BEING AN ORDINANCE PROVIDING FOR BOULEVARD
PARKING UNDER CERTAIN CONDITIONS TO INDIVIDUALS
THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN:
Section 1.
Section 2.
A request may be made before the City Council to allow
boulevard parking on a street for a minimum length of
one block. The request may be for a street bounded by
two other streets or bounded by a street and a natural
barrier. The terms "street" and "avenues" are used
interchangeably.
Parking on the boulevard section of the street shall be
permitted only after the following:
A petition in the form hereinafter described must
be brought before the City Council.
The petition must contain the names of at least
two-thirds of the owners, resident and non-resident,
of both improved and unimproved property. The
two-thirds shall refer to front footage on both
sides of the street. The houses facing a street
and which address' is on that streetLare to be
considered only.~.~
The petition requesting the Council to authorize
boulevard parking must be in the following form:
'lpetition to Allow 'Boulevard Parking"
We, the undersigned, request the City Council
to authorize boulevard parking on our street. We
understand that, if this petition is approved and
takes effect, any veh,i:~le, mine or my neighbors,
may be parked anywhere on the boulevard section of
the street.

The person circulating the petition shall attest
before a notary publ'tc that the person whose name
appears on tKe petition did sign the petition and
that that person did sign the petition in front of
the person ci. rculating the petition. 0nly one (1)
name per property is needed.
Where at least two-thirds of the property owners by
front footage ask for permission to park vehicles on
the boulevard section of the street and after the
petition ts verified by the Council, the Council shall
by Resolution allow such boulevard parking.
The Resolution allowing such parring shall be in force
and remain tn effect until at least fifty-one per cent
[51%) of the property owners petition the Council to
disallow boulevard parking on that street. The Council
after verifying the petition shall then by Resolution
rescind its earlier action.
No permit shall be issued for only one side of the
street. Permission to park on the boulevard shall be
issued by the City Council to individuals. The City
Council sh~ll grant permission through the use of a
permit stamp.
The permit application shall cost $1.00 for the first
month and $.25 for each successive month to a maximum
of six months. Permits can be reissued by the City
Council.
The permission to park on the boulevard shat1 extend
to the individual and to that individual's property.
The individual may park his automobile on the boulevard
directly adjacent to his property. Permission is extended
to only that location.
The City Council shall consider the following when
determining whether or not to issue..such boulevard
parking permit:
a. Health defi. cienc~es;
b. Age;
c. Land condi, t~ons;
d. Alley;
e. Interference with other traffic either vehicular or
pedestrian.

Section 5.
Any person violating any of the provisions of this
Ordinance shall be deemed guilty of a misdemeanor
and punished by a fine of not more than One Hundred
Dollars C$100.00) or by i~mprisonment for not more
than ninety [90) days for each offense.
Section 6.
Should any section, subdivision, clause, or other
provi, s[on of this 0rd[nance be declared by a Court of
competent jut[sd|crOon to be invalid, such dec~sLon
shall not effect the yalidJty of the Ordinance as a
whole Dot any part thereof other than the part so declared
to be i, nvalid.
Section 7.
This Ordinance shall take effect and be in force from
and after thirty LO) days after its passage.
