.
Motion by Jeska, seconded by Logacz that a special meeting be called
for Monday, December 1st at 8:00 p.m. to be held in the regular
Council Chambers for the purpose of consideration of adoption of
assessment rolls. Roll Call - All Ayes.
The City Attorney reported a request for an ordinance prohibiting
drag racing and screeching of Seels. The ordinance will be reviewed
by the Traffic Commission.
The City Attorney reported the bus fare case has been filed and the
transcript was ordered from the reporter.

A discussion was held on taking bids for a sewer cleaning machine but
the Council felt we were not ready to call for bids in December and
Mr. Jolly will make a report on what type of program can be worked out
for rental.
Councilman Jeska asked Mr. Borocki about the situation on Fairway
Drive and Mr. Borocki said he would have to check with George Brown
and a report will be mailed to the Council this week.
Councilman Jeska also asked if the alley between Central and Van Buren
from 39th ~o 40th could be surfaced. Four people have asked for this
and he suggested they file a petition for a concrete alley.
Motion by Land, seconded by Logacz that the license applications as
per list attached, be granted upon payment of proper fees. Roll
Call - All Ayes.
