BEING AN ORDINANCE AUTHORIZING THE SALE BY THE CITY OF
COLUMBIA HEIGHTS OF CERTAIN REAL ESTATE IN OUTLOT A, 2ND
SUBDIVISION OF BLOCK F, COLUMBIA HEIGHTS ANNEX TO MINNE-
APOLIS.
THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN:
Section 1. Authorization of Sale of Real Estate. That the City of
Columbia Heights shall sell and convey unto Douglas M. Bauley and Elsie
C. Bauley, his wife, that certain tract of land lying and being in the County
of Anoka, State of Minnesota, described as follows:, to-wit:
That part of Outlot A, 2nd Subdivision of Block F, Columbia Heights
Annex to Minneapolis, thatl lie~ West of the West line of Lot 14,
Block 4, Columbia Heights Annex to Minneapolis, extended Southerly
to the South line of Outtot A, excepting therefrom that part of the
above described tract which is included in the following description:
That part of Outlot A, Second Subdivision of Block F, Columbia Heights
Annex, according to the map or plat thereof on file and of record in
the office of the Register of Deeds in and for Anoka County, Minnesota,
described as follows: Commencing at the Northwest corner of said
Outlot A, thence Easterly 'to the easterly line of Lot Twelve (12),
extended, thence South at right angles One Hundred Forty-six (146)
feet; thence West at right angles Two Hundred (200) feet; thence
North at right angles Ninety-six (96) feet; thence ~rest at right
angles to the Westerly line of said Outlot A, thence Northeasterly
along the said Westerly line to the point of beginning, together
with that part of the South Half of 38-1/2 Avenue N.E. which has
been vacated lying Northerly of the tract of land above described.
The above tract is subject to'a continuous l$-foot wide easement for the
installationf and maintenance of utilities along the Northerly line, and the Easterly
line of said tract.
Section 2. Terms and Conditions. That the terms of sale of said property
to the said Douglas M. Bauley and Elsie C. Bauley, his wife, shall be as follows:
$13,500.00 in cash at the time 'that the City conveys the property by
deed.
This sale is contingent upon the grantee having completedl~% , in terms
of market value, of the building within 12 months from the second reading of the
ordinance. If the building is not{~To completed, in terms of market value, the land
shall revert to the City of Columbia Heights.

Further, the above sale shall be completed within 60 days after the
second reading of the above ordinance.
Section 3. The Mayor and City Manager to Execute the Documents.
The Mayor and City Manager be and the same are hereby authorized to execute
and deliver to the said purchaser, the necessary deed for carrying out the terms
of this ordinance.
Section 4. Time of Taking Effect. This ordinance shall take effect and
be in force within thirty (30) days after its passage.
Section 5. Sep..arability. Should any section, subdivision, clause or
other provision of this ordinance be declared by a Court of competent jurisdiction
to be invalid, such decision shall not effect the validity of the ordinance as a
whole nor of any part thereof other than the part so declared to be invalid.
