Mayor Nawrocki reported the situation at Budget-Rent-A-Car where
Ted Brown has put up a tin sheet painted white on the outside of his
fence. Landscaping was to have been done when they were given the
permit to move into the area and this has not been done as yet.
Mr. Sonnenberg said he would check into this.
Motion by Jeska, seconded by L0gacz that the Council accepts the
design of the flag as submitted by the Jaycees and Mel Annerud as
the official city flag to be placed in the Columbia Ice Arena.

A hearing was held on opening 39th Avenue N.E. between Stinson Boulevard
and McKinley after a request was received from Quality Homes, Inc.
now in the process of purchasing Lot 2, Block 1, Walton's Sunny Acres
2nd Addition to Columbia Heights from Mr. Pete m on. The City Manager
presented the cost estimates running about $14000 which includes
cutting away the concrete curbing on Stinson and opening the right-of-
way, and stated .in the future the curb and gutter cost would be
approximately $3,000 and the sanitary sewer would be about $2400.
Any costs would be spread about half way up the block to 40th Avenue.
A representative of Quality Homes, Inc. was present and said the purchase
of the lot is contingent upon the street opening and he has spoken to
Gerry Herringer, who owns the two lots on either side, to negotiate
something with him but no settlement could be reached. Mr. Herringer
said he was not interested in trading or selling his property and he
is opposed to paying any assessments on the street opening. Dr. Williams,
from the doctors building on Stinson, is also opposed to paying the
assessments. Mayor Nawrocki added the street opening does not automatically
give Quality Homes the right to put up an apartment building and his
plans would have to be considered by the Planning and Zoning Commission.
Motion by Land, seconded by Logacz that the request to open 39th Avenue
be granted including curb and gutter. Roll Call - Land, Logacz - Ayes.
King, Jeska, Nawrocki - Nay. The motion was defeated.
A discussion was held on the award of bids on garbage collection service.
The low bidder, Ace Solid Waste, is having trouble getting a performance
bond. Mr. Took and Mr. Strittmater of Modern Clean-up were present
stating they would like to be considered as low bidder if Ace does
not come up with a bond and they would like to waive the letter submitted
with their bid re: pick-up of tires as most people trade old tires in
and there will not be many to pick up. Motion by King, seconded by Land
that the City Manager be authorized to enter into a contract with the
low bidder and he be given until September 29 at 5:00 p.m. to come up
with a performance bond and if the contract cannot be consumated the
City Manager be authorized to call for bids to be opened at the next
regular Council meeting, October 13. Roll ~ll - All Ayes.

Bids were opened at li:OO a.m., Monday, September 22, 1969 on water
main improvements and were higher than had been anticipated. Mr.
Grieling of the local H.U.D. office suggested that the City Manager
contact the regional H.U.D. office in Chicago to request additional
funds be granted to the city. He further suggested that the Council
pass a resolution recommending acceptance of'the low bidder, Orfei &
Sons, Inc. for the amount quoted provided the H.U.D. office concurs
in the award and with the request that additional funding be made
available. A resolution was offered by Land, seconded by Logacz,
BE IT HEREBY RESOLVED by the City Council of the City of Columbia
Heights that the low bid of Orfei & Sons, Inc. on H.U.D. Project
WS-Minn-65 Phase 2, Municipal Project #6901, City of Columbia
Heights, Minnesota in the amount of $1,202,166.87 on Part A and
$77,131.39 on Part B for a total bid of $1,279,298.26 be accepted
provided the regional office of H.U.D. concurs said award and
necessary financing provided. Passed this 22nd day of September, 1969.

Motion by Jeska, seconded by King that the City Manager be authorized
to apply for additional funding from the regional H.U.D. office for
Project #6901 due to the increased costs reflected in the bids.

Motion by King, seconded by Jeska that the City Manager be authorized
to advertise to call for bids for janitorial services for the City
Hall and Library,bids to be opened October 13, 1969. Roll Call -
All Ayes.
Mr. Roy Hilton was present appealing the Planning Commission denial
of his request to rezone the westerly half of his lot at 4301 University
from R-2, General Residential, to R-3, Multiple Dwelling, to build
an I1 unit apartment building. The neighbors are ~raid this construction
would decrease the value of their homes and they do not want to see
barracks-type garages or parking stalls. Councilman Jeska stated the
feeling of the planning Commission which is University Avenue in
some areas is commercial and industrial but in this particular area
there are nice homes and rezoXning would spoil the aesthetics of the
neighborhood. Motion by Land, seconded by Logacz that the appeal
be denied. Roll Call - All Ayes.
Second reading of Ordinance #686 rezoning SuXilivan Lake property was
held. Offered by Logacz, seconded by Land. Roll Call - Land, Logacz-
Ayes. King, Jeska, Nawrocki - Nayes. The ordinance was defeated.
No action was taken on Ordinance #713 amending the garbage ordinance.
Second reading of Ordinance #714 - issuance of $650,000 bonds.

First reading of Ordinance #696 - conduct in schools was held.
Councilman Land would like to hear the views from the teachers
organizations ~ this and the City Manager reported they were contacted
last spring but we have received no response.

