The City Attorney reported as to the State Law on ~nicipal Bonding.
He Also reported on the McWilliams court case and this will be gone' over by
the City Engineer, City Manager and City Attorney and they will make their
recommendations.
The City Engineer reported he would like to hold hearings on the storm
sewer in area from University to Quincy Street, between 37th and 41st
Avenues, including a description of what is planned to be done.
Motion by Jeska seconded by King, that the City Manager be authorized
to advertise a hearing on the 5th Street Storm Sewer Project, to be held
January 22, 1968. -Roll .Call - A~i Ayes.
The City Engineer recommended tree trimming on the following streets:
4th Street between 40th and 41st; 5th, 6th, 7th, Washington, Jefferson,
Madison, Monroe and Quincy Streets between 40th and 44th.
The council asked t~at the engineer present a report on streets recom-
mended for tree trimming and estimated costs.
Motion by Land seconded by King, that Christmas Tree licenses be granted
to Newcomb Bros. for lots at 4000 ~~~e~e and on the Zayre Lot,
upon payment of the proper fees and 850.00 deposit on each lot. Roll
Call - Ail Ayes.

Special Meeting November 28,. 1967
Meeting called to order at 8:00 P.M. in the council chambers. Roll call:-
Jeska, Logacz and Nawrocki - present. Land and King - absent.
This special council meetingis ,held for the purpose of considering the
assessing of projects which have been completed this year. Sixteen
people were in attendance at the meeting to ask questions and comment
on the projects. Mrs. Betty Johnson was named secretary for this meeting.
The hearings were 'held on the following assessments with comments as
noted herein: ,
'~575 - Curb & Gutter - University Avenue 37 - 53. The property owner
at 230 40th Ave. N.E. requested reconsideration on his property
because theist service drive south from 40th was primarily'-for the
service of the property owner south of,his lot. The Council directed
the City Manager to withhold[ the curb assessment on the west side ser-
vice road from the assessment list. Assess 3 years. ~
~579 - Water Main - University Ave. 40 - 44~. ~Mr. Stanowski, 4321
University Ave, requested some consideration since he had
installed a private line just prior to decision to hold a hearing for
a water main extension in front of his property. The case was reviewed
and the councilmen present indicated that some consideration might be
justifiable and therefore recommended a 25% discount on the balance of
his assessment. This would be a reduction of 25% of $295.00, or $73.75
leaving a balance payable of $221.25. Assess 8 years.
%596 - Blacktop alley, Madison - Monroe 48 - 49. One property owner
appeared and questioned the stability of the shallow surfacing
and it was explained that the expenditure only allowed a stabilized
base with a sealed surface which should give reasonably good service
with some maintenance. Assess 3 years.
%616 - Delinquent Utility Bills
Assess 1 year.
%602 - 18 A.11ey Pavings. The property owner at 4456 3rd St. informed
the Council that his garage had been undermined during the alley
backfilling and he had installed a concrete block retaining wall to
support the garage. This garage was closer to the alley then the re-
quired set back distance which accounted for part of the problem. The
property owner at 4500 Jefferson questioned the concrete thickness in
his alley and was assured that the volumes delivered and the measure-
ments taken on the job indicated just over a 6" average thickness. He
also mentioned that the alignment of the curb apron and the alley did
not match and the Council requested an investigation of the circumstances
with a letter to the property owner. At this point a property owner at
3842 Main St. commented on a low spot in Main St. near his home and asked
about future plans on reconstructing 3800 Ave. west from Main St.

%604 - Asphalt mat, 48th Ave. - University - 7th. Assess 5 years.
%605 - Curb & Gutter - 48th Ave. University - 4th, 6th - 7th

