Motion by Jeska, seconded by Logacz that the minutes of the last
regular and special Council meetings be approved as presented in
'writing and the reading dispensed with. Roll Call - Ali Ayes.

Bids on concrete alley paving - 46th to 47th Avenue between Pierce
and Fillmore were received from the following:

Motion by King, seconded by Land that the bids be turned over to the

Roll Call - All Ayes.
The second reading on ordinance #694 regulating the use of snowmobiles
in the City of Columbia Heights was not held. Mayor Nawrocki stated
there has been a delay in getting the laws passed by the 1969 session
of the le~slature in regards to snowmobiles and therefore a second
reading should not be held as yet. One gentlemen present stated he
had talked with John Murzyn, Park Superintendent, who told him the
Park Board thought it might be all right to operate snowmobiles in
the part of Huset Park as far as Jefferson Street avoiding the sliding
area. Mayor Nawrocki said it was up to the Park Board to determine
what parks may be used. Motion by Jeska, seconded by Logacz that the
second reading of Ordinance #694 be tabled until November 10, 1969.
Roll Call - All Ayes.
The City Manager was directed to inquire into the snowmobile matter
further by contacting the State of Minnesota Department of Conservation
and the League of Minnesota Municipalities.
The second reading of Ordinance #696 on conduct in schools was not
held as the City Manager has still had no response from the teacher
organizations. Councilman Land has contacted them and is expecting
to get their comments shortly. Motion by Land, seconded by King that
the second reading of Ordinance #696 on conduct in schools be continued
until November 10, 1969. Roll Call - All Ayes.
A second reading was held on Ordinance #715 regarding parking meter
fines. The ordinance was offered by Land, seconded by Logacz.
Roll Call - All Ayes. The ordinance was adopted.
A fence height waiver request was received from Mr. Lee Paulson, 5100
Ranier Pass. Mr. Paulson was present stating he has a written agreement
from his neighbor who has no objection to the construction of a 6'
high alternating board fence. Motion by King, seconded by Land that
the request be granted upon the recommendation of the Planning and
Zoning Commission. Roll Call - All Ayes.

Mr. Arne Gilbertson, 5201 - 7th Street, was present requesting a
home occupancy permit to teach piano and organ, and audio visual
instruction by mail. He uses a small multigraph to print the
instructions and the music. He presented statements from both his
neighbors stating they have no objections to the type of work being
done and the request was unanimously approved by the Planning and
Zoning Commission. Motion by King, seconded by Land that the home
occupancy permit be granted. Roll Call - All Ayes.
A lot subdivision request was received from Theodore Zimba and
Donald Michnowski to divide the lot at 4305 Monroe Street to allow
a second dwelling site at 707 - 43rd Avenue. This is a large corner
lot and should be split so the present house would face Monroe
Street and the new lot would face 43rd Avenue. The request was
recommended by the Planning and Zoning Commission on a three to
one vote. Motion by King, seconded by Logacz that the subdivision
request be granted and that a lot area waiver be granted to allow
the 66I X 98.3I lot and a 70.15' X 98.33' lot with a 7' easement
for future alley purposes, and that the house be placed to conform
with the setback on 43rd Avenue on the two adjoining garages.
Roll Call - All Ayes.
A request was received from Mr. Frank Gross of 3851 Central to
operate a small machine shop in the garage of his Electrical
Service Center. The machine shop would be operated by Mr. Ted Jonak.
Mayor Nawrocki expressed some concern over the parking situation and
Mr. Gross told him there would be spaces for four cars behind the
shop. This request was recommended unanimously by the Planning
and Zoning Commission. Motion by Jeska, seconded by Logacz that
the special use permit for the garage at 3851 Central be granted
for a small machine shop subject to the limitation that the operation
shall be only between the hours of 7:00 a.m. and 8:00 p.m. and that
employee parking be provided in the existing surfaced spots and
within the existing fenced-in area. Roll Call - Land, King, Jeska,
Logacz - Ayes. Nawrocki - Nay. The request was granted.
An appeal of the Planning and Zoning Commission denial of a transfer
of a take-out food restaurant license was received from Mrs. Frances
Urista who now operates the Superior Chicken restaurant at 4011 Central
Avenue. She proposes to move the restaurant to the Little Chief
Shopping Center now under construction on 37th and Stinson Boulevard.
In order to operate a restaurant at this location now zoned C-2 it
would take a rezoning and the Council members do not want to rezone
the area to C-3 to allow a restaurant. Councilman Land felt a
special use permit would be the answer although he is not in favor
of letting any type of drive-in restaurant come into the are~. It
was suggested that the City Attorney make some changes in the ordinance
to allow the restaurant to be put in the C-2 area for a possible first
reading at the next regular Council meeting. No action was taken on
the appeal.

