BEING AN ORDINANCE AMENDING ORDINANCE NO. 462 BEING AN
ORDINANCE FOR THE PURPOSE OF PROMOTING HEALTH, SAFETY,
ORDER, CONVENIENCE AND GENERAL WELFARE BY REGULATING THE
USE OF LAND, THE LOCATION AND THE USE OF BUILDINGS AND THE
ARRANGEMENT OF BUILDING LOTS, AND THE DENSITY OF POPULATION
IN THE CITY OF COLUMBIA HEIGHTS.
THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN:
Section t. Ordinance No. 462 is hereby amended as follows: Section $.?.1,
Uses Permitted and Excluded, C-3 and C-3-S Districts.
Uses Permitted:
1. All restaurants, including but not ,limited to drive-in restaurants
and walk-in restaurants.
Section 2. Section 5.4,B,6, which provides:
6. Restaurants, refreshment stands, but not any selling or serving
alcoholic beverages,
is herein repealed.
Section 3. This Ordinance herein establishes that all restaurants and restaurant
type operations are solely permitted in C-3 and C-3-S Districts.
Section 4. Should any section, subdivision, clause, or other provision of this
Ordinance be declared by a Court of competent jurisdiction to be invalid,
such decision shall not effect the validity of the Ordinance as a whole nor
any part thereof other than the part so declared to be invalid.
Section 5. Any person violating this ordinance shall be guilty of a misdemeanor and
upon conviction shall be punished by fine not to exceed $100.00 or by im-
prisonment for a period not to exceed 90 days.
Section 6. This Ordinance shall take effect and be in full force from and after
thirty (30) days after its passage.
