HomeMy WebLinkAboutOrdinance 578ORDINANCE NO. 578 AN ORDINANCE DEFINING CERTAIN MISDEMEANORS PRESCRIBING A PENALTY FOR T~E VIOLATION THEREOF AND ADOPTING MINNESOTA STATUTES RELETING THERETO. THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN: SECTION I. Adoption of Minnesota Statutes Sections 609.05, 609.085, 609.175, 609.22, 609.27, 609.37, 609.375, 609.40, 609.475, 609.485, 609.50, 609.51, 609.515, 609.52, 609.525, 609.53, 609.535, 609.545, 609.555,609.565, 609.575, 609.595.609.60, 609.605, 609.615, 609.65, 609.655, 609.66, 609.675, 609.68, 609.685, 609.705, 609.715, 609.72, 609.725, 609.735, 609.74,609.745, 609.75, 609,755, 609.775, 609.78, 609.785, 609.79, 609.795, 609.805,609.81, 609.815, 609.82, 340.97 and 614.57, are hereby adopted and shall be in full force and effect in this City insofar as applicable. SECTION II. Violation a Misdemeanor. The violation of any of the sections or subsections of this ordinance by any person, firm or cor- poration, partnership or legal entity shall be deemed a misdemeanor and shall be punished by a fine of not more than one hundred dollars or by imprisonment in the County Jail for not more than ninety (90) days. violation of each section or subsection hereof shall be deemed a separate violation, each to be deemed a suparate misdemeanor. SECTION iii. General Principals. Liability for Crimes of Another. 609..05. Subdivision 1. A person is criminally liable for a crime committed by another if he intentionally aids, advises, hires, cousels, or conspires with or otherwise pro- cures the other to commit the crime. Subdivision 2. A person liable under subdivision 1 is also liable for any other crime committed in pursuance of the intended crime if reasonably foreseeable by him as a probable consequence of committing or attempting to commit the crime intended. Subdivision 3. A person who intentionally aids, advises,hires, cousels, or conspires with or otherwise procures another to commit a crime and thereafter abandons his purpose and makes a reasonable effort to prevent the commission of the crime prior to its commission, is not liable if the crime is thereafter committed. Subdivision 4. A person liable under this section may be charged with and convicted of the crime although the persc person who directly committed it has not been convicted or has been convicted of some other degree of the crime or of some other crime based on the same act. SECTION iV. Anticipatory Crimes, Conspiracy. 609. t75. Subdivision 1. To cause arrest or prosecution. Whoever con- spires with another to cause a third person to be arrested or prosecuted on a criminal charge knowing the c~arge to be false may be sentenced to imprisonment for not more than 90 days or to payment of a fine of not more 'than $100.00. Subdivision 2. To commit crime. T~hoever conspires with another to commit a crime and in furtherance of the consp spiracy one or more of the parties does some overt act in fur- therance of such conspiracy may be sentenced as follows: (1) If the crime intended is a misdemeanor, by a sentence to imprisonment for not more than 90 days or to payment of a fine of not more than $100; or $~b~i~ision 3. Application of section. This section applies if: (1) The defendent in this state conspires with another outside of this state; or (2) The defendent outside of this state conspires with another in this state; or (3) The defendent outside of this state conspires with another outside of this state and an overt act in furtherance of the conspiracy is committed within this state by either of them. SECTION V. Offenses against the person. No person shall commit an offense against the person of another or of violating any of the following sections of Minnesota Statutes: (a) 609.22~Assault. Whoever does any of the following commits an assault and may be. sentenced to imprisonment for not more than 90 days or to payment of a fine of not more than $100: (1) Does an act with intent to cause fear in another of immediate bodily harm or death; or (2) Intentionally inflicts or attempts to inflict bodily harm upon another. SECTION VI. Offenses of Compulsion. No person shall commit an offense of compulsion by violating any of the following Sections of Minnesota statutes: (a) 609.27 SECTION VII. Offenses Against the Family. No person shall commit an offense against the family by violating any of the following Sections of Minnesota Statutes: (a) 609. 