Hearing held on street opening and utilities in Rand Addition. Motion by ¼~awrocki seconded by ~ing, that this hearing be continued until the August 14th coundil meeting, and that the engineer be in- structed to bring some cost estimates and plan proposals, whidh wo~ld- i~el~de'serving adjoining properties. Roll Call - All Ayes. Hearing held on base work for Lincoln Street north of 37th Avenue. Motion by I~[ing seconded by Nawrocki, that the City i4anager be authorized to proceed with installation Df base work on Lincoln Street north of 37th Avenue. Roll Call - Ail Ayes. Hearing held for curb, gntter and Blacktop on 46~ Avenue between jefferson and Monroe. Motion by Nawrocki, seconded by Orendorff, that the City ~nager be authorized to proceed with these improvements in the 1962 constructiDn season. Roll Call - All Ayes. Hearing held on Sanitary Sewer installation on University, east side, 700 feet north of 40th Avenue. ~. Ratner who owns Lot 5 and part of Lot 4 was present and stated he is against this sewer being extended to his property as he has no use fDr it. The party living at 4039 University Avenue was informed that possibly he could connect to 4th Street by using a sump pump. Motion by King seconded by Orendorff, that this hearing be continued to the August 14th meeting. Roll Call - All Ayes. Hearing held on Storm Sewer for Stinson Blvd. from 37th to 39th Avenues. A description of the problems involved was given and no final action taken at this ti~e. 'i%~o representatives from Apache Plaza were present and explained their position on the matter and agreed to attend future ~]eeting. They agreed to present more ~znzo_ma'czon and .d~?w~ings regarding parking, e-kc. before re-a~plying for a Special Use Permit. Motion .by King seconded by Orendorff, that the Special Use P, ermit-~fee~ be refunded to Js/~es Kiycheff for 4040 Central Avenue, Ro' lt. Call-~ll ~yes. A letter was received from the Park Board. requesting a special meeting with the Mayor and Council to discuss the Bond Issue. Resolution offered by Nawrocki seconded by Orendorff, Relating to the under issuance of permits the provisions of Minnesota Laws of 1961, Chapter 735 (Minnesota Statutes, Section 340.14, Subd. 3). ~IqEP~AS, ~4innesota Laws of 1961, Chapter .735, confers upon the State. ~iquor Control Commissioner the authority to grant or deny permits for the operation of establishments commonly known as ~bottle clubs~, and such statutes also appears to grant to the Liquor contzol. Commissioner the power to e_uher grant or deny permits for the practice known as ~.spiking~ in public places where int&xicating liquor is not W~R~AS, munzcmpalz~_es in the state, of ~nnesota traditionally ha~e been vested with the power to license and regulate the sale of intoxicating liquor,~ and its cons~motion in pUD_lC places, and WHEREAS, the regulations of -the various municipalities throughout the State of ~nnesota vary from place to place, depending upon the needs and traditions of the community and the wishes of the inhabitants thereof, and WHEREAS, the granting of a permit for a ~bottle blub~ or ~spiking" estab- lishment, without prior consultation with local municipal officials, would create the danger of (a) violating establish~d~liquor-regulation patterns and policies in the community, (b) violating the wishes of the inhabitants of the community, (c) violating local regulations or policies on such matters as planning, zoning, plumbing, sanitation, traffic control and related matter: (d) imposing an unanticipated and inordinate policing and law-enforcement problem on the community, and (e) otherwise adversely affecting the accomplisl ment of legitimate objectives of the local c~mmunity; N~'~ THEREFORE, be it resolved by the City Council of the city of Colu/~]bia Heights, as follows: 1. This council urgently requests that the State Liquor Control Commissioner consult the local governing body of this community before taking final action upon any application for any permit which would be used within this community under the provisions of ~,~nnesota Laws of 1961, Chapter 735, and that he give the local governing body a reasonable length of time to make an investigation and to express to him its views on the question of whether such permit should be granted or denied. 2. The State Liquor Control Commissioner is hereby urged to give the greatest possible consideration to the wishes of the local governing body with reference to any such application, so as to avoid any of the diff- iculties, relating to the welfare of this community, of the type herein- before mentioned. 3. The City Clerk is hereby authorized and directed to forward certified copies of this resolution to the State Liquor Control Commissioner of the State of ~nnesota and to the Governor of the State of ~.~nnesota. Motion by King seconded by Nawrocki, that Stewart F.Kvalheim be named fiscal agent for the City of Columbia Heights for advertising for bids X~~u~ on Bonds to be opened August 14, 1961. Roll Call-All Ayes. The City Manager reported an appraisal had been received on Lots 12 & 13, Block 2, Sheffield's Addition (45~ Avenue East of Fillmore). Motion by orendorff seconded Nawrocki, that the City l~nager be authorized to pay up to $1~00.00 for the Southerly 30' of Lot 12 and the Northerly 30' of Lot 13,Block 2, Sheffield's Subdivision, less assessments. Roll Call - All Ayes. Motion by ~ing seconded by ~,~awrocki, that the City~l.,~nager be authorized to send out cards to all water users in Columbia Heights, regarding the sprinkling ban. Secretary to City Council I'iAYOR'~ / OFFICIAL PROCEEDINGS Special ~ieeting August 3, 1961 Meeting called to order at 5:15 p.m. Roll Call: Armstrong, Orendorff, Nawrocki - present. ~4cCline and King - absent. The ~yor and Village Council of St. Anthony were present, and also their Village engineer and Attorney, for the purpose of discussing storm sewer installation and surfacing of Stinson Blvd., 37th to Silver Lane. Affected land owners were also present. The cost of catch basins and storm sewer on Stinson Dlvd. was discussed, also cost of land acquisition for ponding area, dredging, etc. It was agreed to reach a written agreement before this work is started. Recess called at 9:25 p.m. l~leeting called to order at 9:40 p.m. Various plans for the storm sewer were discussed and an estimate of cost was reached by the engineering departments, of approximately $60,000.00, which would cover the cost of land acquisition, grading and installation of mains, of which,by area, St. Anthony Village would be responsible for approximately 20 or 25%. Based on this estimate the following motion was made: Motion by Orendorff seconded by Nawrocki, that the hearing on drainage question on Stinson Blvd. be continued until such time as we have a report back from St. Anthony Village as to their decision on the plan.
