A complaint on dogs running loose came in from a resident of the
Innsbruck area. He was told that B & E Patrol, the city dog catcher,
was aware of the problem and that the owner of the particular dog he
referred to was informed he must keep the dog tied.
A request was received to open an access street west from Arthur south
of 40th Avenue. The owner of this land is planning to build a house
back of Arthur facing south toward a new street. If for no other reason,
the street should be opened for fire protection. Motion by King, second
by Jeska, .that the City Manager be authorized to advertise for a
hearing for all or any part thereof o'f ArthUr Circle to be held
at 8:00 p.m., May 26, !969.. Roll Call - Ail Ayes.
No action will be taken on the conduct in schools ordinance until tke
Council has heard from all. school board members and the American
Federation of Teachers.on this.

A hearing was held to open an access street west from Arthur Street south
of 40th Avenue. The hearing was called after one of the property owners
asked to build a house on the last remaining vacant lot on Arthur Street
and in order to build on this site, it is necessary to have street access.
Many of the property owners who would be effected by this street were
present at the meeting and s~Dngly opposed it. The Council felt it
would be best to make a decision on what most of the residents want
here. Motion by King, second by Land that this project be denied.

Recess at 9:27 p.m.
The meeting was called to order at 9:37 p.m.
Representatives from Northern States Power Company were present to
discuss the lighting improvements on 40th Avenue. They said it is
very expensive to have underground wiring and their feeling is it
would be better for the city to have overhead wiring from the back
of the houses, although N.S.P. will consider our underground proposals
once more.
Bids were received on the city industrial property on 37th Avenue
from the following:
William D. Lucking, Lots 42 and 43, Block 89, Col. Hts. Annex,
$5,000. Lots 44 and 45, Block 89, ~Col. Hts. Annex, $5,Q00.

Motion by Jeska, second by Logacz that the bids be turned over to the
City Manager for tabulation and report back at the next regular meeting
of the City Council in that the proposals be reviewed by the Planning
and Zoning Commission. Roll Call - All Ayes.
No first reading of Ordinance #704, rezoning 4345 Central Avenue.
A request for a lot subdivision and permission to move a house from
3722 Stinson Boulevard to 4441 Jefferson Street was received from
Mr. Bernard Blanske. Motion by King, .second by Land, that the request
to move the house subject to the provision recommended by the Planning
and Zoning Commission that Mr. Blanske post a $500 performance bond to
guarentee completion of the work by August 9, and the lot subdivision
request from the two adjoining properties at 4445 and 4437 Jefferson
for a 4' lot width waiver be granted. Roll Call: Land, King, .Jeska,
Logacz - Ayes. Nawrocki - Nay.
Mr. Melvin Eshelman, 5125 - 6th Street was present requesting a waiver
to place a garage on his lot. He brough~signed agreements from his
neighbors stating they have no objections to the construction.
Motion by Land, second by Jeska that a 1' side yard and 1' back yard
waiver be granted to 5125 - 6th Street to allow the placement of a
garage 2' from the lot line. Roll Call - All Ayes.
Mr. Tom Sullivan was present requesting a special use permit for a
nursing home at 4801 Central Avenue. Motion by King, second by Land,
that the request for a special use permit for a 194 bed nursing home
be granted based on the recommendation of the Planning and Zoning
Commission. Roll Call - All Ayes.