The meeting was called back to order at 10:50 p.m.
A lot subdivision request was received from Mike Reichenberger to
divide Lot 7, Block 3, Reservoir Hills. Motion by King, seconded by
Land, that the request be granted and the special assessments of
$516.83 be split accordingly to the benefited property. Roll Call -
Ail Ayes.
A request was received from Mrs. Forrest Cornelius to connect her
home at 4020 Main Street in Fridley to the Columbia Heights sanitary
sewer on Main Street. A check in the amount of $250.00 was submitted
to cover the cost. Motion by Land, seconded by King, that the request
be granted. Roll Call - All Ayes.
Motion by King, seconded by Jeska that the City Manager be authorized
to call for a hearing on installation of sidewalks on the south side
of 49th Avenue between Monroe and University, the hearing to be held
at the regular meeting of the City Council November l0 1969 at 8:00 p.~

Motion by Jeska, seconded by King, that the list of election judges
for the primary and/or general election as presented be granted.

George Ihnot was present asking that the provision stated at the
September 8, 1969 meeting of the Council that a $2500 performance bond
be posted to insure completion of the work involved in moving his
house from 4105 - 3rd Street to 4133 Reservoir be lifted as he is
unable to secure a bond in that amount. Motion by King, seconded by
Jeska that the original motion be amended to allow a $500 certified
check to be deposited with the city in lieu of the $2500 bond for
the faithful performance as indicated in the motion. Roll Call -
AI'I Ayes.
Mr. Ihnot also requested a waiver to allow the northeast corner of
his house to come within 6' of the north lot line. A petition signed
by some of the neighbors stating they have no objections to the waiver
was presented. Motion by King, seconded by Jeska that the waiver be
granted. Roll Call - All Ayes.
The City Assessor, John Larson, requested permission to attend an
appraisers course to be held at Macalester College Tuesday evenings,
October 7 through March 3, the cost being a total of $95. Motion by
King, seconded by Logacz, that the request be granted. Roll Call -
All Ayes.

The City Manager reported on the budget hearings, a meeting with the
Library Tuesday evening at 7:00 p.m., and the first meeting of
the Policy and Goals Committee at 8:00 p.m. On Wednesday evening
a meeting at 7:00 p.m. with the Civil Defense Department and the
Human Rights Commission meeting at 8:00 p.m. to discuss Roosevelt
City, Alabama. At 6:00 p.m., Thursday, the Council will meet with
representatives from the Police Department.
The City Attorney presented the following resolution ordering a
certain building located at 4301 - 7th Street N.E., Columbia Height,
Minnesota, to be razed and removed. Resolution offered by King,
seconded by Jeska, WHEREAS, Moens Jokumson, and Pauline Jokumson,
husband and wife, are the owners of the building located at 4301
Seventh Street Northeast, Columbia Heights, Minnesota, and WHEREAS,
the building is best described as a two-story frame house, and
WHEREAS, an inspection of said premises and a report thereon by
the Building Inspector ~r Columbia Heights relates that the building
is inadequately maintained, dilapidated and abandoned, and,
consequently, constitutes a fire hazard and a hazard to public
safety and health, and WHEREAS, on the basis of said report
the Council of the City of Columbia Heights finds that said building
is inadequately maintained, is dilapidated and abandoned and,
consequently, constitutes a fire hazard and a hazard to public
safety and health. NOW,THEREFORE, BE IT RESOLVED that Moens Jokumson
and Pauline Jokumson, husband and wife, shall be ordered to ~ze
and remove the building on the property legally described as:
Lot 4, Block 5, except the North 167.19 feet thereof, Rearrangement
of Block A, Columbia Heights Annex to Minneapolis. This action is
taken pursuant to Minnesota Statutes Annotated, 463.15 through 463.26
on the grounds that the said building is a hazardous building within
the meaning of that statute. Roll Call - All Ayes.
The City Attorney presented the following resolution ordering

Roslyn Park, Anoka County, Minnesota. This action is taken pursuant
to Minnesota Statutes Annotated, 463.15 through 463.26 on the grounds
that the said buildings are hazardous buildings within the meaning of

The City Attorney presented Ordinance #715 amending the traffic
ordinance (#428) and the first reading was held.
The Attorney also presented snowmobile ordinance #694.

to advertise for bids for one concrete alley, the alley between 46th
and 47th between Pierce and Fillmore, bids to be opened at the
October 13th meeting, subject to obtaining the right-of-way. Roll

Motion by King, seconded by Land that expenses be authorized for
two persons to attend the 53rd annual Waterworks Conference at the
Pick-Nicollet Hotel, October 1, 2, and 3rd. Roll Call - All Ayes.
Motion by Jeska, seconded by King that expenses be authorized for
two persons to attend a meeting of Minnesota Good Roads, September 29
at David Fong's Restaurant. Roll Call - All Ayes.
Motion by Jeska, seconded by King that the license applications as
per list attached be granted upon payment of proper fees. Roll Call -
A11 Ayes.
In regards to the rubbish hauling license application from Mike Guptill
and Mike Jensen presented September 8, they should be informed the
Police Department report was unsatisfactory and the license not be
granted.