%607 - Asphalt Mat, Leander Lane, Royce to 44th. Assess 3 years.
%608 - Blacktop Alley, Van Buren - Central, 40th - 41st. A letter was
received from Mr. Ray Nyberg, owner of property along Central
Ave. on the north end of the alley. Mr. Nyberg expressed dissatisfaction
with the alley construction and indicated that a drainage was improper
and did not flow north as it formerly had done. Mr. Nyberg's renter at
the dairy store also complained of the grades and indicated that the
alley was lower than the 41st Ave. sidewalk. The City Engineer stated
that grades had been checked on this alley after construction and the
grade would carry water northward but some uneven sections in the alley
caused hollows where water stands after a rainfall. The City COuncil
agreed to have a leveling course of fine mix blacktop placed through the
area where the unevenness exists early next summer when proper materials
are available and weather conditions proper. The Street Foreman verified
the existance of bad base materials which had to be excavated out of the
alley before proceeding with the blacktopping. Assess 3 years.
%609 - Concrete Alley, Van Buren - Central, South of 42nd Ave.
Assess 8 years.
%610 - Concrete Alley 3rd to University, 37th - 38th.
Assess 8 years.
~611 - Watermain, West side of Central, 51st - 53rd. A discussion was -held regarding'the-assessable.frontage on this project and the
benefited properties. Since the water line had been extended westward
on 53rd'to serve, additional frontage on Lot One; the Council'determined
that this~frontage whould be included in_the_assessmentJ
Assess 10 years.
~612 - Seal Coat at 12 Locations. Mr. KloncZ, ~711 2nd St. indicated
that he had' appeared at a hearing in 1966 at which time the pro-
ject was turned down and he had been unaware of the hearing in July
when~he project was considered for this'year. Mr.~ jankowski, 3755 2½
Street, appeared and indicated that he understood this hearing was to
decide whether or not the future seal coat project would be carried out.
Assess 1 year.
Motion by Jeska~ seconded by Logacz that the curb assessment On ~he west
service drive of Unlverslty Avenue south of 40th hearing be adjourned to
December 11 at the regular council meeting and withheld from this assess-
ment resolution. All Ayes'
Motion by Jeska,. seconded'by Logacz to reduce the water main special
assessment.of Mr. Stanowski, 4321 University Avenue, by 25% of the
balance of his assessment which is 25% of $295.00 or $73.75, making
his assessment total $221.25. · All Ayes.
Motion by Jeska, seconded by LogacZ,~ that the front'footage assessment
for Lot ! in assessment ~6!1 water main 'sh&t1 be 595 feet instead~of
395 to include the frontage served on 53rd Ave. west from Central.
All Ayes.
RESOLUTION offered by Jeska, seconded by~Logacz~ ad~pting the asSessment
rolls.for the. following local improvements and determining that said im-
provements have been made and ratifying and confirming all o~her proceed-
ings, heretofore had: Special assessment numbers 575, 579, 596, 602, 604,
605, 607, 608, 609, 610, 6~1, 612, and 616.
WHEREAS, 'the City. Council of the City. of Columbia Heights, Minnesota, met
on the 28thdaYof November, 1967, at the City Ha~l Council Chambers,
being ,the time and 'place set when and where all. persons interested could
appear and be heard by the Council with respect to benefits, and to %he
propOrtion ~f the'cost of making the local improvements above described,
a notice of such hearing having been heretofore duly published as required
by law, and a notice mailed to each property'owner of record stating the
proposed amount of the assessment; and, ~
WHEREAS, this council has heretofore estimated and fixed'the cost of
s~ch local improvements and'has prepared an assessment roll'~herefore.
THE CITY COUNCIL OF. THE CITY OF .COLUMBIA HEIGHTS HEREBY RESOLVES:
~Section 1. That this council..does hereby adopt the aforesaidassess-
ment rolls known and described as "Assessment Rol!~ for Local Improve-
ments numbered 575, 579, 596, 602,.604, 605, 607, 608, 609, 610, 611,
612 and 616."
Section 2.~ That this council hereby finds and determines that each
of the lots and parcels of land enumerated in said assessment rolls was
and is especially benefitted by such improvement in an amount'not less
than the amount set opposite~in the~column headed "Total amount of lien

against each tract of land." And this council further finds and deter-
m~nes that the proper proportion of the cost of such improvement to be
especially' assessed against such lot or parcel of land is the amount set
,opposite the description of each such lot or parcel of land respectively
in said assessment rolls in said column headed "Total amount of lien
against each tract of land."
Section 3. That said assessments may be paid in part or in full without
interest on or before December 29, 1967 or in annual installments for a
period of from one to ten years as designated on each assessment roll,
payable on or before the 30th day of September, annually, with 6% interest
thereon. Failuke to pay the annual installment renders the same delinquent
and thereafter a 1~ penalty is added and the said delinquent special assess-
ment is certified to the County for Collection with the Real Estate Tax.
Section 4. That this council did hereby determine and re-determine to
proceed with said improvements, does ratify and confirm all other proceed-
ings heretofore had in that regard, and said improvement shall hereafter
be~ known and numbered as "local improvements numbered 575, 579, 596, 602,
604, 605, 607, 6~08, 609, 610, 611, 612 and' 616."
Section 5. This resolution shall take effect .immediately upon its passage.

Under new business, Mr. Jankowski asked about the condition of 37th Ave.
frc~ Central Avenue rto university; in particular, the railroad c~ossing
west of ~th St. The Mayor explained that this was a State Aid road and
was tentatively scheduled for construction' in 1972 about midway through
the i2 year schedule. The Engineer and Street Foreman both indicated that
the Soo Line would be asked to cooperate in repairing the crossings on
37th Avenue.
Mayor Nawrocki announced that at 8:00 P.M., Wednesday evening, November 29,
the League of Anoka County,Municipalities would be meeting at the Fridley
City Hall.