The Planning and Zoning Commission has recommended the appointment of
six or seven persons to serve on a citizens advisory group to work with
the Commission and the Planning Consultant on the goals and policies
of the 701 Plan. They feel it is good to get many people involved in a
project as big as the 701 program. Copies of the Planners report will
be sent to the Council along with maps showing how the city would be
broken down into six "Neighborhoods", each working out their own problems.
A list of persons interested in serving on boards and commissions will
also be sent to the Council so a recommendation can be made as soon as
possible.
Several complaints on dandelions and noxious weeds have come into the
office and the City Manager suggested the Council consider some sort of
regulaHtion to control this problem. He will check with St. Anthony
and Minneapolis to see what they have done.
Motion by Land, second by King that the lot subdivision request for
Lots 16 and 17, Block 2, Silver Lake Addition, be granted. Roll Call -
All Ayes.
Motion by King, second by Land, that authorization be granted for five
members of the Fire Department to attend the Minnesota State Firemen's
Association Conference to be held in Alexandria, Minnesota, June 8-11,
1969, total expenses $295. Roll Call - All Ayes.
A petition was received from the property owners on the 53rd block of
4th Street for the city to blacktop their alley. Motion by King, second
by Land that the City Manager be authorized to advertise for a hearing
for concrete surfacing or blacktop the alley from 52nd to 53rd between
4th Street and University, to be held Tuesday, June 10, 1969 at 8:00 p.m.
Roll Call - All Ayes.
Motion by King, second by Land, .that the special meeting set for Tuesday,
June 10, 1969 at 8:00 p.m. be changed to June 17, 1969 at 8:00 p.m.
Roll Call - All Ayes.
Motion by Jeska, second by Logacz that the City Manager be authorized to
advertise for a hearing to be held June]7 for concrete alley surfacing
in the alley between Quincy and Columbia Junior High School north of 41st
Avenue. Roll Call: Land, King, Nawrocki - Nay. Jeska, Logacz - Aye.
The motion was defeated.
Motion by King, second by Jeska, that the City Manager be authorized to
advertise for a hearing on concrete or blacktop alley surfacing from 5th
to Lookout between 40thl Avenue and Summit Street, to be held Tuesday,
June 17, 1969 at 8:00 p.m. Roll Call - All Ayes.
Motion by King, second by Logacz that the City Manager be authorized to
advertise for a hearing for a new water main on 43rd Avenue 1200' east
of Central to be held at a special meeting June 17, 1969 at 8:00 p.m.
Roll Call - All Ayes.
47.
Motion by Jeska, second by King, that the following people be re-
appointed to the various commissions:
Chet Herringer - Merit Commission
Dr. William Ashford and Dale Jeska - Planning & Zoning Commission
Donald Welch - Recreation Commission
John Rak - Park Board
Mrs. Gilbert Miller and Robert King - Library Board
John Nelson - Traffic Commission
Gloria Chadwick and Jim Durand - Human Rights Commission
Mr. Mel Bauman does not want to be re-appointed to the Human Rights
Commission and therefore the Council will have to make a recommendation
for this opening on the Commission from the list of applicants. Roll Call-
All Ayes.
Motion by King, second by Jeska that the Council concur with the
Mayor's appointment of Kenneth Nygaard to the Police and Fire Civil
Service Commission for a period of three years. Roll Call - All Ayes.
A request was made to re-open the hearing on 41½ Avenue platting.
It was stated 50% of the involved property owners must sign a petition
requesting the hearing before consideration will be given. A letter
will be sent to the person who requested this hearing informing her
of this requirement.
Mr. Lobash was present to ask if something could be done about
Shopper's City auto repair shop, some boxes in the back of the store,
and the parking lot. Apparently the repair shop keeps its doors open
when the men are working and it is very noisy. The parking lot is
always full of trash and paper which blows into the neighbor's yards.
The City Manager said he has written to the manager of Shopper's City
on both these problems and the Building Inspector will make spot
checks of the area. Mr. Lobash also complained about a neighbor
whose spruce tree is growing over his yard. The Attorney explained
the city could do nothing and advised him to take the case to
concilliation court. Mr. Lobash further complained that the clean-up
work including sodding on 44th Avenue was unsatisfactory and required
attention. Mayor Nawrocki-suggested that each Council member view
the premises personally to determine what action might be desirable.
The City Manager reported that he has written to the Highway Department
and the School District ko ask them to mee~ with the COuncil to review
the 49th Avenue footbridge to discuss fencing and a weather shield.
This item will be discussed at the June 9th meeting.

The City Attorney reported that the city has been sued by the
Hazel's after they lost property as a result of a broken water main
and flooding occurred. He reported the legal description was being
made for the John Glover lake property. Mr. Glover brought in some
plans for a 600 unit apartment building. A letter was received from
the attorney for the school district asking to meet with the City Council
of the City of Columbia Heights and the Board of Education to discuss
the property for the proposed new school building.
Jim Hafner of Juran and Moody was present to give the Council some
general background information on the investment and banking firm he
represents.
The City Engineer reported on the meeting with county officials and
prospective bidders for the reconstruction of 40th Avenue.
Resolution was offered by King, ~second by Jeska BE IT HEREBY RESOLVED
BY THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS: WHEREAS, The
County of Anoka has proposed the reconstruction of 40th Avenue N.E.
between University and Central Avenue and has advertised for and opened
bids on Monday, May 26, 1969 to implement this construction and,
WHEREAS, The County Engineer recommends the acceptance of the
proposal of Dunkley Surfacing as low bidder for this construction,
BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights
that the City of Columbia Heights concur this award and will participate
in the cost of said construction according to the agreement so signed
and now on file in the city office with the alternate on street lighting
subject to final determination by the City Council on or before June 9, 1969.

list attached, be approved upon proper payment of fees. Roll Call - All Ayes.
Motion by Jeska, second by King that the license application of Robert
Morris Cook for a solicitor's license to sell candy door to door for
City Junior Sales be denied on the basis that we already have many local
youth groups using this as a method of raising money. Roll Call -
All Ayes.
No action was taken on the license application of Mary Louise McKinnon
to solicit the sale of portraits in homes. More information is needed
as to how this solicitation is going to be handled.
