BEING AN ORDINANCE AMENDING ORDINANCE [~62 BEING AN ORDINANCE
FOR THE PURPOSE OF PROMOTING HEALTH, SAFETY, ORDER, CONVENIENCE
AND GENERAL WELFARE BY REGULATING ~ USE OF LAND, /HE LOCATION
AND ~ USE OF BUILDINGS, AND THE ARRANGEMENT OF BUILDING LOTS,
AND iRE DENSITY OF POPULATION IN iHE CITY OF COLUMBIA HEIGHTS.
PERFORMANCE STANDARDS
The performance standards established in this section are
designed to prevent and eliminate those conditions that cause
blight. The standards shall be enforced through the building
department. Before any building permit or certificate of
occupancy is approved, the Building Inspector shall determine,
insofar ~s he is able, whether the proposed use will conform
to the performance standards. This may require the developer
to supply additional data about the proposed use (such as equip-
ment to be used, hours of operation, method of refuse disposal,
type and location of exterior storage, etco)
It may occasionally benecessary to employ specialized consul-
tants to determine whether a given use would exceed the perform~nce
standards° The City thus recognizes its responsibility for
preventing nuisance conditions before, not after, they occur.

Refuse: In all areas, all waste material, debris, refuse, or
'g'~rb~ge shall be kept in an enclosed building or properly con-
tained in a closed container designed for such purpose. The owner
of vacant land shall be responsible for keeping such land free
of refuse.

Screenin$: Where any business or industrial use (i.e. structure
parking, or storage) is within 300 feet of property zoned or
used for residential purposes, that business or industry shall
provide screening along the boundary of the residential property.
This screening shall consist of fencing, wall, plantings
as determined by the Planning and Zoning Commission to be appropriate
for the given situation.
This screening shall also be required of all multiple
dwellings where they abut an existing single dwelling, or property
zoned R1 or R2.
D. Maintenance: In all areas, all structures, parking and storage
areas, landscaping and screening, shall be maintained so as not
to be unsightly to the adjoining areas~
E. Glare: In all areas, no direct g~ar~, whether from lights or
from high-temperature processes such as conbustion or welding,
shall be directed onto a public street, or onto adjoining properties
in such a manner as to impede safe traffic movement or create a
nuisance to the adjoining users.
Drainage: No land shall be developed and no use shall be
permitted that results in water run-off, flooding, or erosion
on adjacent properties; such run-off shall be properly channeled
into a storm drain water course, ponding area, or other public
facility.
Radiation and Electrical Emissions: No activities shall be
permitted that emit dangerous radioactivity beyond enclosed
areas. No electrical disturbance (except domestic household
appliances) adversely affecting the operation at any point of
any equipment other than that of the creator of such distur-
bance.
Other Nuisance Characteristics: No noise, odors, v-lb~ation,
smoke, air pollution, or dangerous wastes shall be created
that are offensive or dangerous to the public health and safety.

~Vibra~tion: Any vibration discernable to the h~man sense of feeling
for three minutes or more duration in any one hour and any
vibration producing an acceleration of more than O.l.g. or shall
resuIt in any combination of amplitudes and frequencies beyond the
'~afe'~ range of Table 7, U.S. Bureau of Mines, Bulletin "Quarry
Blasting"~ on any structure.
S~oke: Any emission of visible smoke of a shade equal to or
greater than No. 2 on the Ringlemann Smoke Chart, as published by
the U.S. Bureau of Mines, except that visible grey smoke or a shade
darker than No. 2 on said chart may be emitted for not more than t~o
minutes in any 30 minute period.
Section 2.
Air Pollution: (Fly ash, dust, fumes, vapors, gasses, etc.)
No emission which can cause any dmmage to health, animals, or
vegetation or other forms of property or which can cause any
excessive s oiling at any point, and in no event any emission of
any solid or liquid particles in concentrations exceeding
0.85 lbs~ per l~000 lbs. of gasses shall be permitt~d~ Measure-
ment to be made at any convenient point along the stack. In the
case of f~el burning equipment, an adjustment of the ~asses to
12 per cent CO2 content will be made. In no case shall more than
15 per cent of the total chst measured before entering the d~st
collecting device be emitted into the atmosphere.
This Ordinance shall take effect and be in force from and after thirty
(30) days after its passage.