Mr. A1 Martinson was present requesting a waiver for a solid 6' high
board fence he built around his swimming pool unaware of the fence
permit requirement. The Planning and Zoning Commission recommended
the waiver unanimously for safety reasons in keeping children from
climbing over the fence and falling into the pool. Motion by King,
seconded by Jeska that the waiver be granted to Mr. Martinson to
allow construction of a solid board fence around the swimming pool
in back of his home at 1916 - 40th Avenue N.E. Roll Call - All Ayes.
It was suggested that the Building Inspector and Permit Department
make citizens aware of the fence permit requirement when a swimming
pool building permit is purchased.
The City Manager reported the preliminary plans for the 49th Avenue
footbridge have been received by the Highway Department. The Council
reviewed the plans and a resolution was offered by Logacz, seconded
by Jeska WHEREAS the Commissioner of Highways has prepared preliminary
plans for the improvement of a part of Trunl¢ Highway Number 5
renumbered as Trunk Highway Number 65 within the corporate limits
of the City of Columbia Heights at 49th Avenue N.E.; and WHEREAS
said preliminary plans are on file in the office of the Department
of Highways, St. Paul, Minnesota, being marked, labeled, and identified
as Layout No. 1 - S.P. 0207-25 (65-5) at 49th Avenue N.E.; and
WHEREAS copies of said preliminary plans as so marked, labeled, and
identified are also on file in the office of the City Clerk; and
WHEREAS the term "said preliminary plansI' as hereinafter used in
the body of this resolution shall be deemed and intended to mean,
refer to, and to incorporate the preliminary plans as in the foregoing
recitals particularly identified and described; NOW, THEN, BE IT
RESOLVED that said preliminary plans for the improvement of Trunk
Highway Number 5 renumbered Trunk Highway Number 65 within the limits
of the City of Columbia Heights be and are hereby approved. Roll
Call - All Ayes.
Mrs, Beverly Sonnenberg and Mr. Gail Tilton were present requesting
reconsideration on the fence problem at 4441 and 4445 - 6th Street
raised by Mr. Tilton September 8, 1969. Mr. Tilton has sold his
house and Mrs. Sonnenberg stated she will have the fence painted
on the Tilton's side and the post near the alley removed as soon as
the Tilton's have moved. The Council felt it was up to the administration
to work with these people now.
Motion by King, seconded by Jeska that the City Manager be authorized
to spend up to $1,000 for surfacing ~~XX[~material for the
tennis court at Ostrander Park, $1,000 for sod at Memorial Park and
$1,OOO for black dirt for work in Memorial Park. Roll Call - All Ayes.
A recess was called at ll:05 p.m.
The meeting came back to order at ll:15 p.m.

