King ~ Motion by Orendorff seconded by Jeska, that the license applications for 1965' and 1966 as per attached list, be approved upon payment o~f the proper fees. Roll Call - All Ayes. Motion by Orendorff seconded by Jeska, 'that the license application of Louis Wille, 4801 University Ave. for 1965 Christmas Tree license, be approved upon payment of the proper fee. Roll Call - All Ayes. ~Motion by Jeska seconded by Orendorff, that the Pawn Shop license application of A.J. Reynolds, 828 - 40th Avenue N.E., be denied. Roll Call - All Ayes. The City Attorney reported we would be in court Tuesday, December 21st, .regarding the Zayre fire. The insurance companies involved are suing the City of Columbia Heights indicating that we have been arbitrary and cg~cious in ordering the d. emolishing of the burned building. ..Also a court case is scheduled for Wednesday, December 22nd, ~ Distributing Co. vs City of Columbia Heights regarding vending maclhine licenses. Roll Call: King, Nawrocki - Present Jeska - Absent Orendorff, Land The first item of business was the appointment of a secretary protem during Mrs. Pritchard's absence. Motion by Land, seconded by King that bps. Marie MacNally be appointed secretary protem for this meeting. Roll Call - All Ayes. Invocation offered by Reverend Douglas Henderson of the People's Church. Motion by Land, seconded by Orendorff that the minutes of the last regular and special meetings be approved as presented in writing and that the reading of same be dispensed with. Paulson, 932 Minnissippi Street N. E., in the amount of 83,450.00 per year. Motion by King, seconded by Land that the bid of Albert W. Paulson for dog catching services be accepted and that the mayor and city manager be authorized to enter into a contract with him. Roll Call - All Ayes. The only bid received for LegalPublication for 1966 was from Tri- County Publications. Motion by Orendorff, seconded by King that ~The Record" be awarded the bid for Legal Publication for 1966 in accordance with the State Statutes, Roll Call - All Ayes. 443 Bids on Radio Equipment were received from: Motorola Communications and Electronics, Inc. - 7515 Wayzata Blvd. Minneapolis 26, Minnesota. General Communications, Inc. (G. E.) - 5800 Excelsior Blvd. Minneapolis 16, Minnesota Hallicrafters T. W. Communications - 9601 South Garfield Avenue Minneapolis 20, Minnesota Motion by King, seconded by Land that these bids be turned over to the city manager for tabulation and that the award of the bid should be made at the next Council meeting. Roll Call - All Ayes. The next item to come before the Council was the reading of a resolution on re-districting voting precincts. Resolution offered by Land, seconded by King WHEREAS, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the following precinct boundaries and polling places be established in the City of Columbia Heights; to wit: Precinct ~1: That area bounded by University Avenue on the East; 37th Avenue on the South; the corporate limits of Columbia Heights on the West; and 45th Avenue on the North. The polling place shall be Oakwood Ele~mentary SchOol. Precinct ~2: That area bounded by Central Avenue on the East; 37th Avenue on the South; University Avenue on the West; and 41st Avenue on the North. The polling place shall be the Columbia Heights Fieldhouse. Precinct 93: That area bounded by Washington Street on the West; 41st Avenue on the South; Central Avenue on the East; and 46th Avenue and the south boundary of Hilltop Village on the North. The polling place shall be at Columbia Junior High School. ~recinct ~4: That area bounded by the corporate limits of Columbia Heights on the East and South; Central Avenue on the West; and 40th Avenue on the North. The polling place shall be at Silver Lake Elementary School. Precinct 95: That area bounded by the corporate limits of Columbia Heights on the East and North; McLeod Street to Reservoir Blvd., Reservoir Blvd. to 43rd Avenue, 43rd Avenue from Reservoir Blvd. t~ Stinson Blvd. on the South; and McLeod Street to 45th Avenue, 45th Avenue from McLeod Street to the west boundary of the Minneapolis Reservoir property, the west boundary of Hilltop 3rd Unit, and the west boundary of Innsbruck to Matterhorn Drive. The polling place shall be Columbia Heights Senior High S~hool. Precinct ~6: That area bounded by the corporate limits of Columbia Heights on the East; 40th Avenue on the South; 45th Aven~e, Central Avenue to McLeod