Awarding of bid on Project No.5900 as per attached Bid Tabulation.
Motion by King seconded by Proft, that Bids A thru F be awarded to
Bianconi Construction Co. in the amount of ~150,098.46. Roll Call -
Ail Ayes.
A Hearing was held on street opening on Cleveland Street between
40th and 41st.
Motion by Chies seconded by King, that the City Manager be authorized
to proceed with this street opening. Roll Call - All Ayes.
A Hearing was held on Blacktop for Tyler Street between 46th and 47th.
Motion by King seconded by Chies, that the City Manager be authorized
to proceed with this street upon the recommendations of the Engineer.

A Hearing was held on Concrete alley installation between 7th and
Washington from 42 to 43. Home owners were present protesting this
installation.
Motion by King seconded by Chies, that this hearing be continued until
the next meeting, May llth. Roll Call - Ail Ayes.
A Hearing was held on Blacktop alley between 6th and 7th Streets from
41st to 42nd.
Motion by Proft seconded by King, that the City Manager be authorized
to proceed with this project. Roll Call - All Ayes.
A Hearing was held on Blacktop Alley b~tween Monroe &'Quincy Streets
orQ44~h to-45th.

because of storm sewer installation in this alley, in the n~ar future.

Motion by F~ng seconded by Proft, that the engineer be authorized to
proceed with plans for a storm sewer in alley between Monroe & Quincy,
from 44 to 45, and referred to R.D. Thomas & Associates. Roll Call -
All Ayes.
Continued hearing on utility extensions on Tyler St. & Arthur Place
north of 44th Avenue. The Engineer proposes a 35' right-of-way
on Arthur Place by taking 5' from the west side of street, and ask
for easements to run the water line down the back line of Tyler St.
to serve all the lots on Tyler St. & Arthur Place.
Motion by Proft seconded by F~ng, authorizing the watermain con-
struction from the now existing line on Tyler Street, east to the
lot line midway between Tyler St. and Arthur Place, then north to
the existing line on 45th Avenue, and sanitary sewer from the now
existing line on Tyler St. to serve all lots on Tyler Street. Roll

Hearing held on Project $365 Assessment roll for sanitary sewer on
Arthur Street north of 42nd Avenue
Resolution offered by Proft seconded by King, Adopting assessment Tolls
for the following local improvements and determining that said improve-
ments be made and ratifying and confirming all other proceedings, here-
tofore had: Project ~365.
WHEREAS, the City Council of Columbia Heights, Minnesota, met on the
27th day of April, 1959, at the City Office in said City, being the
time andplace set when and where all persons interested could appear
and be heard by the Council with respect to benefits, and to the pro-
portion of the cost of making the local improvements above described,
a notice of such hearing been heretofore duly published as required
by law; and,

of such local improvements and has prepared ah assessment roll -therefore.

Motion by Chies seconded by King, that this request be granted upon

A request was received from Arvid E. Carlson & Son,Inc. to extend the
existing watermain on 3rd Street to service 4213 3rd St. which would be
approximately 115' in length and installed under the supervision of the
City Engineer.
Motion by King seconded by Chies, that this request be granted. Roll

A Petition was received for sanitary sewer on Arthur Street between
39th and 41st.
Motion by King seconded by Proft, that a Hearing be held May llth on
this improvement. Ro. call - All Ayes.

Motion by Chies seconded by Proft, that this permit be granted to move
house only. provided it is stuccoed and kept as close to ground as

A request was received from John Chies, for private sewer extension
to serve the 11 unit apartment building at 940 - 39th Avenue.
Motion by King seconded by Proft, that this request be granted upon
payment of the proper fee. Roll Call - King, Julkowski, Proft.

Motion by King seconded by Chies, that the list of Election judges as
submitted by the City Clerk, be approved. Roll Call - Ail Ayes
It was announced that this was the time and place for opening and con-
sider&~on of bids for the purchase of $550,000 Permanent Improvement
Revolving Fund Bonds and 8150,000 Municipal Building Bonds of the City
advertised for sale pursuant to prior resolutions mol the City Council.
It was determined that all of the persons who desired to bid on either of
said bond issues had delivered their sealed bids to the City Manager.
The City Manager reported that the notices of sale for said bond
issues had been duly published as required by law, in the official news-
paper and in Commercial West.
The City Manager then presented the sealed bids which had been received
for the bonds, which were thereupon publicly open~d, tabulated, and found to
be as follows:

The net interest costs on the issues according to the foregoing bids were
then computed and announced.
After consideration of the bids by the Cpuncilmen, Cguncilman King
presented and read the following resolution and moved its adoption:

Minnesota, that the bid of E.J. Prescott & Company, of the City of
Minneapolis, Minnesota, and associates names therein, to purchase $550,000
Permanent Improvement Revolving Fund Bonds of the City to be dated~as of
June 1, 1959, and to be issued in accordance with the notic~ calling for
bids thereon, is hereby found and determined to be the hid'most favorable
to the City received pursuant to due advertisement therefor, and should be and
is hereby accepted, said bi'd being to 'purchase the bonds at a price of par
plus accrued interest plus a premium of $ None for bonds bearing interest as
follows:

and delivery of the bonds, and the good faith checks of other bidders
shall be forthwith returned to them.

Councilman King introduced the following resolution and moved its
adoption, which proposed resolution was thereupon read:
A RESOLUTION FIXING THE FORM AND DETAILS OF
8550,000 PERMANENT IMPROVEMENT REVOLVING FUND BONDS,
DIRECTING THEIR EXECUTIONAND DELIVERY, ~AND

BE IT RESOLVED by the City Council of the City of Columbia Heights,
Minnesota, as follows:
1. The City of Columbia Heights shall forthwith issue and deliver its
negotiable coupon PERMANENT Improvement Revolving Fund Bonds in the
aggregate principal amount of $550,000, dated as of June 1, 1959, said
bonds to be 550 in number, numbered 1 through 550, each in denomination
of $1000, and to mature serially in the amount of $55,000 on June 1 in
each of the years 1960 through 1969, all without option of prior payment.
Said bonds shall bear interest payable December 1, 1959, and semi-annually
thereafter on each June 1 and December 1, at the'following rates:

This bond is one of an issue in the total principal ~mount of
8550,000, all of like date and tenor except as to serial numbers,
maturity'dates, and interest rate, all issued by said City for the
purpose of providing funds for improvements of a lasting character,
including installation of paving, curbs, gutters, storm sewers, street
openings and acquisitions, and water line and sewer line extensions and
a trunk sanitary sewer, and as authorized by an ordinance duly adopted
by 4/5 vote of the Council and pursuant to and in full conformity with
the Constitution and Laws of the State of Minnesota and the Home Rule
Charter of said City thereunto enabling.
IT IS HEREBY CERTIFIED AND RECITED that all acts, conditions, and
things requiredby the Constitution and Laws of the State of Minnesota and
the Home Rule Charter of said City to be done, to happen, to exist, and to
be performed precedent to and in the issuance of this bond, in order to
make it the valid and binding general obligation of said City according
to its terms, have been done, have happened, do exist, and have been
performed in regular and due form, time, and manner as required bY law;
that, prior to the issuance of this bond, a direct, annual ad valorem
tax has been duly levied upon all of the taxable property in the City
for the years and in amounts as required by law, and additional taxes,
if needed for payment of said principal and interest, will be levied
upon all of said property without limitation as to rate or amount; and that
the issuance of this bond did not cause the indebtedness of the City to
exceed any constitutional, statutory, or charter limitation.
IN WITNESS W~EREOF the City of Columbia Heights, Minnesota, by its
Council,has caused this bond to be executed in its behalf by the signature
of the Mayor, attested by the City Manager, and its corporate seal to be
hereto affixed, and has caused the attached interest coupons to be
executed and authrnticated by facsimiles of the signatures of said
officers, all as of June 1, 1959.

3. Said bonds shall be forthwith prepared for execution under the
direction of the City Manager and attorneys, and shall thereupon be
executed ~n behalf of the City of the signature of the Mayor, attested by
the City Manager, and sealed with the official corporate seal; and the
interest coupons shall be executed and authenticated by printed facsimiles
of the signatures of said officers. When the bonds have been so executed,
the City Treasurer shall deliver them, or cause them to be delivered, to
the purchasers upon receipt of the purchase price herdtofore agreed upon,
and the purchaser shall not be obligated to see to the application of such
purchase price.
4. The full faith and credit of the City and its unlimited taxing powers art
hereby irrevocably pledged to the prompt and full payment of the principal
of and interest on each and all of said bonds as such ~rincipal and interest
become due. In compliance with Minnesota Statues, and in order to provide
moneys for payment of the principal of and interest on bonds, there
shall be and is hereby levied upon all of the taxable properties in the
City a direct, annual ad valorem tax to be spread upon the tax rolls
and collected with and as-part of other general City taxes.in the,
years 1959 through 1967 (collectable in the respective next ensuing,yea~

