HomeMy WebLinkAboutOrdinance 594ORDINANCE NO. 594 AN ORDINANCE FOR THE PURPOSE OF PROMOTING HEALTH, SAFETY, ORDER, CONVENIENCE, AND GENERAL WELFARE BY PROHIBITING THE ABANDONMENT OF VEHICLES, RESTRICTING THE DISPOSITION OR KEEPING OF WRECKED, NON-OPERATING OR DISCARDED VEHICLES ON STREETS OR PRIVATE PROPERTY PROVIDING PENALTIES FOR VIOLA- TION, PROVIDING FOR SAME IN ACCORDANCE WITH SECTION 14, OF THE ZONING ORDINANCE NO. 462. THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN: Section 1. For the purpose of promoting health, safety, order, convenience, and general welfare in the City of Columbia Heights, the outside parking or outside storage, on or near residential district properties, of vehicles, materials, supplies or equipment not custom- arily used or needed for use in connection with the occupancy of rmsidential property~for residential purposes is hereby found to create nuisances and detrimental influence upon the puclic health, safety, property, good order and general welfare in such districts, including obstructing of view,on streets and on private properties, bringing unhealthful and noisome odors and materials into residential neighborhoods, creating cluttered and otherwise unsightly areas, pre- venting the full use of residential streets for residential parking, introducing commercial advertising signs into areas where commercial advertising signs are otherwise prohibited, and otherwise adversely affecting residential property values and neighborhood patterns. Section 2. It is unlawful for any person,,firm or corporation owning, driving or in charge of any b~s, motor truck, truck, tractor or commercial vehicle to cause or permit the same to be parked or stand longer than twenty-four hours continuously on, in front of, or beside any property in any residence district, except for the purpose of loading or unloading. For the purposes of this section a bus is a vehicle designed for carrying passengers and having a seating capacity of more than nine persons and a motor truck, truck tractor or commer- cial vehicle is a vehicle having either a capacity of more than one ton or a weight of more than 5,000 pounds, or both. Section 3. No person shall leave any partially dismantled, non- operating, wrecked or junked vehicle on any street or highway within the City. Section 4. No person in charge or control of any property within the City, whether as owner, tenant, occupant, lessee, or otherwise, shall allow any partially dismantled, non-operating, wrecked, junked, or discarded vehicle to remain on such property longer than 96 hours; and no person shall leave any such vehicle on any property within the City for a longer time than 96 hours; except that this ordinance shall not apply with regard to a vehicle in an enclosed building; a vehicle on the premises of a business enterprise operated in a lawful place and manner, when necessary to the operation of such business enterprise; or a vehicle in an appropriate storage place or depository maintained in a lawful place and manner by the City.
