Mr. Lobash was present wondering about the Council's feelings on
his boulevard grade problem and also brought up the Shoppers City
problems which, had not been taken care of. The Council saw nothing
wrong with his boulevard and this is the way all the properties were
done on 44th Avenue. The Building Inspector was instructed to again
check on the paper blowing at Shoppers City and on the noise from
the tire shop, and report back a% the next regular Council meeting.

Bids on watermain connection construction for 4Oth Avenue from University
to Central were received from the following:
Northdale Construction Co. @$28,555.00
Dunkley Surfacing @$23,572.00
Arnold R. Kraft @$25,826.40
Motion by Land, seconded by Jeska, that the bids be turned over to the
City Manager for tabulation and report back later in the meeting.

A discussion was held on the garbage collection service contract.
Mayor Nawrocki reviewed the present situation with Modern Clean-up
and stated the city and Modern Clean-up have decided to break the
contract which is not up until December 31, 1969, and call for bids
for a new service to begin sometime in September. The May~r
presented what is being done in Flint, Michigan where the residents
must place plastic bags in their cans. These bags are bought by the
city and distributed to the residents in rolls. One gentiemen
present asked if the city could buy their own trucks and do the
work but this is a very expensive operation and it seems to work
out better if we contract with a hauler. The Mayor stated that
a law was passed by the 1969 Legislature making it illegal to burn
rubbish in back yards. The Council decided to consider the contract
including a provision making the service mandatory to all persons
and a decision made at another time.
Second reading of Ordinance #709 - increasing the penalty for
misdemeanors. Offered by Land, seconded by Logacz. Roll Call -
All Ayes.
A letter was received from Gerry Herringer asking to purchase city
owned property in Apache Heights. This property has been up for
sale two times but no bids received. Mr. Herringer offered $7,000
for the property which is above the appraised value. Ordinance #710
was prepared and a first reading held.

The meeting came to order at 10:03 p.m.
Motion by Jeska, seconded by Logacz, that the Mayor and City Manager
be authorized to enter into an agreement with Cargill as approved
by the City Attorney for construction of a dust emission control
device on the property on 5th Street. Roll Call - All Ayes.
Motion by Jeska, seconded by Land to refer the matter of the lot
subdivision requests from the school district to the City Attorney
and report back at the next regular meeting. Roll Call - All Ayes.
Motion by Land, seconded by Jeska, that the City Manager be authorized
to spend up to $1,000 for concrete curbing at Huset Park picnic
area parking area and spend up to $1,000 for sodding at Memorial
Park. Roll Call - All Ayes.
Motion by Jeska, seconded by Logacz that the requ~t for a license
to operate a beer tavern at 4010 Central Avenue be laid over for
further information. Roll Call - All Ayes.
Motion by Land, seconded by Jeska, that the Building Inspector be
authorized to attend the Annual Conference of Building Officials to
be held September i-5, 1969 in Salt Lake City, Utah, expenses to be
$350.00. Roll Call - All Ayes.
Motion by Jeska, seconded by Logacz, that authorization be granted to
cancel check #5740, a duplicate of check #5629. Roll Call - All Ayes.
A discussion was held in regards to Mr. Lobash's complaints of the
papers blowing from Shoppers City, the noise from the tire shop, and
his yard grade. Mr. Sonnenberg reported he spoke with the Manager
of Shoppers City who will have someone picking up the papers from
the parking lot and neighbors yards daily. The Council members have
all seen Mr. Lobash's yard grade and feel there is nothing wrong with
it and do not feel there is excessive noise from the tire shop area.
A letter will be sent to Mr. Lobash informing him of this discussion.
Motion by Jeska, seconded by Logacz, that permission be granted to
Robert D. Comer & Associates to install a radio antenna on top of
the city water tower and the Mayor and City Manager be authorized to
enter into agreement for same at a rental rate of $10.00 per month,
including a provision that the facility also be used by the City
in emergency situations. Roll Call - All Ayes.
The Jaycees requested permission to furnish beer to participants of
a softball tournament to be held August 16, 1969 in Huset Park. The
City Attorney stated the Jaycees do not need a license as they will
not be selling the beer.
The City Manager reported Dunkley Surfacing was shut down on Thursday
afternoon after the Mayor and he noticed air pollution coming from
their new plant while on an inspection tour of the city. The plant
was shut down until Barbsr-Green could come out and make necessary
repairs but Saturday persons living in the area noticed the plant
was again operating. Complaints were raised about a dust problem
on Grand Street from 38th to 39th where trucks are hauling rocks
and pieces of curbing from 40th Avenue, and the Mayor reported the
junk trucks and debris that was ordered to be removed some time ago
are still standing in the area. The City Manager will contact Dunkley
and get an explanation for this.
The Mayor reported a garbage problem at an apartment building on 40th
and Central Avenue where the cans have not been emptied for some
time and are standing on the side of the building where they can be
seen from the street. The Building Inspector has contacted the
caretaker and owner of the building to get this cleaned up.
Motion by Jeska, seconded by Land, that the bid on 40th Avenue watermain
connection construction be awarded to Dunkley Surfacing in the amount
of $23,572.~00 subject to concurrence with H.U.D. and the Mayor and
City Manager be authorized to enter into agreement for same. Roll
Call - All Ayes.

Motion by Land, seconded by Logacz, that the license applications as
per list attached be granted upon payment of proper fees. Roll

Mayor Nawrocki reported he received correspondence from Senator
Mondale and Cong. MacGregor indicating they would check with federal
agencies to see if any financial assistance is available for work
with Roosevelt, Alabama. Mr. Watson stated we have received no
reply to his letter to the Mayor of Roosevelt of June 26, ]969.
The Planning and Zoning Commission has indicated they would like to
hold a joint meeting with the City Council and Carl Dale, the city
planner, August 19, 1969.
The Mayor read a letter to Chief Glader from the County Attorney's
office congratulating the officers for their fine work in apprehending
two burglars.
