HomeMy WebLinkAboutOrdinance 685 ORDINANCE NO. BEING AN ORDINANCE PROVIDING FOR BOULEVARD PARKtN'~DER CERTAIN GONDITIONS THE CITY OF COLUMBIA tiEIG~TS DOES ORDAIN: Section 1. A request may be made before the City Council to allow boulevard parking on a street for a minimum length of one block. The request may be for a street bounded by two other streets or bounded by a street and a natural barrier. The terms "s treet" and "avenues" are us ed intercbangeably. Section 2. Parking on the boulevard section of the street shall be permitted only after the following: a. A petition in the form hereinafter described must be brought before the City Council. b. The petition must contain the names of at least two-thirds of the owners, resident and non-resident, of both improved and unimproved property. The two-thirds shall refer to front footage on both sides of the street. The houses facing a street and 'which address is on that street are to be cons idered only. c. The petition requesting the Council to authorize boulevard parking must be in the following form: "Petition to Allow Boulevard Parking" We, the undersigned, request the City Council to authorize boulevard parking on our street. YVe understand that, if this petition is approved and takes effect, any vehicle, mine or my neighbors, may be parked anywhere on the boulevard section of the street. Name 1. 2. The person circulating the petition shall attest before a notary public that the person 'whose name appears on the petition did sign the petition and that that person did sign the petition in front of the person circulating the petition. Only one (1) name per property is needed. Section 3. Where at least t~vo-thirds of the property owners by front footage ask ici' permission to park vehicles on the boulevard section of the street and after the petition is verified by theGouncil, the Gouncil shall by Resolution allow such boulevard parking. The Resolution allowing such parking shall be in force and remain in effect until at least fifty-one per cent (51%) of the property owners petition the Council to disallow boulevard parking on that street. The Council after verifying the petition shall then by Resolution rescind its earlier action. Section 4. No permit shall be issued for only one side of the street. Section 5. Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and pubished by a fine of not more than One I~undred Dollars ($100.00) or by imprisonment for not more than ninety (90) days for each offense. Section 6. Should any section, subdivision, clause, or other provision of this Ordinance be declared by a Gourt of competent jurisdiction to be invalid, such decision shall not effect the validity of the Ordinance as a 'whole nor of any part thereof other than the part so declared to be invalid. Section 7. This Ordinance shall take effect and be in force from and after thirty (30) days after its passage.