A discussion was held on the garbage pick-up service contract and the
following items will be inclUded in the new contract. 1. Everyone
will be entitled to have up to two 32 gallon cans designed by our
ordinance. 2. Location. The cans shall be picked up by the alley
where a public alley exists and by the back door where no alley exists
or at a reasonably accessible space. 3. Pick-ups shall include up to
four automobile tires per year, leaves, branches, papers and magazines
up to 20 pounds, and non-organic household refuse which shall be
bundled or tied and put out on the curb on pick-up day. Christmas
trees up to 6' in length wi.Il be picked up in January. The bids were
tabulated and the following action was taken. Motion by King, seconded
by Jeska that the bid for garbage and rubbish pick-up be awarded to
Modern Clean-up Services, Inc. for a two year period and the Mayor
and City Manager enter into an agreement for same, the service to
begin November 3, 1969. Roll Call - All Ayes.
A second reading of the ordinance regulating garbage collection will
be held October 27. th.
The City Manager was directed to compose a letter to all citizens in
Columbia Heights explaining the reason for the service, changes, and
prices.
The City Engineer reported the bids on alley paving for 46th and 47th
between Pierce and Fillmore were 25% higher than had been anticipated.
He recommended that the Council reject' the bids and readvertise in the
spring. He stated some patch work will be done this winter to keep
the alley in satisfactory condition. Motion by King, seconded by
Logacz that the bids be rejected on the basis that they are too high
over the estimates. Roll Call - All Ayes.
Motion by King, seconded by Jeska that the City Manager be authorized
to spend up to $1,000 for a folder-inserter machine to be used in the
city office. Roll Call - Ail Ayes.
Motion by Jeska, seconded by Land that the City Manager be authorized
to spend up to $50 to attend a two-day conference in Mankato, November
10th and llth. Roll Call - All Ayes. This conference is co-sponsored
by the American Association of School Administration and the International
City Management Association and is being held for school superintendents
and city managers.
The following resolution providing for public sale of $660,000 General
Obligation Permanent Improvement Revolving Fund Bonds was offered by
Land, seconded by Jeska BE IT HEREBY RESOLVED by the Council of the
City of Columbia Heights, Minnesota, as follows: 1. This Council
by its Ordinance No. 714 adopted September 22, 1969, authorized the
issuance of $650,000 principal amount of Permanent Improvement Revolving
Fund Bonds of the City to provide funds for the construction of public
improvements of a lasting character, including improvements to the city's
water utility. It is hereby determined to be necessary to proceed with
the public sale of said bonds; and to obtain the best bid for said bonds
at public sale, to sell and issue an additional $10,000 of like bonds
together with said bonds pursuant to Minnesota Statutes, Section 475.56.

2. This Council shall meet at the time and place set forth in the
form of notice hereinafter prescribed for the purpose of receiving
bids for the purchase of said bonds. The City Manager is hereby
authorized and directed to cause a notice of the time, place and
purpose of the meeting to be published once in the official newspaper
of the City and in the Commercial West, published in Minneapolis, Minnesota,
which notice shall be in substantially the following form: NOTICE IS
HEREBY GIVEN that the Council o,f the City of Columbia Heights, will
meet at the City Hall on Monday, November 10, 1969, at 8:00 p.m., Central
Standard Time, to receive, open and consider sealed bids for the
purchase of $660,000 negotiable coupon, general obligation Permanent
Improvement Revolving Fund Bonds of the City. The bonds will be dated
November 1, 1969, and will mature without option of prior payment on
February 1 in the amount of $100,000 in each of the years 1972 through
1974, $80,000 in the year 1975, and $70,000 in each of the years 1976
through 1979. Interest on the bonds will be payable on August 1, 1970,
and semiannually thereafter on each February 1 and August 1. All bonds
maturing on the same date must bear interest from date of issue until
paid at a single, uniform rate, not exceeding the rate specified for
bonds of any subsequent maturity. Each rate must be in an integral
multiple of 5/100 of 1%, and no rate may exceed 7%. No supplemental
or "B" coupons will be permitted. The bonds will be issued in
denominations of $1,O00 or $5,000, as requested by the successful
bidder within 48 hours after award of sale.
Principal and interest will be made payable at any suitable bank in the
United States designated by the successful bidder within 48 hours after
award of ~le, subject to approval by the City, and the City will pay
the reasonable and customary paying agency charges. The City will
furnish, without cost to the purchaser and within forty days after
award of sale, the printed and executed bonds, the usual form of
no-litigation certificate, and the unqualified approving legal opinion
of bond counsel designated below. Delivery will be made without cost
to the purchaser anywhere in the continental United States. Payment
by the purchaser must be in immediately available funds. An unqualified
legal opinion on the bonds will be furnished by Messrs. Dorsey,
Marquart, Windhorst, West & Halladay of Minneapolis, Minnesota. The
legal opinion will be printed ~on the bonds at the request of the
purchaser. The legal opinion will state that the bonds are valid
and binding general obligations of the city.
Sealed bids must be mailed or delivered to the undersigned and must
be received prior to the time of said meeting. Each bid must be
accompanied by a cashier's or certified check or bank draft in the
amount of $13,200, payable to the City Treasurer, to be retained by
the City as liquidated damages if the bid is accepted and the bidder
fails to comply therewith. The bid authorizing the lowest net interest
cost (total interest from date of bonds to stated maturities, less
any cash premium or plus any amount less than $660,000 bid for
principal) will be deemed the most favorable. No oral bid, and no
bid of less than $650,000 for principal plus accrued interest on all
of the bonds, and no bid involving a net interest cost exceeding an
average annual rate of 7%, will be considered. The City reserves the
right to reject any and all bids and to waive any informality in any