Said levies shall be irrepealable until the full. principal and interest
on all of the bonds of said issue have been paid; provided that, when and
if other moneys are available or shall .be available in the special sinking
fund to pay the principal and interest of the bonds, the City Manager
shall certify such amount to ~the County Auditor of Anoka County on or
before October 15 in any year, and thereupon the amount to be extended
upon .the' next ensuing tax rolls for said bonds shall.be reduced ~accordingly.
5. There. is hereby c~eated a separate ':Sinking Fund Account for $550,000
Permanent Improvement Revolving Fund~ Bonds~' in the general sinking fund
of the City, into which shall,be paid the proceeds of .the .foregoing ,
levies and any accrued interest and premium received upon the delivery
of the bonds, and such other moneys as may from time to time be directed
to be used for payment of said bonds, including proceeds of collections
of all special, assessments levied for the improvements for which the
proceeds of said bonds are used to pay. Out of said account sh~ll be
paid the interest on and principal of this issue as such principal and
interest become due. Said account shall be used for no other purpose
until all of s~d bonds have been paid, save and except that, if any
payment of principal or interest shall become due on any of said bonds
when moneys in the sinking fund account are insufficient therefore,
such payments shall be made by .advances out of any other funds of the
City, and such funds-may be reimbursed out-of said account when moneys
are available therein.
6. The Secretary of the Council is diracted to cause a copy of .this
resolution, certified by the Secretary, to be filed in the office of the
County,,Auditor of Anoka ~ounty, Minnesota, and .to obtain from such Auditor
the certifieate required by law respecting the filing~ thereof and enty
of the bonds on his register.
7. The County officers of Anoka County and the officers of the City are
authorized and directed to furnish to the purchasers of said bonds, and
to the attorneys approving legality thereof, certified copies of all
proceedings and records of the City relating to the bonds and to the
financial a~fa~s of the City, and such other certificates or affidavits
as may be. required to show the facts as to the power and authority of
the .City to' issue said bonds, as shown by the books and records under their
custody and control or as otherwise known to such officers; and such
certified copies, certificates, and affidavits, including any heretofore
furnished, shall be deemed representatives of the City as to the truth
of the facts purported to be shown thereby.
8. This resolute-on shall be published in the official newspaper ~ithin
15 days after its passage, and shall take effect 30 days after its
passage, unless suspended by a referendum petition, and upon so taking
effect shall operate to ratify, confirm and validate any and all actions
of the City Officers thereto fore taken which are herein authorized to
be done.

its adoption, which proposed resolution was thereupon read:

BE IT RESOLVED by the City Council of the City of Columbia Heights,
Minnesota, as follows:
1. The City of Columbia Heights shall forthwith issue and deliver its
negotiable coupon Municipal Building Bonds, in the aggregate principal
amount of $150,000, dated as of June 1, 1959, said bonds being 150 in
number, numbered 1 through 150, each in denomination of 81000, and to
mature serially in the amount of $10,000 on December 1 in each of the
years 1961 through 1975, all without option of prior payment. Said
bonds shall bear interest payable JUne 1, 1960, and semiannually there-
after on each December 1 and June 1, at the following rates:

3. Said bonds shall be forthwith prepared for execution uhder the
direction of the City Manager and attorneys, and shall thereupon be
executed in behalf of the City by the signature of the Mayor, attested by the
City Manager, and sealed with the official corporate seal~ and the interest
coupons shall be executed and authenticated by printed facsimiles of the
signature of said officers. When the bonds have been so executed, the
City Treasurer shall deliver them, or cause them to be delivered, to the
purchasers upon receipt of the purchase price heretofore agreed upon,
and the purchaser shall not be obligated to see to the application of
such purchase price.
4. The full faith and credit of the City and its unlimited taxing powers
are hereby irrevocably pledged to the prompt and full payment of ,the
principal of and interest on each and all of said bonds as such principal
and interest become due. In compliance with Minnesota Statutes, and in
order to provide moneys for payment of the principal of and intereSt on
the bonds, there shall be and is hereby levied upon' all of the taxable
properties in the City a direct, annual ad valorem tax to be spread upon

said levies shall be irrepealable until the full principal and interest
on all of the bon~s of said issue have been paid~ provided that, when
and if other moneys are available or shall be available in the special
sinking fund to pay the principal and interest of the bonds, the City
Manager shall certify such amount to the County Auditor of Anoka County
on or before October 15 in any year, and thereupon the amount to be
extended upon the next ensuing tax rolls for said bonds shall be reduced
accordingly.
