King, Land, Nawrocki, Invocation offered by Reverend Douglas Henderson of the Peoples Church. Motion by Nawrocki seconded by Orendorff, that the minutes of the last special and regular meetings be accepted as presented, with the exception of of the June 8th special meeting to include Armstrong as being absent, and Nawrocki arriving at 7:45 p.m., and that the reading be dispensed with. Roll Call - All Ayes. Only one bid was received on towing contract. Motion by Nawrocki seconded by Land, that this bid be returned to the bidder and that we re-advertise for bids to be opened at the next regular meeting, June 28th, and information be given regarding the proposed Ordin- ance in regard to junk cars. Roll Call - All Ayes. Motion by Nawrocki seconded by Orendorff, that the bids received on a wading pool for Mathaire Park be returned unopened, and that we re-advertise for bids to be opened at the June 28th meeting. Roll Call - All Ayes. Two bids were received and the Park Consultant recommended that we re-advertise. Hearing held on Curb, Gutter and Blacktop surfacing on 46th Avenue from Johnson St. eastward 135 feet. An estimated cost of $7.00 per foot for street charge and $2.33 Avenue charge was given for these improvements~ The problem of proper drainage ~ack pf the property on Johnson St. was discussed and the engineer was asked to get a letter from Minneapolis regarding this drainage, to see if something could be worked out. Motion by Nawrocki seconded by Land, that the City Manager be authorized to proceed with the Curb, Gutter and Blacktop Surfacing on 46th Avenue east of Johnson 135 feet. Roll Call - All Ayes. Motion by Nawrocki seconded by Orendorff, that the City Manager be authorized to advertise a hearing to be held July 12th, 1965, for a storm sewer line in the rear of the property facing Johnson St,,North of 46th Avenue, and East of Johnson St. Roll Call,- All Ayes. Hearing held on concrete paving in lieu of Blacktop in alley between University and 4th St. from 51 to 52. Motion by Nawrocki seconded by Orendorff, that this request for concrete paving be granted, in lieu of Blacktop. Roll Call - All Ayes. Continued hearing held on Industrial Park Development. Drawings were projected on the wall with the opaque projector showing what was proposed for this area, which contains 10.7 acres. An estimated cost of $1300. per acre was given with a total cost of $13,900, for storm drain installation, with engineering costs to be added. Motion by Land seconded by Orendorff, that the City Manager be authorized to proceed with the installation of storm sewer North of 37th Avenue, Midway between Madison Place and Quincy Street. Roll Call - All Ayes. Second reading of Ordinance No.602. An Ordinance providing for the issuance of $900,000 of Bonds for improvement of The City Water Utility. Offered by Nawrocki seconded by Orendorff. Roll Call - All Ayes. Resolution offered by Land seconded by Orendorff, BE IT RESOLVED by the City Council of the City of Columbia Heights, In view of MSA 475.53, Subdivision 1, which in part provides that no Municipality shall incur or be subject to a net debt in excess of 20% of the assessed value, and In view of MSA 475.753 which in part states that all municipalities are subject to the provisions of Minnesota Statutes Chapter 475 in the issu- ance of obligations, and may incur indebtedness to the extent of, but not in excess of, the debt limit in said chapter notwithstanding any home 373 rule charter provision or charter law adopted prior to April 1, 1951. Nothing herein shall prevent the adoption after that date of additional debt limitations or restrictions. And, in view that the charter of the City of Columbia Heights was adopted on June 9, 1921, and limits the indebtedness to 10% of the assessed valuation, It is the intention of the City Council of the City of Columbia Heights to utilize the State Laws amending the limit of the City of Columbia Heights to 20% of the assessed valuation. Roll Call - All Ayes. First reading of Ordinance No.604, Being an ordinance providing for the issuance of $915,000 of Bonds for creating and maintaining the City's Storm sewer fund. First reading of Ordinance No.605, Rezoning Lots 14 and 15, Block 9, Columbia Heights Annex to C-2 General Commercial. Petition received for alley surfacing between 2~ and 3rd, from 38th to Edgemoor. Motion by Nawrocki seconded by Land, that the City Manager be authorized to advertise a hearing to be held June 28th, for either concrete or blacktop paving in this alley. Roll Call - All Ayes. Petition received for concrete alley paving between 2nd and Main St., from 39 to 40. Motion by Land seconded by Nawrocki, that the City Manager be authorized to advertise a hearing to be held June 28th for this alley paving. Roll Call - All Ayes. Petition received to re-consider the platting of Cleveland Street North of 43rd Avenue. Motion by Land seconded by Orendorff, that this petition be referred to the Planning and ~oning Commission meeting to be held July 6, 1965. Roll Call - All Ayes. Subdivision request received from Ray Nelson, 2336 45th Avenue. Motion by Orendorff seconded by Land, that this request be tabled until the next meeting. Roll Call - All Ayes. Request for Private Sewer and Water to serve 4110 M~in Street in Fridley. Motion by Land seconded by Nawrocki, that this request be granted upon payment of the proper fees. Roll Call - All Ayes. The City Manager reported regarding the letter received from Hartford Ins. Co. in answer to his inquiry as to the status of the claims which had been turned over to them. Request received for storm sewer installation to serve Lots 1,2,27,28, 29,30, Block 11, Mathaire Addn. Motion by Orendorff seconded by Land, that the City Manager be authorized to advertise a hearing to be held on June 28th, for this storm drain. Roll Call - All Ayes. Motion by Land seconded by Orendorff, that the City Manager be authorized to call for bids to be opened July 26, 1965, on the city owned lots in Block 2, Apache Heights. Roll Call - All Ayes. 374 The City Attorney reported on Firemen's Relief legislation which was passed and presented the following Resolution: ~esolution offered by Orendorff seconded by Land, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, that pursuant to M.S.A. 6~5.021 Laws, 1965, Chapter 605, is hereby approved by the City Council of the City of Columbia Heights. Roll Call - All Ayes. Motion by Land seconded by Orendorff, that the City Manager be authorized to advertise for bids to be opened at the July 26th meeting, on Block 2, Apache Heights. Roll Call - All Ayes. Motion by Orendorff seconded by Land, that the City Manager be authorized to advertise a hearing to be held July 1271965, on sidewalk replacement as needed in the following areas: Central Avenue, 37th to 45th. VanBuren-Washington; 41st to 43rd. Roll Call - All Ayes. Quincy, Jackson,VanBuren; 39th to 40th. Motion by Orendorff seconded by Land, that the City Manager be authorized to pay to Andrew Birosh and Anna Birosh, and D.D. Wozniak, their attorney, the sum of $750.00 for a full and complete release, whether it be for loss of access or lateral support, or any other damage the City may have caused in the construction of 43½ Avenue, and also for an easement over and across that portion of the easterly fifty feet of Lot 32, Block 2, Reservoir Hills, being used for street purposes. Roll Call-All Ayes. Motion by Land seconded by Orendorff, that the license applications as per list attached, be granted upon payment of the proper fees. Roll Call - All Ayes. The City Engineer reported regarding the installation of the Sullivan Lake outfall, which it is hoped will be installed this year.
