BEING AN ORDINANCE LICENSING AND REGULATING THE USE
OF MECHANICAL AMUSEMENT DEVICES FOR CHILDREN.
THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN:
Section 1. '
An "amusement device" is herein defined as one designed for and used
exclusively by children, such as, but not limited to, kiddie cars, miniature air-
plane rides, mechanical horses, and other miniature mechanical devices not
operated as a part of or in connection with any carnival, circus, show or other
entertainment or exhibition.
Section 2.
No person shall operate any amusement device without being licensed
under this ordinance.
Section 3. Application for license.
Any person desiring to operate any amusement device as set forth in this
ordinance shall obtain a license from the City Clerk. The application shall contain
the name of the applicant; and, if a partnership, the names of the partners; and, if
a corporation, the names of the officers of the said corporation; the place or places
of business at which such amusement device is to be located, together with the home
address of all persons listed in the application, and the type of amusement device
to be used.
Section 4. Insurance Reqpired.
The applicant shall furnish a policy or duplicate policy of liability insurance
in the sum of not less than $25,000.00 for injury to one person or less than $$0,000.00
for one accident, which policy shall be written by an insurance company authorized
to do business in the State of Minnesota and shall be approved as to form and execution
by the City Attorney.
Section 5. License Fee.
The annual license fee for the license under this ordinance shall be set
by resolution by the City Council for each and every year.
Section 6. Expiration Date. ~
All licenses shall expire on December 31 of each year.
Section 7. Revocation of License.
Failure to comply ~vith the terms of this ordinance shall be grounds for
revocation of the license issued under this ordinance.
Section 8.
Should any section, subdivision, clause, or other provision of this
ordinance be declared by a Court of competent jurisdiction to be invalid, such
decision shall not effect the validity of the ordinance as a ~vhole nor of any
part thereof other than the part so declared to be invalid.
Section 9.
Any person violating this ordinance shall be guilty of a misdemeanor
and upon convict/on shall be punished by a fine not to exceed $100.00 or by
imprisonment for a period not to exceed 90 days.
Section 10.
This ordinance shall take effect and be in force from and after Thirty
(30i days after its passage.
