BEING AN ORDINANCE AMENDING ORDINANCE NO. 462,
BEING AN ORDINANCE FOR THE PURPOSE OF PROMOTING
HEALTH, SAFETY, ORDER, CONVENIENCE AND GENERAL
WELFARE BY REGULATING THE USE OF LAND, THE LOCATION
AND THE USE OF BUILDINGS AND THE ARRANGEMENT OF
BUILDING LOTS, AND THE DENSITY OF POPULATION iN
THE CITY OF COLUMBIA. HEIGHTS.
THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN:
Section 1.
Ordinance No.462 is hereby amended as follows:
That Section 3 include the following item:
39. UTILITY SHEDS. Structures other than a dwelling unit o
or garage.
(a) Utility Sheds shall be permitted only after
application for the issuance of a special use
permit by the City Council of the City of Columbia
Heights. No utility shed shall be permitted unless
and until such special use permit has been issued
by the City Council of the City of Columbia
Heights.
(b) Special use permit shall require (1) that either
a concrete slab or other suitable foundation be
required to insure stability of the structure;
(2) that the structure be properly maintained,
including exterior finish, in conformance with
the requirements for accessory buildings.
(c) All existing utility sheds meaning structures other
than dwelling units or garages are herein defined
to be non-conforming uses and a special use per-
..... mit shall be required for such utility sheds.
Section ~. noul~ any section, suoeivision, c£ause or other provision
of this Ordinance be declared by a Court of competent jur-
isdiction to be invalid, such decision shall not effect
the validity of the Ordinance as a whole nor any part
thereof, other than the part so declared to be invalid.

Any person violating this Ordinance shall be guilty of a
misdemeanor and upon conviction shall be punished by a
fine not to exceed 8100.00 or by imprisonment for a p~sriod
not to exceed 90 days.
This ordinance shall take effect and be in full force
from and after thirty (30) days after its passage.
