Award of bid on police cars. Motion by King, second by Land that this bid be awarded to Central Motors in the amount of $6,081.00 for the purchase of 3 Plymouth's. City Manager is authorized to expend $600 to keep the 1967 Ford. Roll Call - All Ayes. Second reading Ordinance ~692, boulevard parking. Offered by Land, Second by Logacz. Roll Call: Land, Logacz - Ayes King, Jeska, and Nawrocki - Nayes. ' Second reading Ordinance ~693 on apartment licensing. Offered by King, seconded by Jeska. R~IX~XXKXK~X~XXK/~M~KXX~ Section 6 - add the following sentence: "An annual fee of $10.00 for the first four units and $2.00 for each additional.unit shall be collected by the building inspector for each .registration required under this Ordinance." King, seconded by Jeska, authorizing execution of grant agreement. WHEREAS, THE CITY OF COLUMBIA HEIGHTS organized and existing under and by virture of the laws of the State of Minnesota (herein called the "Applicant"), has heretofore submitted an application to the United States of America, acting by and through the Secretary of Housing and Urban Development (herein called the "Government"), for a grant under Section 702 of the Housing and Urban Development Act of 1965, for the purposes designated in the said application; and WHEREAS, the Government has approved the said application subject to certain conditions and has submitted to the Applicant a certain Grant Agreement dated as of Januarys. 20, 1969 (herein called the "Grant Agreement"), for approval and execution by the Applicant, which said Grant Agreement is satisfactory, NOW, THEREFORE, BE IT RESOLVED BY THE CITY C©~NCIL ~OF THE CITY OF COLUMBIA HEIGHTS, that the said Grant Agreement, a copy of which is attached hereto, be and the same is hereby approved. The City Manager is hereby authorized and directed to execute the said Grant Agreement in the name and on behalf of the Applicant, in as many counterparts as may be necessary, and the City Manager is hereby authorized and directed to affix or impress the official seal of the Applicant thereon and to attest the same. The proper officer is directed to forward the said executed counterparts of the said Grant Agreement to the Government, together with such other documents evidencing the approval and authorization to execute the same as may be required by the Government. Roll Call - All Ayes. The H.U.D. Grant Agreement was read in conjunction with the Resolution. THIS GRANT AGREEMENT dated as of January 20, 1969 by and betwee~ the City of Columbia Heights, Minnesota (herein called the "Applicant"), and the United States of America, Secretary of Housing and Urban Development (herein called the "Government"): NOW, THEREFORE, THIS AGREEMENT WITNESSETH: That for and in consideration of the mutual, promises hereinafter contained, the parties hereto do convenant and agree as follows: Section 1. ~nount and Purpose. Subject to the Terms and Conditions (Form HUD 41420 dated 5-66) attached hereto and made a part 17. hereof as Attachment A, and the provisions of this Agreement, the Government will make a Grant to the applicant in an amount not to exceed $453,:000 or 50 percent of the Eligible Project Cost as determined by the Government on completion of the Project, whichever is the lesser, in order to aid in financing the Project hereinafter defined, presently estimated to cost $1,014,000. Section 2. Description of the Project. The project shall consist of additions to feeder watermains to serve the developed areas of the City of Columbia Heights, Minnesota (herein called the "Project"). Section 3. Government Field Expense. The amount of the fixed fee for Government Field Expense referred to in Section 33 of the attached Terms and Conditions shall be $3,400, except that such fixed fee will be redetermined if actual Eligible Project Cost after award of construction contract varies by more than 20 percent of the estimated Project cost in Section 1 above. Section 4. Reduction in Grant. The Government shall have the right to reduce the amount of the Grant upon giving the Applicant written notice, if the Eligible Project Cost after award of construction contract is determined by the Government to be less than the estimated cost upon which the stipulated amount of the Grant was based. Section 5. Special Conditions. The Government's obligation to make the Grant is also subject to the Special Conditions attached hereto and made a part hereof as Attachment B. IN WITNESS