bid. The successful bidder will not be required to accept delivery
of the bonds if on or before the date of tender of delivery to the
purchaser any federal law, regulation or ruling shall provide that
the interest on the bonds is to be included in gross income of any
recipient in computing any tax on or deduction from income for
federal income tax purposes, and in this event the deposit securing
the bid will be returned.
3. Each and all of the terms and provisions of the foregoing notice
of sale are adopted and confirmed as the terms and conditions of the
bonds and of their offering for sale. Roll Call - All Ayes.
Mr. Jack Meyer who represents Anoka County on the Metropolitan
Transit Commission has had discussions with the City Engineer regarding
a bus shelter on 44th Avenue and Central Avenue. He wanted to attend
the meeting to explain the proposals to the Council but became sick
and could not make it. Motion by King, seconded by Jeska that the
matter of the bus shelter in conjunction with the M.T.C. be referred
to the Traffic Commission for action and/or recommendations.

The City Manager brought forth a letter from Twin City Lines, Inc.
responding to a request to have the bus service moved from University
Avenue over to 3rd Street between 37th Avenue and 40th Avenue. The
letter stated the bus company would rather operate the bus on 2½ Street
or Main Street to avoid some of the turns on the route. Motion by
Land, seconded by Jeska that the bus company be notified that the
City Council wishes to have the bus line moved from University over
to 3rd Street. .Roll Call - All Ayes.
Motion by Jeska, seconded by Logacz that a special meeting of the
City Council to canvass the primary election results be set for
Wednesday evening at 9:30 p.m. Roll Call - Ali Ayes.
Mayor Nawrocki called a spec~i meeting of the City Council for
Thursday, October 30, 1969 at 8:00 p.m. for purposes of considering
the budget for 1970.
The City Attorney presented Ordinance #716 regulating the salaries
of the Mayor and Council members and a first reading was held.
The City Attorney explained the condemnation proceedings and a
motion was made by Land, seconded by King that the City of Columbia
Heights issue a draft to Victoria Wargovick and Andrew Wargovick,
and Frank Kozlak their attorney, for the sum of $400; a draft to

Motion by King, seconded by Logacz to pay appraisers fees and costs
to Albert Kordiak in the amount of $150, Harvey Peterson in the

