HomeMy WebLinkAboutOrdinance 600ORDIIYANCE NO. ~ BEING AN ORDINANCE PROVIDING FOR THE SEIZURE AND SALE OF ARTICLES BY POLICE DEPARTMENT OF THE CITY OF COLUMBIA HEIGHTS. THE CITY' OF COLUMBIA HEIGHTS DOES ORDAIN: Section 1. Whenever any articles or thing of value shall be found upon any street, sidewalk, avenue, alley, lane, or public ground!' the Chief of police shall seize and remove the same to some secure place within the City, retain possession thereof for at least six (6) months, and proceed to sell the same at public auction, giving at least six days notice of the time and place of such sale, in writing, to be posted in three conspicuous places in the City. The notice shall contain a brief description of the articles to be sold and the time and place of sale, which sale shall be made by the Chief of Police or under his direction. The owner of,such property, upon proving his title to the same to the satisfaction of the Chief of Police, shall be permitted to reclaim the same upon payment of $1 for the notice of sale posted as above specified, and also all reasonable expenses and charges incident to or incurred by the Chief of Police in the removal, care and storage of said property, which fees and expenses the Chief of Police shall charge and demand before delivering up the property. In caSe of sale of such property, upon proof of ownership thereof as aforesaid, the Chief of Police, at any time within one week from the sale, may p~y over the proceeds of the sale to the owner, after first deducting therefrom the fees and expenses above specified; otherwise the Chief of Police shall pay such surplus to the City Treasurer, and the City Council may at any time within six months thereafter cause such surplus 'to be paid to the former owner of the property. The Chief of Police shall report to the City Council quart:- erly as to all property seized under this section, the amount of expenses and charges thereon, and realized from sale or reclaiming of the property, and shall pay over all. moneys received by him, except as above specified to the City Treasurer. Section 2. This Ordinance shall take effect and be in force from and after thirty (30) days after its passage.