WHEREOF, THIS Agreement has been executed in the name and on behalf of the City of Columbia Heights, Minnesota by the undersigned official, and under its official seal, attested by its City Clerk and in the name and on behalf of the United States of America, Secretary of Housing and Urban Development, by the undersigned official. ATTACHMENT B, SPECIAL CONDITIONS. The following Special Conditions are made a part of the Grant Agreement for the above-numbered Project: Section 1 - Prior to disbursement of any portion of the grant proceeds, the applicant shall present satisfactory evidence that it has sold and delivered the bonds necessary to provide its share of the entire Project cost, that the proceeds thereof have been deposited in the Construction Account and the same have been applied toward approximately 40% of the total Project cost. Section 2 - Add the following as sub-paragraph (f) to Section 12.. Prerequisite to Disbursements of the Terms and Conditions: (f) A contract has been executed for the construction of the proposed 54" storm outlet sewer at 5th Street N.E. and 37th Avenue N.E. Section 3. - Section 27. Equal Employment Opportunity of the Terms and Conditions relating to contracts subject to Executive Order No. 11246 is hereby changed to require the Applicant to substitute in any contract for construction or modification thereof executed after October 13, 1968, the words "race, color, .religion, sex, or national origin" wherever the words "race, creed, color, or national origin" are now required to be used. Section 4. - Applicant shall be responsible for assuring in accordance with such rules or procedures as may be prescribed by the Government, that to the maximum extent practicable there are provided in connection with the construction of this Project new job opportunities for the unemployed and underemployed. In carrying out this responsibility Applicant shall include or cause to be included in all contracts for construction work in connection with the Project, a p~ovision stating that the contractor (1) shall, to the maximum extent practicable, follow hiring and employment practices which will assure that performance of Project work results in new job opportunities for the unemployed and underemployed, and (2) shall insert or cause to be inserted the same'or a similar provision in each corstruction sub-contract. 18. Motion by Land, seconded by King that request be granted for Police Chief Glader to attend t~lice Chief's Institute March 17 - 19 Roll Call - All Ayes. ' Motion by King, Seconded by Land that request be granted for John Larson to attend annual Assessor's School March 4 - 7. Roll Call - All Ayes. Motion by King, Seconded by Land that request be granted for attendance at Municipal Clerks and Finance Officers Conference March 11-12 Roll Call - All Ayes. ' The City Manager reported hiring Mr. Corwine to set up wading pool plans and specifications. Motion by King, seconded by Land that request be granted for three employees to attend Safety School, March 7, 1969. Roll Call - All Ayes. Motion by King, seconded by Land that petition opposing operation of Dunkley Surfacing by placed on file. Roll Call - All Ayes. Motion by King, seconded by Logacz that the Council go on record as to opposition of Rock Crusher. Roll Call - All Ayes. City Manager reported on hiring of an Engineer at $750/mo with a $30 - $40 pay raise in three months. Moiion by King, seconded by Land authorizing Mayor and City Manager to enter into a contract with Metro-Phone for use of antenna space on water tower at $500/year effective April 1, 1969. Roll Call - All Ayes. Motion by Jeska, seconded by King that a contract be negotiated with Bell Telephone Company for use of antenna space on water tower. Roll Call - All Ayes. Motion by Land, seconded by King that we concur to settle the Kriesel- Bernard case. Roll Call - All Ayes. Motion by King, seconded by Land that the License applications as per list attached, be approved upon payment of the proper fees. Roll K Call - All Ayes. A Metropolitan Section of the League of Minnesota [~unicipalities meeting will be held March 5 in Richfield. The Anoka County League of Municipalities will meet Saturday in the County Commissioners Office and the monthly meeting will ban Fridley. Motion by Jeska, seconded by King that the Council favor H.F. #60 re: fair trade laws and the City Manager be authorized to so inform appropriate members of the legislature. Roll Call All Ayes.
