HomeMy WebLinkAboutOrdinance 618ORDINANCE NO. 618 BEING AN ORDINANCE PROVIDING FOR THE ISSUANCE OF ON-SALE NON-INTOXICATING MALT LIQUOR LICENSES TO CERTAIN CLUBS AND PROVIDING THE REGULATION THEREOF. The City of Columbia Heights does ordain: SECTION 1. The term ~club'~ for this Ordinance means an organization for social or business purposes, or for intellectual improvement, or for the promotion of sports, where serving of such non-intoxicating malt liquors is incidental and not the major purpose of the club, and which shall have more than fifty members and which shall, for more than a year have owned, hired or leased a building or space in a building of such extent and character as m~ may be suitable and adequate for 'the reasonable and comfortable accomodation of its members, and whose affairs and management are conducted by a Board of Directors, executive committee, or other similar body chosen by the members at a meeting held for that purpose, none of whose members, officers, agents, or employees are pa&d directly or indirectly any compensation by way of profit from the distribution or sale of beverages to the members of the club, or its guests, beyond the amount of such reasonable salary of wages as may be fixed and voted each year by the Directors or other governing body. SECTION 2. The licenses issued shall be for the On-Sale of non-intoxicat- ing malt liquors to members only. SECTION 3. The license fee shall be set by the City Council and shall not be less than $35.00. SECTION 4. Any clubs defined herein may make application for such licenses. The application shall be made with the City Clerk and on a form that the City Clerk and the State of Minnesota Liquor Control Commissioner prescribe. SECTION 5. 1. No sale of non-intoxicating malt liquor shall be made on any Sunday between the hours of 1:00 A.M. and 1:00 o'clock P.M. nor between the hours of 1:00 A.M. and 8:00 o'clock P.M. on any election day in the City of Columbia Heights. No sale shall be made between the hours of 1:00 A.M. and 4:00 o'clock P.M. on any weekday, Monday through Friday. No sale shall be made between the hours of 1:00 A.M. Saturday and 1:00 P.M. Saturday. Page 2 2. Sales shall be made only to Club members Section 6. A license to sell non-intoxicating malt liquor may permit the sale of such non-intoxicating malt liquor at only one level of the premises designated in said license. SECTION'7. Any change in the person managing ~he non-intoxicating malt liquor operation for the club shall be immediately forwarded to the City Clerk at the City of Columbia Heights. SECTION 8. No person shall manage or operate, nor in anywise be in control of the operation of the club who does not meet the qualifications as set out by the State of Minnesota Liquor Control Commissioner. SECTION 9. Execution of application. The application shall be signed by an officer of the club. SECTION 10. PRO-RATING OF FEES. There shall be no pro-ration of the license fees. SECTION 11. Investigation The Chief of Police shall investigate the truthfulness of the statements set forth in the application and shall endorse his findings thereon. ~he applicant shall furnish the Chief of Police such evidence as he may reason- ably require in support of the statements set forth in the application.. Upon completing his report, the Chief of Police shall return the applica- tion to the City Council. SECTION 12. Renewal. If the application shall be for the renewal of an existing license, the City Council, in its discretion, may grant or refuse a renewal of any license SECTION 13. No License shall be issued for any building, room or place within 600 feet of any public or parochial school, or church, said distance to be measured in a straight line from the building in which such school or church is conducted and to the main public entrance to the premises for which the license is sought. SECTION 14. Upon the granting by the City Council of the application, a license shall be issued and shall contain the name and address of the licensee and a description of the premises for which such license is granted, which license shall be signed by the City Clerk and shall haw~ attached thereto the seal of the City and the same shall be kept posted at al Pa~qe 3 all times in a conspicuous place in the premises for which the license is issued. SECTION 15. Revocation of Licenses. Any license issued under this Ordinance may be revoked by the City Council for any violation of this Ordinance and the laws of the State of Minnesota and any other City of Columbia Heights Ordinances relative to the sale of liquor and non-intoxicating malt liquor in the conduct of the business of the licensee. Such revocation by the City Council may be made for cause after notice to the licensee and hgaring, and opportunity of the licensee to be heard relative thereto. SECTION 16. Conviction, suspension and Revocation. Upon conviction of the licensee or of any agent, employee of said licensee for violation of any of the provisions of law relating to the sale, poss- ession, manufacture, transportation of liquor upon the premises of the licensee operating under said license, all licenses of the licensee shall be forthwith revoked unless it shall appear that such violation was not wilfull on the part of the licensee, in which case, and in lieu of such revocation, such licenses may be suspended for a period of thirty (30) days for the first violation or offense; for a period of Ninety (90) days for the second violation or offenses; and for the third violation or offenseG said license shall be revoked forthwith, which suspension or revocation shall be in addition to all the penalties provided by law. SECTION 17, State Law to App.l~. No license shall be issued in violation of any of the laws of the State of Minnesota, any violation of any law of the State of Minnesota relating to the sale or distribution of liquor shall be considered a violation of this code. SECTION 18. Time of takin~ Effect. This ordinance shall take effect and be in force from and after thirty (30) days after its passage.