Motion by Jeska, seconded by King that the Mayor and City Manager be
authorized to enter into an agreement with the Minneapolis Public
Library for use of the library facilities between residents of
Minneapolis and Columbia Heights. Roll Call - All Ayes.
Motion by King, seconded by Land that the Mayor and City Manager be
authorized to enter into an agreement with Modern Clean-up Services,
Inc. to terminate their present contract as of November 3, 1969,
subject to the agreement going into effect. Roll Call - All Ayes.
Motion by King, seconded by Land to authorize expenses for two people
to attend the 16th Annual Bituminous Conference at the University of
Minnesota, November 12, 1969. Roll Call - All Ayes.
The City Engineer explained he has bids for the purchase of new street
signs on 40th Avenue for each intersection between CeNtral and
University. The bid from Don Harstad Company is $28.96 per inter-
section or $405 complete. The other bid was $1.68 per intersection
less but we would have to supply the faces. Therefore, the City
Engineer recommended the acceptance of Don Harstad Bid. No Council
action was needed.
The City Engineer requested authorization to spend $1200 for the
purchase of pipes on Summit Street from 5th Street to the west from
the alley between 40th and Summit. He stated the assessment and
project hearings have been held. Motion by Jeska, seconded by Logacz
that the City Manager be authorized to spend up to $1200 for the
purchase of pipe and pipe suppliers as accepted by the County of
Anoka. Roll Call - All Ayes.
Motion by Jeska, seconded by King that the City Manager be authorized
to spend up to $1,000 for rental equipment for storm sewer work for
the alley from 5th Street to Lookout from 40th to
Summit Street. Roll Call - All Ayes.
Motion by Jeska, seconded by Land that the removal of parking meters
between Jackson and Van Buren on 40th Avenue be authorized in accordance
with the recommendation of the Traffic Commission and that two hour
parking limit signs be posted. Roll Call - All Ayes.
Motion by Land, seconded by King that the license applications as per
list attached be granted, upon payment of proper fees. Roll Call -
All Ayes.
A request was received from Lennox Hill of 1702 Mississippi Street,
New Brighton, to conduct an auction of garage equipment on Saturday,
October 18, 1969 at 1:00 p.m. at Bailey's Brake Alignment Company,
4043½ Central Avenue. Motion by Jeska, seconded by King that the
license application request for an auctioneers license be granted
upon payment of proper fee. Roll Call - All Ayes.

Motion by Jeska, seconded by King that the request from Immaculate
Conception Church for a bingo permit for 1970 be granted. No fee.

Councilman Jeska brought forth a problem with #2 liquor store
customers parking in the Oildyne parking lot on 40th Avenue. City
Manager stated he informed the owner of Oildyne he should put up
"No Parking" signs but apparently they have done no good. There is
not enough parking spaces at the liquor store.
Motion by King, seconded by Jeska that the 2nd reading of Ordinance #713
on garbage collection service be tabled until the special meeting of
the City Council, Wednesday, October 15, 1969 at 9:30 p.m. Roll Call -

Motion by Land, seconded by Jeska that Mildred Carlson be appointed
secretary pro tem. Roll Call - All Ayes.
A resolution was offered by Logacz, seconded by Jeska, BE IT HEREBY
RESOLVED by the City Council of the City of Columbia Heights, that
the County Auditor be, and he is hereby directed to levy the
delinquent special assessments on the properties in the City of
Columbia Heights as submitted on the duplicate statement form with
the amount to be levied indicated opposite the stamp "Certified to
County Auditor" BE IT FURTHER RESOLVED that the foregoing amounts
shall be included in the individual real estate tax statements for
the current year and identified thereon as special assessments.
Said levies shall be enforced and collected in the manner provided
for the enforcement and collection of state and county taxes under
and in accordance with the provisions of the general laws of the
state. All assessments with penalties and interest as indicated
thereon paid to the County Treasurer shall belong to the City of
Columbia Heights ~d shall be turned over to the City Treasurer in
the manner provided by the City Charter and Ordinances. The City
of Columbia Heights shall accept payments on these levies until the
end of the calendar year. Upon receipt of said payments the County
will be notified to remove this levy from the tax rolls.
