The judge upheld that this fee is reasonable for the first year of operation of the machines, but a different licensing code should exist for the second and following years of operation. The second case to appear in district court was that involving the Zayre fire. The judge did not feel that the City of Columbia Heights had been "arbitrary or capricious", as the suing insurance companies had charged, and the charge was dismissed for lack of evidence to support such claim. It has been determined that the Zayre building shall be demolished. Motion by King, seconded by Land that the license applications as listed~3~ be approved upon payment of the proper fees. Calvary Covenant church understood when they bought a thirty foot parcel from the City that they were to provide off- street parking. Their long-range plan is to purchase additional property which will be used for parking facilities and use their old church building as an educational unit, rather than demolishing the old church building and using that area for parking. The old church site is now being rented temporarily ratherthan standing vacant.
