Sub. of Walton's S.Ao 3rd to R-~General Residential. , The council asked that this property be. checked into and enforce the requirements of the commercial operatioo on this property~ Resolution offered by Land seconded by ~rendorff, ~.W~EREAS, the City of Columbia Heights, Minnesota-is authorized by law to exercise responsi- bilities for the preservatf~n of open-space land within ~ts'boundaries through acquisition by gift, gTant, devise purchase, or condemnation of lands which have value for park and recreation purposes; and WHEREAS, a comprehensive plan is now being p~epared by ~he~ Planning Commission, fhr 'the physical growth an~ development of' the territoYy wit in the boundaries of the seven-county Twin Cities Metropolitan Area., which plan is being made with the general p~rpose of guiding and co- ordinating 'the orderly growth and development of ~he Area; and ~REAS, the parties of t~is Agreement ~re .fully cognizant of the 'n~ed and urgency of expediting the acquisition of open-space land in'order 't,3 meet the ~ecreation needs of a rapidly expanding population, in accordance with orderly and cooperative plans and ~roqedures, and recognize that · Title VII of the United States Housing Act,of 1961 and the land and'water Conservation Act of 1965 are valid methods of encouragin~ and assisting Public-Bodies in the acquisition of additional open-space land; NOW THEREFORE, the Planning Commission and the Public Body agrees as follows: 1. The Public Body will prepare long-range recreation and open-space plans for their respective jurisdiction, in cooperation with the Planning Commission. On completion such plans will be certified as to conformance with the comprehensive plan now be%ng completed by the Commis9ion2 2. The Public Body, in acquiring additional open-space land within its respective jurisdiction will do so in accordance with its official open-space plans. 3. The Public Body will use its best efforts to implement its official open-space plans with or ~ithout the use of grants under the Federal Open-space Land Program. ,4~ Where grants are received un~er the Federal Open-space land Program, the Public Body will provide the local funds as needed and will use their best efforts -to increase their open-space land programs in propor- tion to any such grants received. 5O2 5. Prior to the acquisiton of Open-space lan~Qr prior to the filing ~f~ '~'.~ an application for a federal grant under Title VII of the Housing Act of 1961, each Public Body shall submit an open-space land acquisition pro~ra~ to the Planning Commission for review as to conformance with the compre- hensive Rlan now being completed under,the Joint Program for Land-Use Transportation Planning. Each public body shall be guided by the reviews~ plans and policies of the Planning Commission. 6. Nothing contained herein is intended to require a Public Body to take any action which is not authorized to take, or to refrain from any action which it is required to take, pursuant~to the federal, state, or local law under which such public Body is created or under which it exercises respon- sibilities for the acquisition and preservation of open-space land. 7. This Agreement shall take effect upon execution by all Parties mentioned in the Preamble. Thereafter, additional Public Bodies may, from time to time execute this Agreement and such execution subsequent to the date of this Agreement shall not be deemed to require its re-execution by any Party which had theretofore executed the same. This Agreement shall allow parties not satisfied with the performance of s~me to wSthdraw upon sixty days written notice to the other signatories. Rol~ Call - All Ayes. l! First reading of Ordinance No.627, Being an ordinance providing for the sale of certain properties to the City of Minneapolis. ~ Recess called at 9:30 p.m. Meeting called to order at 9:48 p.m. Motion by King seconded by Orendorff, that the bid of Dr. Phillip A. Brandeen for Lots 3 and 4, Block 2, Apache Heights, be accepted at~a cost of 812,000.00 including payment of special assessments outstanding at this time, and tha~ the ~xx~ City Manager be authorized to draw up an ordinance for the sale of this property. Roll Call - All Ayes. First reading of Ordinance No.628, Authorizing the sale of Lots 3 and 4, Block 2, Apache Heights, to Dr. P.A. Brandeen. A report was presented to the Council as to the previous actions taken on the Urspringer property on 37th Avenue. F~. Urspringer was present and discussed with the cDuncil his present request for lot size waiver. Motion by Land Seconded by King~ that the lot size waiver request of Mr. Urspringer be denied. Roll Call - All Ayes. Mr. Urspringer was told that if he could come up with plans that ~ould meet the Council's approval, his waiver request could be taken up again. A group of home owners from the area north of Highland Lake were present regarding the overflow pond lying behind their homes, which was causing a drainage problem. ~. Nordquist, spokesman for the'group suggested that we dontact~ the State Department of Conservation for recommendations ~or improving this 'area, and also contact the City of Fridley. The City Manager ~as asked to write a letter to the State Department of Conservation and report back to the council. J! The approval for ~he Police Chief to attend the Minnesota Leag.ue ckf Munic. Convention at Rochester, was included in the motion of May 23rd. The City Manager was asked to check i~to the request of Leland R.Entner, 4350 Quincy St., for the return of a 15 foot strip of land on the back of his property, and report back to the city council. 