Street, McLeod Street from 45th to Reservoir Blvd., Reservoir Blvd. to 43rd Avenue, and 43rd Avenue from Reservoir Blvd. to Stinson Blvd. on the North; and Central Avenue on the West. The polling place shall be Silver Lake Elementary School. Precinct ~7: That area bounded by the east boundary of Mathaire and Lot 1, Block 1, Innsbruck 3rd Addition, and the west boundary of the Minneapolis Water Reservoir on the East; 45th Avenue on the South; and the corporate limits of Columbia Heights on the North; and Central Avenue on the West. The polling place shall be at Columbia Heights Senior High School. Precinct ~8: That area bounded by Washington Street on the East; 41st Avenue on the' South; 46th Avenue on the North; and University Avenue on the West. The polling place shall be Oakwood Elementary School. Precinct ~9: That area bounded by 7th Street on the East; 46th Avenue on the South; and the corporate limits of Columbia Heights on the North and the 444 West. The polling place shall be Nelson Elementary School. Precinct ~10: That area bounded by Central Avenue to the corporate limits of Hilltop Village on 49th Avenue and on Monroe Street to 46th Avenue on the East; 46th Avenue on the South; 53rd Avenue or the corporate limits of Columbia Heights on the North; and 7th Street on the West. The polling place shall be Nelson Elementary School. BE IT FURTHER RE - SOLVED that the foregoing boundaries and polling places be esta~li--shed for all elections after January 1, 1966. Roll Call - Orendorff, Land, and King -- Ayes. Nawrocki - Naye. Mr. Nawrocki gave his reason for voting no on the new precinct lines to be as follows: "I recognize the need for increased facilities at the polls to handle voting more expedient- ly. Additional judges at the polls wall help. The proposed plan, while it corrects some existing problems, creates new problems for others by placing them further from the polls." First Reading of Ordinance ~614, regarding licensing of Bottle Clubs. Mr. Nawrocki stated that the intention would be to hold a formal, general hearing on this ordinance on January 10, 1966 at the regular meeting when it would receive its second reading. Motion by King, seconded by Land that Mayor Nawrocki be re-appointed as delegate and Mr. Warren Armstrong be re-appointed as alternate delegate to the Suburban Rate Authority. Roll Call - All Ayes. Motion by Land, seconded by King that the City Manager be authorized to call for bids on the Vertical Retaining Wall at Jackson Pond. These bids would be opened January 10, 1966. Roll Call - All Ayes. Motion by King, seconded by Orendorff that the first tier of parking spaces on the Municipal lot adjacent to the alley north of 40th Avenue (behind Chet's Shoe Store) be posted for 2 Hour Parking. Roll Call - All Ayes. Motion by King, seconded by Land that the request for the renewal of the Bingo permit for the V.F.W. Hall ~230 be granted for 1966. Roll Call - All Ayes. In his report, the City manager reported the possibility of a potential claim along 44th Avenue for damages to a home from jarring of ground and excavating. This has been referred to the contractor who carries the insurance on these 3obs. Mr. Watson declared the need for a meeting later in the week to complete year end work. Motion by King, seconded by Orendorff to set a special meeting of the City Council on Wednesday, December 29, 1965, at 9:00 P.M. to finish up end of the year business. Roll Call - All Ayes. A brief discussion was held on gumball ~achine licensing in the City of Columbia Heights, and Mr. Sokolowski suggested that interested parties appear at the January 10, 1966, meeting. The City Attorney reported on two court cases which were of importance to the City of Columbia Heights. On Wednesday, the Paks vs. the City of Columbia Heights case was brought before district court re- garding the licensing fee of 85.00 for each first vending machine 445 (washers and dryers) in apartment buildings, and 8100 for every machine thereafter. The judge upheld that this fee is reasonable for the first year of operation of-the machines, but a different licensing code should exist for the second and following years of operation. The second case to appear in district court was that involving the Zayre fire. The judge did not feel that the City of Columbia Heights had been "arbitrary or capricious~, as the suing insurance companies had charged, and the charge was dismissed for lack of evidence to support such claim.
