Motion by Chies seconded by King, that Richards Oil Co. be awarded the bid on picked up and delivered Asphaltic material for 1959. Roll Call - All Ayes. Motion by Julkowski seconded by Proft, that Jay W. Craig Co. be awarded the bid on distributed asphaltic material for 1959. Roll Call - All Ayes. Bids on Road Aggregate were received as per attached tabulated list: Motion by Julkowski seconded by King, that Chies Bros. be awarded the bid on Class 5 delivered, for ~.Call - All Ayes. Motion by King seconded by Chies, that Hartse be awarded the bid on Sanding Sand and Class 4 delivered, for 1~ Call - All AyFs2. Motion by Chies seconded by Julkowski, that Arsenal sand & Gravel Co. be awarded the. bid on BA-2 delivered for 1959. Roll Call - All AyFsz. Motion by Proft seconded by King, that Anderson Aggregate be awarded the bid on Class 5, Sanding Sand and BA-2, Picked Up, for 1959. Roll Call - All Ayes. Motion by Chies seconded by Julkowski, that Craig J. Alexander be awarded the bid on 81ass 4, picked up, for 1959. Roll Call - Ail Ayes. Bids on Equipment rental were received as per attached tabulated list. The City Engineer was instructed to inform each bidder as to number of pieces of equipment on which he was low bidder. This equipment will be called in as needed during the 1959 construction season. A Hearing was held on Sewer and Water for 3rd Street from 42nd to 44th. Motion by Julkowski seconded by King, to continue this hearing until o~r next regular council meeting, March 23rd, and in the meantime the City Engineer will check into this further. Roll Call - All Ayes A Hearing was held on Curb Assessment for 43rd Avenue West of McLeod. A petition was received from residents on 43rd Avenue protesting the cost of this assessment. WHEREAS, the City Council-6f-Col~mbia Heights, b~nnes°ta, met on the 9th day of March, 1959, at the City Office in said City, being the time and place set when and where all persons interested could appear and be heard by the Council with respect to benefits, and to the pro- portion of the cost of making the local improvemen~ above described, a notice of such he&ring been heretofore duly published as r~quireduby law; and 9UHEREAS, this Council has heretofore estimated and fixed the cost of such local improvements and has prepared an assessment roll therefore. Roll Call - Ayes: King, Julkowski, Proft, Stopka. Nayes: Chies. Mr. Chies stated he voted No as he was of the opinion that-the 27¢ for street work should be included in this assessment. Motion by King seconded by Julkowski, that the petition received from residents on 43rd Avenue West of McLeod, be placed on file. Roll Call -' All Ayes. A hearing was held on alley opening between 6th and 7th Streets from 4~'~h to 48th. MOtion by King Seconded by Chies, that the City Manager be authorized to proceed with this alley opening. Roll Call - All Ayes. Resolution offered by Chies seconded by King, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, that the City Treasurer be and she is hereby instructed to transfer from the Liquor fund as follows: 875.91 to the Fire Fund 1,545.97 to the Park Fund ~ 2,639.37 to the Street Fund ' 836.56 to the Library Fund and that there are sufficient moneys in said liquor fund to make such transfers. Roll Call - All Ayes. Resolution offered by Proft seconded by Julkowski, BE IT HEREBY RE- SOLVED by the City Council of the City of Columbia Heights,-that '48th Avenue N.E. from Jefferson' to Madison Streets N.E., and Jeffersgn and I~ladison Streets N.E. from 48th to 49th Avenues N.E., be improved as follows: Right-of-way Roadway Pavement Base Curb & Gutter Storm Sewer Street Signs Sewer & Water 60 feet 30 foot minimum 4 inch stabilized, per Columbia Heights Specifications Concrete, per C.H. ~ Per Columbia Heights plans and specifications as necessary. Standard, all. Per C.H. Plans & Specifications' BE IT FURTHER RESOLVED, that the costs of said improvements shall be paid by the developer on a one year assessment b~sis. Completion date for said work shall be August 1, 1960, weather and other natural hazards permitting. Roll Call - All Ayes. Recess called at 9:20 p.m. Meeting called to order at 9:30 p.m. The City Manager asked for authorization to send personnel to attend League schools at the University of Minnesota as follows: Police Chiefs - March 19 - 21 Newly Elected Mayors-Councilmen - March 24 Mayors-Councilmen - March 24 - 25 City Managers - March 24 - 25 Finance Officers - March 24 - 25 Public Works - March 24 - 25 Building Inspectors - March 25 - 26 Motion by Julkowski seconded by King, that this request be granted. Roll Call - All Ayes. The City Manager reported the following action taken at the Planning & Zoning Commission meeting: Motion by Robinson, seconded by King, that the Special Use Permit for Collins Trucking operations, be denied. Roll Call - Ayes: Robinson, King, Spencer, Brown. Nayes: Rau. Kvalheim abstained from voting. ~r. Kvalheim reported he had not received a report from the Attorney General as yet. Resolution offered by Julkowski seconded by Chies, BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights, that a Special Use Permit be granted to Everett Collins to conduct a trucking operation and trucking terminal ,on the following described lands and premises,to-wit: S½ of Lot 2, lying westerly of University Ave.,Rearrangement of Block Easterly portion of Lots 13 and 14, being a tract 168.65' as measured on northerly line of Lot 14 and 233' as measured on southerly line of Lot 13, Rearrangement of Block 'E'. Under the following terms and conditions: (a) That said permit is granted for a period