BEING AN O~NANCE REGULATING THE SALE OF CHRISTMAS
TREES.
THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN:
Section 1.
No person shall give away or trade, barter or sell at retail any cut evergreen,
firs, spruce or other tree of like kind for the use as what is generally known and
described as Christmas. trees without being licensed under this ordinance. This
ordinance shall not apply to the use of ornamental trees having a heights of less
than 36 inches t which are fireproofed and sprayed with coloring and used by florists
in their decorative schemes.
Section 2.
Every applicant for such license shall file with the City Clerk a written
application thereof stating the correct name, address and place of intended sale
of such Christmas trees.
Section 3.
The annual license fee shall be set by the City Council each year by resolution.
Section 4.
Each license shall be issued for a one-year period and all licenses shall
expire on November 1 of each year.
Section 5.
Failure to comply with the bond requirements shall be grounds for revocation
of the license.
Section 6.
Should any section, subdivision, clause, or other provision of this
ordinance be declared by a Court of competent jurisdiction to be invalid, such
decision shallnot effect the validity of the ordinance as a whole nor of any
part thereof other than the part so declared to be invalid.
Section Y.
Any person violating this ordinance shall be guilty of a misdemeanor
and upon conviction shall be punished by a fine not to exceed $100.00 or by
imprisonment for a period not to exceed 90 days. ,
Section 8.
This ordinance shall take effect and be in force from and after Thirty
(30) days after its passage.
