BEI~G AN ORDINANCE REGULATING TH~ USE OF HIGHWAYS, STREETS AND ALLEYS
WITHIN TH~ CITY OF COLUMBI~ HEIGHTS, AND REQUIRING A LICENSE BY ANY
DRIVER THEREON°
THE CITY COUNCIL OF THE CITY OF COL~IA KEIGHTS DOES ORDAIN:
Section 1o No person~ except those hereinafter expressly exempted~ shall
operate or drive any motor vehicle upon any street~ alley or highway in the
City of Columbia Heights unless he has a valid license as a driver under the
provisions of the Drivers License Law of Minnesota.
Section 2. Exempt persons. The following persons are exempt from license
hereunder:
Persons licensed as chauffeurs under the laws of the State
of Minnesota while operating motor vehicles in the performance
of their duties as such chauffeurs°
Any person while driving or operating a motor vehicle in the
service of the Army~ Navy, or Marine Corps of the United States
Any person while driving or operating any farm tractor, or
implement of husbandry temporarily operated or moved on a
highway;
A non-resident who is at least 1~ years of age and who has in
his immediate possession a valid driver's license issued to
him in his home s%a~e or country may operate a motor vehicle
in this City only as a driver;
Any non-resident who is at least 18 years of age, whose home
Star, or Country does not require the licensing of drivers~ may
operate a motor vehicle as a driver onty~ for a period of not
more than 90 days in any calendar year~ if the motor vehicle
so operated is duly registered for the current calendar year in
the home state or country of such non-resident.
Section 3- Instruction Permits. Any person who, except for his lack of in-
struction in operating a motor ve~ic!e, would otherwise be qualified to obtain

a driver's license under the provisions of the Drivers License Law of
Minnesota~ may apply for an instruction permit and the Department of Highways
shall issue such permit~entit!ing the applicant, while having such permit in
his immediate possession, to drive a motor vehicle upon the highways for a
period of ~ months, but such person must be accompanied by a licensed driver
or chauffeur who is actually occupying a seat beside the driver°
~ection ~. Licensee to Have License in Possession. Every licensee shall have
his li6ense in his immediate possession at all times when operating a motor
vehicle, and shall display thesame, upon demand of a justice of the peace, an
authorized representative of the Department or officer authorized by law to
enforce the laws relating to the operation of motor vehicles upon public streets,
alleys and highways, and the licensee shall, upon request of any such officer~
write his name in the presence of such officer in order that the identity of
the licensee may be determined.
Section 5o Change of .Address. When any person, after applying for or receiving
a driver's license, shall change his permanent domicile from the address named
in such app!ication~ or in the license issued to him, or shall change his or her
name by marriage or otherwise, such person shall, within 50.days thereafter, make
application for a duplicate driverts license upon a form furnished by the Depart-
ment. Such application for duplicate license shall show both the !icensee~s
old address and his new address~ or his former name and new name, as the case
may be. Such application for a duplicate licens% upon change of address or
change of name, shall be accompanied by all certificates of driver's license
then in the possession of the applicant, together with the required fee.
. Section 6. Unlawful Acts Regarding Licenses. No person shall:
(a) Display, or cause or permit to be displayed, or have in his
possession, any ca~celed~ revoked, suspended, fictitious, or

or fraudulently altered driver's license.
(b) Lend his driver's license to any other person or knowingly
permit the use thereof by another°
(c) Displayor represent as one's own any driver's license not
issued to him.
(d)
Fail to refuse to surrender to the Department, upon its
lawful demand, any driver's license which has been suspended,
revoked or canceled.
(e) Use a false or fictitious name in any application for a driver's
license, or knowingly make a false statement, or know~ng!y con-
ceal a material fact~ or otherwise commit a fraud in any such
application.
(f) Operate a motor vehicle in any manner in violation of the
restrictions imposed in a restricted license issued to him~
(g) Operate a motor vehicle in the State under a licens% permit~
or registration certificate issued by any other jurisdiction
while his license or right to operate a motor vehicle in
Minnesota has been suspended, revoked or canceled.
Section 7. Rentk!s to Non-Licensed Drivers° No person shall rent or lease a
motor vehicle to any other person unless the latter person is then duly licensed
hereunder, or, in the case of a non-resident~ then duly licensed under the law
of the state or country of his residence, except a non-resident, whose home state
or country does not require that a driver be licensed°
Section 8. Driving after Suspension. Any person whose driver's license or
driving privilege has been canceled, suspended, or revoked, who operates any
motor vehicle, the operation of which requires a driver's license, upon the
streets, alleys or highways in the City while such a license or privilege is
canceled, suspended or revoked~ is guilty of a misdemeanor.
Section 9. Copies of Records a~ Evidence. Copies of any of the files or
records of the Department certified by the Commissioner as being true copies

shall be received in evidence in any Court in the State with the same force
and effect as the originals.
Section !0. Owner's Responsibility. No person having possession or control
of a motor vehicle shall knowingly authorize or allow the same to be driven
or operated or controlled by any person prohibited from driving or operating
or contro!ing such vehicle°
Section 11. Surrender of Driver's License. When any person is convicted of
any offense for which the Court in which such conviction is had recommends
the suspension of the driver's license of such person~ the court in which such
conviction is had shalZ require the surrender to it of all driver's licenses then
held by the person so convicted and the court shall thereupon forward the same
together with a record of such conviction, to the Department.
Section 12. Chauffeur's License. No person shall drive a motor vehicle as
a chauffeur upon the public streets, alleys or highways of the City, unless
such person shall ~aYe secured a chauffeur,s license from the Secretary of State
of Minnesota~ in the manner provided b~ the Statutes of Minnesota~
Section 15.

upon the streets, alleys or highways a truck, tractor or
truck-tractor belonging to another, with the exception of
those light cars classified as trucks which are on!yused to
carry tools, repairs or light materials used by the driver in
his employment and trucks registered in the "T" class when
operated by members of the family of the owner; and,
(d) Every person who drives a school bus transporting school
children
Section iL,. Any person, firm or corporation who shall violate any provisions
of this ordinance shall, upon conviction thereof, be punished by a fine of
not to exeeed $!00o00 or by imprisonment for not to exceed 90 days.
Section 15. T~me of taking effect of this ordinance shall be in effect and
take force from and after thirty (50) days after its passage.