5O 3 ~4otion by King seconded by Orendofff, that the Mayor and City ~ianager be authorized to enter into a contract with the George M. Hansen Co. for a consulting service for the balance of the year. Roll Call - All Ayes. Motion by Land seconded by King., that the City Manager be authorized to spend up to $950. for earth moving in Memorial Park, as per Park Dept. request. Roll Call - All Ayes. Motion by Orendorff seconded by King, that the City Manager be authorized to advertise for bids ob Towing, Gasoline and Diesel Fuel for the ensuing year, to be opened June 27, 1966. Roll Call -All Ayes. Motion by Land seconded by King, that the City Manager be authorized to cancel all outstanding checks issued prior to January 1, 1965. Roll Call - All Ayes. Motion by King seconded by Orendorff, that Mrs. Gilbert Miller be re- appointed to the Library Board for a period of 3 years. Roll Call-All Ayes. The Mayor reported his re-appointment of Kenneth Nygaard to the Fire and Police Civil Service Commission. No action was taken on installation of walk-way from Pierce Circle to alley S.E. of Polk Street. Request for Special Use Permit to operate a Mobile Home Sales lot at 5200 Central Avenue. i~otion by Land seconded by King, that this Special Use Permit be granted with the stipulation that Si~ty days be allowed, during which time the sales lot must be graveled, and that asphalt pads be installed under each '~railer, and that if these requirements are not met the permit will expire Roll Call -~All Ayes. Letter received from the Kiwanis Club requesting a waiver of fees for candy and gum vending machines for their club. .Motion by King seconded by Land, that this request be granted. Jacobson and others representing student Employment, were present regarding their solicitors permit application, to place addresses on curbs or steps in Columbia Heights, and using students 14 to 16 years old for this ~ork. Motion by Orendorff seconded by King, that this request be granted and that all employees be cleared by the Police Department, and that certifi- cate of Insurance be provided. Roll Call - All Ayes. Motion by King seconded by Land, that the bid on Bituminous street and alley paving, be awarded to Alexander Constr. Co. at a total cost'of $18,901.40, and unit cost of 86.44 per tone in place. Motion by Land seconded by King, that the bid on Concrete Street and alley improvements be awarded to Concrete Specialties in the total amount of 836,856.55, Project No. 6602. Roll Call - All Ayes. ~he City ~ngineer reported he would have a recommendation ready for the next meeting on street improvements on 42nd, 43rd and Gould Avenues The City Attorney reported on the following items: Rothman property at 504 Summit in court last Wednesday and she was given 60 days to t~ce all material out of basement and remove structure and if she does not do this, the city can go in and remove same. Other court actions and condemnations, and also reported on Silver Lake Beach. Dilapidated house at 4655 Johnson St. - the following Resolution was passed: WHEREAS, Stanton N. and Virginia Lee Opdahl; husband and wife, are the owners of certain buildings located at 4655 Johnson St.N.E., Columbia Heights, Minnesot~a, on the below legally described property, and WPiEREAS, a certain building is located on the front part of the~lo't a~djacent to johnson St.N.E., and WHEREAS,~ th-at building is best described as a block and wood structure, and WHEREAS, after the receipt of numerous complaints, the Council of ~the City of Columbia Heights ordered an inspection to be made of the above described premises, which described premises was found to be inadequately maintained, dilapidated, physically damaged, abandoned and in a state of disrepair and constitutes a h~zard to the public, safety and health and that does violate e'xisting ordinances of the City of Columbia Height~,aNd WHEREAS, the Council of the City of Columbia Heights finds that the above dewcribed building is inadequately maintained; that the building is dil- apidated; that the building is physically damaged; that the building is abandoned; and that the building does constitute a hazard to the public safety and health; and that it does not conform to the building code. of the City of Columbia Heights. NOW THEREFORE., BE IT RESOLVED .that Stanton N. and Virginia Lee Opdahl husband and %~ife, sha~l be ordered to raise and remove that building on tke property legally described as: The East Ninety-Four (94) feet of the North One Hundred Thirty- Five and Thirty 'one-hundredths .(135.90) feet of Lot One (1), Block One (1), Sheffield's Subdivision. This action is taken pursuant to Minnesota Statutes Annotated 463.15 to ~63.26 on the grounds that the said building is a hazardous building within the meaning of that statute. Roll Call - All Ayes. Circle drainage problem was discussed and the City Engineer was asked to see that something is done on this. ~ ~ MOtion by Land Seconded by King, that the Council favors the proposed Change within the League of Minnesota Municipalities, which is being proposed in the State Constitution at the convention this year, setting up a Metropolitan Section to deal with certain things without going ~hrough the normal committee.
