Motion by Nawrocki, seconded by King, that the minutes of the previous regular meeting be approved as presented in writing and the reading be' dispensed with. Roll Call - All Ayes. Motion by King,~ seconded by Land that these bids be turned over to the City Manager for tabulation and award made at the next regular meeting. Roll Call - All Ayes. Prom a motion by King, s~conded by Land, the award on a Trailer Mounted Brush Chipper was made to Hall Equipment, Inc. for a Wayne 16 inch Chipper in the amount of $4,313.00. Roll Call - All-Ayes. A hearing was held-on ~lley surfacing between ~6th and 7th, from 52nd to 53rd. It was noted that the majority of the petitioners elected concrete which City Engineer Brown estimated would cost approximately $4.00 per assessable foot. There was also discussion on'the falling away of em- bankments. Motion~by Kin~, seconded by Nawrocki, that this alley hearing be continued until the October 26th meeting to permit the Engineering Department to make an-alignment stUdy and any additional work necessary regarding embankments with cards to be sent to the adjacent property owners. '~ Roll Call -Ai~ Ayes. ~ The hearing on the storm drain to serve Lots 14, 15 and 16, Block 2, Sheffields Subdivision was postponed by a motion from Nawrocki, seconded by King, until the next regular meeting, since the property owners in- volved were not present. Cards will be sent. It was estimated the cost would be $900C for the entire job. Roll Call - All Ayes. Regarding the continued hearing on reconstruction of Reservoir Blvd., 44th to 45th~ the City Attorney reported that the agreement with Minneapolis regarding~the-right-of-way had b~en reviewed and that ~in this agreement Minneapolis was not required to participate in cost of construction but that Minneapolis would be liable for repair of damage due to abnormal use. Decision was to use existing bricks as base and the City Attorney to in- stigate--an agreement with Minneapolis Water Works regarding future payment of any abnormal road damage due to their trucks using this portion. Motion by King, seconded by Land, that the City Manager be authorized to proceed with construction in next year's construction program. Roll Call - All Ayes The City Attorney reported on the findings of Dr. Harold Paulus, Associ- ate Professor, Environmental Health, University of Minnesota, relative to the Dunkley Blacktop Company investigation. Dr. Paulus reported that he felt it could be proven that the plant is in violation of Ordinance 545 because of excessive soiling in the neighborhood if not from the stack emission. After considerable discussion by Council and spectators, motion by Nawrocki, seconded by King, that the City Attorney be instructed to advise Dunkley Company that they are in violation of the Ordinance by reason of emission of dust from the separating operation and a complaint will be issued unless Dunkley presents to the City Council of the City of Columbia Heights by the 13th of October plans which are designed to control the emission of such dust and to bring it within the standards of Ordinance 545. Roll Call - All Ayes. Comments also were made by the people in the neighborhood relative to dust flying off Dunkley's trucks and the suggestion that they be covered with tarps or canvas. Motion by Nawrocki, seconded by King that the Park Superintendent be authorized to purchase baseball backstop, amounting to $606.00, for McKenna Park. Roll Call - All Ayes. Appointment to Fire and Police Civil Service Commission was deferred. There were no late requests. City Manager reported a Traffic Commission Meeting Monday, October 5, at which time the request for a parking space in front of the Rocket Pizza Restaurant will be considered. A better RESOLUTION offered by King, seconded by Orendorff, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that the Northwestern Bell Telephone Company, a corporation be and the same is hereby granted a license to install upon land owned by the City of Columbia Heights cer- tain structures and apparatus as shown in Exhibit A of the Corporate Undertaking, dated the 23rd day of September, 1964, and executed for and on behalf of the said Corporation by its General Attorney Garfield E. Lovaas, upon the following conditions: 1. That the said Corporation save, protect, and hold harmless the said City, from any and all claims for damages directly or indirectly arising out of the construction, maintainance and use of the premises described in E×hi~Dit A. 2. That the said corporation shall reimburse the said City for any additional expense it may incurred which are attributable to said telephone plant. 3. That the said Corporation will remove the said plant upon receipt of six months notice in writing. 4. Upon removal, the corporation will restore the premises to the same condition as it was prior to the in- stallation of said plant by the Corporation. Roll Call - All Ayes. Roll Call - All Ayes. Motion by Orendorff, seconded by Land, that the next regular Council Meeting be set for October 13, Tuesday, since Monday, October 12, is a holiday ~ Columbus Day. The City Manager requested permission to enroll in a public Administration Seminar at the University.in lieu of attending the Anti, at City Managers' Convention in-Chicago. -This will be discussed later. ~. St. Anthony's acceptance of a proposal regarding storm.drainage on Stinson Blvd~ will be'covered at a later~meeting.~ The City Attorney was requested to check the voting statutes regarding the legality of a voter's registration booth at Zayre's to be manned by the League of Women-Voters.
