Walter's Disposal Serv. 2930 Wall Road Motion by McCline seconded by King, that these bids be turned over to the City Manager for tabulation and to be awarded at a special council meeting Thursday, December 15th at 7 p.m. Roll Call - All Ayes. Hearing held on Blacktop alley between Madison and Monroe from 40th to 41st. The City Engineer recommended concrete paving in this alley on account of the grade. Motion by King seconded by McCline, that this hearing be continued until the council meeting on January 9th, and that the people so effected be notified. Roll Call - Ail Ayes. The Planning & Zoning Commission referred the request for a permit to build an ll-unit apartment at 228-40th Avenue, to the City Council. Julian Johnson is no longer interested in this property and therefore if anyone else is interested it will have to be brought up again. Mr. Marcotte, 4656 Monroe St.N.E. has asked that his request to sub-divide Lot 9, Sheffield Acres into three building sites be brought before the City Council. The Council recommended sub-dividing this property into three lots facing 47th Avenue and re-submit this to the Planning & Zoning Commission. Resolution offered by Orendorff seconded by ~fing, WHEREAS, there have been negotiations between the Minneapolis Gas Company and communities served by the suburban division of the Minneapolis Gas Company over an extended period of time, resulting in the drafting of a proposed n~w uniform franchise ordinance for communities served by the suburban division of the Minneapolis Gas Company, and WHEREAS, after a thorough analysis of the provisions of such proposed franchise ordinance, a firm of rate consultants acting on behalf of such commuDities has recommended that such franchise ordinance be adopted, and ~EREAS, after having examined and analyzed the provisions of the said franchise ordinance, it is the considered judgment of this Council that the enac-~ment of said franchise ordinance will be beneficial to this municipality and in the best interests of consumers of gas in this municipality, and it appears to this Council that said franchise ordinance should be enacted, and ~K{EREAS, it is necessary that the Legislature of the State of Minnesota enact enabling legislation to insure that said franchise ordinance may be validly enacted by this municipality, and ~4EREAS, agreement has also been reached on the provisions of a bill which, if enacted, would provide the necessary enabling legislation; NOW T~EREFOP~, BE iT RESOLVED by the City Council of the City of Columbia Heights, as follows: 1. It is hereby declared to-be the intention of this Council to adopt the aforementioned franchise ordinance immediately after, and providing that, the Legislature of the State of Minnesota enacts enabling-legislation authorizing and empowering this municipality to enact such franchise' ordinance. 2. This Council herewith urges the enactment by the Legislature of the State of Minnesota of appropriate enabling legislation which will-permit this municipality to adopt the aforementioned uniform franchise ordinance,. so as to act in concert with other municipalities in the regulation of the rates and practices of the ~inne~Dolis Gas Company, such enabling legi- slation to be in substantially the form of the legislative bill which accompanies the aforementioned franchise ordinance. First reading Ordinanc~e No.505, Being an Ordinance vacating the'North- South Alley east of 5th Street and the North-South section of ~th Street N.E., lying between 39th Avenue and Mill Street N.E. First reading of Ordinance No.505, Being an ordinance amending Ordinance No.377, being an ordinance'establishing a Fire Prevention Code for the City of Columbia Heights. First reading of.Ordinance No.507, Being an Ordinance relating to the govern- ing of transportation of buildings of any nature or type over the streets and highways of the City of Columbia Heights. Resolution offered by McCline seconded by King, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, that WHEREAS, it has become apparent that the City of Minneapolis intends to propose legislative action to allow the levying of a gross earnings tax on persons employed within the City of Minneapolis, and WI~EP~AS, such legislation would affect a large number of Citizens in our City to essentially constitute taxation without representation, and WI~EREAS, this City Council as representatives of these Citizens of Columbia Heights, do hereby unequivocally oppose such a tax burden being imposed upon our Citizens and hereby go on record to express such opposition. It was reported by those attsnding the public hearing held by the Minnesota Department of Highways on December 12th, that there was no indication that they would not proceed~with improvements on University Ave. from St. Anthony Blvd. to the north limits of Spring Lake Park, next year. A letter was received from John P. Murzyn, Park Superintendent, requesting purchase of a tractor with loader at $750.00. This piece of equipment being on display in Police Dept. garage. Recess called at 9:28 p.m. to ex~L]ine this tractor. Meeting called to order at 9:40 p.m. Motion by King seconded by Chies, that the Park Department be authorized to spend up to $750.00 for this FrDnt End Loader and Scraper. Roll Call - All Ayes. The City Manager reported regarding the watermain replacement in the alley between Tyler and Polk from 37th to 4Otb. This 4 inch line had been laid in 1917 and was replaced with a 10 inch line. The assessment clerk was present and costs were explained. Several residents from that area were present and stated they did not want the alley blacktopped between Tyler and Polk from 39th to 40th, until some of the present assessments were paid up. An appraisal report was received ~n Lots 11,12,13, Block 9, Hilltop 1st Addition, which adjoins out water tower property and could be used for an underground tank. These lots consist of approximately 35,000 sq. ft. Motion by McCline seconded by King, that the City Manager be authorized to negotiate for the purchase of these lots in an amount up to $4200.00. Roll Call - All Ayes. The City Engineer reported George E. Hopkins, Engineer for Innsbruck had filed a correction in length of lot line between Lots 20 and 21, Block 2, Innsbruck 3rd Addition. Charles Dugan and Mr. Erling Hanson, represent- atives of Super Valu, were present at the meeting and discussed with the Council plans for the shopping center west of Central between 43rd and 44th, including plans for parking east of Central for employees and overflow parking. Motion by King seconded by McCline, that the principle as set forth in letter addressed to the City Attorney dated December 9, 1960, from Reinhardt, General Director of Development for Super Value, is accepted with the following changes: That paragraph No.2 be changed to read 'that the re-~ocation of ponding area be assessed over a ten year period with interest at 69; that all else contained 'therein be accepted in principle, the plan as set forth in Drawing ~353 of Super Value dated September 12, 1960. Secretary to City Council OFFICIAL PROCEEDINGS Special Meeting December 15, 196(3 Meeting called to order at 7:00 p.m. Roll Call: Armstrong, King, McCline, Orendorff - present. Chies - absent. The first order of business is awarding of bid on garbage pickup for 1961 and 1962.
