Mayor Nawrocki reported he received correspondence from Senator Mondale and Cong. MacGregor indicating they would check with federal agencies to see if any financial assistance is available for work with Roosevelt, Alabama. Mr. Watson stated we have received no reply to his letter to the Mayor of Roosevelt of June 26, 1969. The Planning and Zoning Commission has indicated they would like to hold a joint meeting with the City Council and Carl Dale, the city planner, August 19, 1969. The Mayor read a letter to Chief Glader from the County Attorney's office congratulating the officers for their fine work in apprehending two burglars. The Mayor asked the Council to give some thought to constructing sidewalks on 49th Avenue from University to Central Avenue. The City Manager stated this was a standard maintenance procedure that should be done approximately every fifth year or so to keep the streets in good condition. The cost will be approximately 45¢ per front foot. The seal coating will include any major repair work that must be done to the streets or to the curbs and gutters. Mr. Bill Marshall, who lives on the corner of Johnson Street and Innsbruck Parkway was present in opposition to the project stating if his street is kept in good repair young people will use it as a race track. He stated some of the problems he has had this summer with auto racing and loitering in his neighborhood. A resident of 43rd and McLeod present also complained of young people driving carelessly down her street. Mayor Nawrocki suggested these problems be taken to the Traffic Commission. Councilman Land asked the City Engineer when the work would be completed and the Engineer said it would take about seven work days by the city crew. A Resolution ordering the improvements was Offered by Land, seconded by ~XKing, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, WHEREAS, the City Council of the City of Columbia Heights by Motion on the 2~th day of July, 1969 ordered notice of a hearing to be given to property owners, and WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council meeting on the llth day of August, 1~69, and WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions. NOW, THEREFORE, IT IS HEREBY RESOLVED: 1. That the location and extent of such improvements is as follows: As listed in Public Hearing Notice published 7/30/69 and 8/6/69 and attached and made a part hereof. 2. That the materials to be used are as follows: Cationic emulsion and seal coat aggregate in accordance with appropriate State Highway specifications. 3. That a careful estimate of the cost of the improvement has been made by the City Manager and the several lots and parcels of land fronting upon and adjacent to such proposed improvement, which he deemed benefited thereby, were properly notified 75. of said hearings, and 4. That the City Manager shall also list the names and owners of the several parcels so improved as nearly as can be ascertained. 5. These improvements shall also be known as Project #641. Roll Call - All Ayes. Consideration was given to a new garbage service contract. Motion by Land, seconded by Jeska, that'the City Manager be authorized to advertise for bids for garbage pick-up service, the bids to be opened at the September 8, 1969 regular Council meeting. Roll Call - All Ayes. It is hoped that the service could begin some time in October and the ordinance will have the necessary changes making service mandatory ready for the next regular Council meeting. A signed agreement from Modern Clean-up cancelling the contract should be received very soon. No bids were received on the city owned property at Block 5, Reservoir Hills, on 40th Avenue just east of Central. A letter was received from the Post Office Department indicating an interest to negotiate for an option on the property. Motion by King, seconded by Jeska, that the City Manager be authorized to negotiate with the Post Office Department for an option on the city owned lots at 4Oth Avenue east of Central, the south 42' of Lot 14, all of Lot 43, and the west 20' of Lot 44, Block 5, Reservoir Hills. Roll Call - Ali Ayes. Second reading of Ordinance #710 - sale of property in Apache Heights to Gerrall Herringer. Offered by Jeska, seconded by La~d. Roll Call - All Ayes. The ordinance is adopted. Mr. Clifford Peterson, 4011 Polk Street, stated his intentions at the Planning and Zon~g Commission meeting to appeal their denial of a side yard waiver to place a garage 17' high, with the appearance of a barn. Mr. Peterson was not present at the meeting. Motion by Land, seconded by Jeska, that the appeal for a waiver be tabled until the next regular meeting for additional information. Roll Call - All Ayes. A request was received from Charles Eastman of 2217 - 39½ Avenue to build a 5' high chain link fence as the dog who will be confined ins~e the fence is able to jump a 3½' fence. Motion by King, seconded by Jeska to grant the waiver based on the recommendation of the Planning and Zoning Commission. Roll Call - All Ayes. A request was received from Dr. Donald Coron of 1825 Innsbruck Parkway to build a 7' fence in his back yard. Motion by King, seconded by Jeska that the request be granted based on Planning and Zoning Commission recommendation and concurrence with his neighbor. Roll Call - All Ayes. 76. A request was received from Budget Rent-A-Car, 3828 Central Avenue, for a special use permit to operate an auto rental business. This was unanimously recommended by the Planning and Zoning Commission. Budget Rent-A-Car had no representatives present at the meeting. Motion by Jeska, seconded by King, that the request be tabled for further information. Roll Call - All Ayes. Two representatives from Budget Rent-A-Car appeared at the meeting to explain what they will be do~g. Mayor Nawrocki asked them to present a written proposal showing a description of the property and where the rental cars will be located. The gentlemen stated this is the location where Mr. Ted Brown was given permission to erect a screening fence to shield automobiles he has in storage waiting to be repaired and the rental business can park some of their rental vehicles in the fenced enclosure. Councilman Je~ka asked that the item be taken from the table as he has a proposal. Motion by Land, seconded by Jeska that the matter be taken from the table. Roll Call - Land, King, Jeska - Ayes. Motion by Jeska, seconded by King that Budget Rent-A-Car systems be allowed to go into the building at 3828 Central, the exterior cars on the street be put in the fenced enclosure, the parking area have blacktop surface, a permanent hedge screening be placed behind the sidewalk immediately in front of the parking area along Central Avenue and towards the rear on the north side of the lot towards the fenced enclosure, that additional parking that may be needed be placed in the fenced area or in the building itself, the work to be completed by September 1, 1969. Roll Call: Land, King, Jeska - Ayes. Nawrocki Nay. A request was received for a lot subdivision at ii. 08 - 45th Avenue N.E. Motion by Jeska, seconded by Land, that the subdivision request to divide Lots 10 and ll, Block 1, Reservoir Hills be granted and the outstanding special assessments be ~paid. Roll Call - All Ayes. A request was received for a lot subdivision at 1307 - 42nd Avenue. Motion by Land, seconded by King, that the subdivision request for Lot 46, except the west 4I of the south 150' and except the south 5' thereof, Block 3, Reservoir Hills, be granted and the outstanding special assessments of $274.24 be divided. Roll Call - All Ayes. No action was taken on the license application of Gladys Swanson to operate a beer parlor at 4010 Central Avenue N.E. No action was taken on the Planning Commission recommendation on the Sullivan Lake proposal. Mr. Ahlstrom was present requesting a special use permit for a used car lot at the old Shell station on 51st and Central. He stated he proposes to buy the property and as it is in very good condition, it would require very little clean-up. This will not be a junk yard, the lot is paved, and the lighting system will not bother the neighbors. The City Attorney stated this location is right across the street from the area Minar Ford proposed a car lot and was turned 77. down. Mayor Nawrocki feels there are plenty of businesses of this nature on Central Avenue now and would not like to see any more go in. Councilman Jeska stated he would like to have this item tabled giving the people living in this area a chance to express their f~elings on it and the Planning Commission will have a chance to look it over. Motion by King, seconded by Land, that the permit be granted subject to Planning Commission approval. Roll Call -Land, King - Ayes. Jeska, Nawrocki - Nayes. The Planning Commission will be holding a special hearing tommorrow night, Tuesday, August 12 at 8:00 p.m. and Mr. Ahlstrom was asked to attend this meeting. A gentlemen and his son were present to pay their share for damages done to the Silver Lake lift station about a year ago by five young boys, damages amounting to $120. The City Attorney will proceed to collect payment from the others who were involved. The City Manager reported he has received no response from Barber- Greene Company re: the Dunkley mixing plant. He also reported on the air conditioner complaint from 4412 - 2nd Street stating Twin City Testing had come out to check the noise level to see if it was in violation of our city nuisance ordinance. The City Manager reported receipt of a letter from Roosevelt City, Alabama today accepting our sister-city proposal and that copies of the response had been sent to the Council members. Mayor Nawrocki has also received letters from various federal agencies and departments regarding this proposal. The City Attorney reported Herritage Nursing Home has expressed an interest in the remaining city property in Apache Heights across from the doctors building. The Attorney has received the insurance certificates from Polar Bear Ice Cream to operate two trucks. Motion by King, seconded by Jeska that the license applications as per list attached be granted upon payment of proper fees. Roll Call - All Ayes. Mayor Nawrocki brought up the problem at the apartment building on Central Avenue with their garbage cans. Mr. Sonnenberg said he is trying to get the area cleaned up but the trucks can not get into the back of the budding and this prevents having vat service. Mayor Nawrocki also stated 3819 Johnson must be cleaned up. This was supposed to have been done July 1 and nothing has changed there.