of three (3) years from the date hereof. (b) That the existing building upon said premises be painted forthwith; and that the cupola be removed forthwith. (c) That the said Everett Collins release the easement of which he is now possessed to 3rd Street, save and except the easterly 20 feet thereof. (d) That the land and premises above described be immediately dleaned and kept in orderly condition during the duration of the special use permit herein. (e) That the said Everett Collins inm]ediately take the necessary steps to provide sanitary facilities to said premises. The installation of satisfactory sanitary facilities be completed by June 1, 1959 and that the installation meet all codes covering such installation. (f) That the above described premises be fenced in its entirety, · he type and nature of fencing to be used to meet with the requirements of the City Engineer of the City of Columbia Heights. (G) No operation shall be conducted on the said premises contiguous to the south, west and north sides of the now existing building, between the hours of 12 midnight and 6 a.m. of any day, that the lands contiguous to the easterly side of the now existing building can be used without any limitations as to the hours of operation. BE IT FURTHER RESOLVED, that any charged violation shall b.e brought in the same manner and use the same procedure as set forth in Ordinance ~o.171 and amendments thereto. That any conviction of the terms and conditions of this resolution shall result in a revocation of'the special use permit g~anted herein. Roll Call - Ayes: Julkowski, Chies, Proft, Stopka. Naye: King. A letter was received from Thomas .O. Kachelmacher, LegalCounsel for Local 664, asking that the City Council appoint a repr~sentgtive on the wage panel, so that the two representatives can get together and carry out the necessary steps as required by law. Motion by Proft seconded by King, designating Mr. Kvalheim, City ~torney as the City's representative on the wage arbitration panel for Local 664. Roll Call'- Ail Ayes. Street platting.~n pilot study block (43~ Avenue east of Centrai) was discussed and will be taken up probably at the next regular,meeting. A letter was received from the Jaycees requesting exclusive'rights to sell concessions on Jamboree Parade Route. Legal opinion will be requested and this matter will be put on the agenda for next meeting. The Mayor recommended that Raymond Sibinski be appointed to the Planning &'Z°ning Commission to fill the unexpired term of Harold Anderson. Motion by Julkowski seconded by Proft, re-affirming the recommendatio~ of the Mayor. Roll Call - All Ayes. A -letter was received from the Library Board stating ?~m. King had tendered his resignation as a member of the Library Board and re- recommended ~ppointing Peter Barna to place him. Motion bY Chies seconded by King, appointing Peter Barna to the Library Board to fill the unexpired term of ~m. King. Roll Call - All Ayes. A request was received for street lights at 50th and Jefferson and 50th & ~ashington. Mo. tion by King seconded by Julkowski, that this request be turned over to the City Manager and N.S.P. Co. for their recommendation, Roll Call - All Ayes. A request was received from V.F.~. Post 230 of Columbia Heights ~or a Bingo permit weekly. Mo~ion by Proft seconded by King, that this permit be granted. Roll Call - All Ayes. The City Engineer reported he had been in contact with the Traffic Manager of the City of Minneapolis and was informed they have the means and funds now appropriated for a traffic signal at 37th & Central. They request that we pay one-half the installation and maintenance cost. Although some aid may be obtained from the State Highway or State Aid program,H~ would recommend that we follow through on a 50-50 basis in order to facilitate the installation as soon as possible. A letter will be forthcom~ from Minneapolis verifying the above r~ort. The Engineer asked for authorization to allow R.D. Thomas & Assoc. to proceed with storm sewer plans zor areas now under 1959 con- struction. The council will take this matter up at the special meeting to he held next week. Motion by Chies seconded by King, that a special meeting be set for Thursday, March 19th, at 7:30 p.m. Roll Call - A~tl Ayes. Secretary to City Council~ / MAYOR OFFICIAL PROCEEDINGS Special Meeting March 19, 1959 Meeting called to order at 8 p.m. Ail members present. Mr. Henry Omachi and Mr. Ray Haglund of R.D. Thomas & Associates were present at the meeting. Mr. Omachi gave a detailed report on the storm sewer needs for Columbia Heights. This was part One of the Storm Sewer Study authorized by the Council 11/24/58. Motion by King seconded by Proft, authorizing the City Manager to have R.D. Thomas & Associates proceed with the drafting of the nec- essary plans for those portions of the storm drain as required to complete the street surfacing and utility installations, previously authorized between 7th Street and Monroe, from 45th to 49th. '.- '~ This'~i~ for storm sewers to serve the low area at 47th and Washington, and between 45th and 46th on Washington, and between 45th and 46th on Jefferson, and also the low area at the turn around at 45th and Madison. Roll Call - All Ayes. Mayor Stopka left the meeting at this time and Mr. Julkowski took over as Chairman. Motion by Chies seconded by King, authorizing the City Manager to call for bids at our meeting of April 13th on Project No.5900, which is the utility installations and street openings and stabilization on the area bordered by 45th and 49th Avenues, 7th Street to Monroe, and necessary storm sewers.