375 SECTION VIII. Offenses against the Government. No person shall commit an offense against the government by violating any of the follow- ing Sections of Minnesota Statutes: (a) 60 9.40 SECTION iX. Crimes Affecting a Public Officer or Employee. No person shall commit an offense against or affecting a public officer or employee by violating any of the following sections of Minnesota Statutes: (a) 609.475 SECTION X. Offenses against the Administration of Justice. No person shall commit an offense against the administration of justice by violating any of the following Sections of Minnesota Statutes (a) (b) (c) (d) (e) 609.485 Escape from custody. 609.50 Obstructing legal process or arrest. 609.505 Fals~y reporting crime. 609.51 Simulating legal process. 609.515 Misconduct of judicial or hearing off&cer. SECTION XI. Offenses of Theft. No person shall commit an offense of theft by violating any of the following Sections of Minnesota Statutes: (a) 609.52 (b) 609. 525 (c) 609.53 (d) 609.535 (e) 609. 545 Theft. Bringing stolen goods into state. Receiving stolen property. Issuance of worthless checks. Misusing credit card to secure services. SECTION XII. Offenses of Damage or Trespass to Property. No person shall commit an offense of damage or trespass to property by violating any of the following Sections of Minnesota Statutes: (b) (c) (d) (e) (f) (g) 609. 565 Simple arson. 609.57 Attempted arson. 609.575 Negligent fires. 609.595 Damage to property. 609.60 Dangerous trespass and other acts. 609.605 Trespasses and other acts. 609.615 Defeating security on realty. SECTION XIII. Offenses of Forgery and Related Crimes. No person shall commit an offense of forgery or other related crime by violating any of the following Sections of Minnesota Statutes: (a) (b) 609.65 False certification by notary public. 609.655 Alteration or removal of identification number. SECTION XIV. Offenses Against Public Safety and Health. No person shall commit an offense against public safety and health by violating any of the following Sections of Minnesota Statutes: (a) (b) '(c) 609.66 DangerQus weapons. 609.675 Exposure of unused refrigerator or container to children. 609.68 Unlawful deposit of garbage, litter or like. 609.685 Use of tobacco by children. SECTION XV. Offenses of Public Misconduct or Nuisance. No person, shall commit an offense of public misconduct or nuisance by violating any of the following Sections of the Minnesota Statutes: SECTION XVI. (a) 609. 705 (b) 609. 715 (c) 609.72 (d) 609. 725 (e) 609. 735 (f) 609.74 (g) 609.74.5 Unlawful assembly. Presence at unlawful assembly. Disorderly conduct. Vagrancy. Concealing identity. Piblic nuisance. Permitting public nuisance. Offenses Against Gambling. No person shall commit an offense of gambling by violating any of the following Sections of Minnesota Statutes: (a) 609.75 Gambling. (b) 609.755 Acts of or relating to gambling. SECTION XVII. Offenses relating to Communications. No person shall commit an offense relating to communications by violating any of the following Sections of Minnesota Statutes: (a) 609. 775 (b) 609.78 (c) 609.785 (d) 609.79 (e) 609. 795 SECTION XVI!I. Divulging telephone or telegraph message; non-delivery. Emergency telephone calls. Fraudulent long distance telephone calls. Making anonymous telephone call. Opening sealed letter, telegram, or package. Offenses Relating to a Business. No person shall commit an offense relating to business by violating any of the following Sections of Minnesota Statutes: (a) 609. 805 (b) 609.81 (c) 609.815 (d) 609.82 Ticket scalping. Misconduct of pawnbrokers. Misconduct of junk or second~and dealer. Fraud in obtaining credit. SECTION XIX. Miscellaneous Offenses. No person shall commit an offense as regards intoxication, ~agrancy, etc. by violating any of the following Sections of Minnesota Statutes: (4) 340.96 Intoxication. (b) 614.57 Vagrancy. SECTION YAK. This ordinance shall take effect and be in force from and after thirty (30) days after its passage.
