WHEREAS, Petitions have been flied with the City
Manager and many complaints have been voiced at the City
Council against the riding of horses upon the public
streets of Columbia Heights.
WHEREAS, A public hearing was held on the iSth day
of May, 19~0, at the city offices, which meeting was
attended by over two hundred and fifth citizens and tax
payers, during which time the complaints of the tax payers
were registered before the ~+'~ Council
WHEREAS, The City Council fully recognizes that
there is !~ediate need for legislation regarding the
riding and driving of horses upon the city streets, alleys:
and thoroughfares in the City of Columbia Heights.
THIS COUNC!L, hero,by, and under this preamble declares
that a public emergency exists which subjects the city to
the necessity of taking extraordinary measures and that in
o~der to promptly meet such emergency it is necessary to
pass Ordinance No. ~ as an emergency ordinance.

THEREOF.
Section 1. Ridin~ Academy. The words Riding Academy
as used in this ordinance shall be held to mean, and are
hereby defined as mesnIng, any barn, stable, building, or
other place within the city~ the principal use of which or
the chief source of~orofit of which is ~-~-~'z~ vne keep-
ing or letting for hire or reward of horses, carrie~ies, cabs,
wagons, s!eighs, or otb'er vehicles for carrying passengers
drawn by bJorses, whether such horses or vehicles be hired
out or let with or without a driver furnished by the Riding
Academy
Section 2. Horse Defined. The work "horse:' as used
in this ordinance shall be held to mean any quodriped mainly
used for rldin~ or brid~ purposes~ whether said horse is
used exclusively by its owner or is rented our for profit.
Section 3. Riding Academys to be licensed. No person
or corporation shall keep, conduct or operate a RidinE Acad-
emy, or carry on the business of a Riding Academy keeper in
this city without first obtaining a license so to do in the
manner hereinafter provided.
Section 4. Application for license. Any person deslr-
lng to keep, condu~:t or op=,ra~e a Riding Academy, or to carry
on the business of keeper of a Riding Academy, shall mske
application to the ~City Clerk. Such application shall set
forth the name of the applicant, an~ if an individual or
indi~idua!s, the place of his or their residence. Such adp-
!Ication shall also contain the location of the place at which
it is intended to keep such Riding Academy or to conduct the
b~siness of keeper of a Riding Academy.
The City Council thereupon issue or cause to be issued
a license upon the payment hy such ap?!icant in accordance
with the rates hereinafter fixed.
Section ~. License Fee. The annual license fee for a
license to engage in the business of operating a Riding Acad-
emy shall be ~.00.
Section 6. Horses to be Registered. ?~o person shall
ride or dr!~:e a horse u~2on any rub!lo street, alley, hlghway,

Sectlon 7. Horses to be Registered wlth the Clty ~lanager_._
Every owner of a horse shall list am.d register with the City
~anager an accurate description of each l~.orse owned by him.
Said description shall show the sex, height, color, and dis-
tinguishing marks .and name of each horse.
Section 8. City .~anager to issue Numbers and Registration
Cards. U~on payment of a fee of ~!.00 the City ~.,~anager shal_
issue to the ra.~istered owner of each horse a n~,mber, of a
type de~!gnate~ by the Clty Lianas'er, and a registration card,
said number and reglstrat!on cards ha~.~ln~ numbers stam?ed
thereon, in numerical order beglnnlng with number !; such
numbers shall be suitable for attacb~_ment to the horse, saddle,
or bridle. Said number must be conspiouo~sly displayed on
said horse at all times ,when it is traveling upon city streets,
alleys, or highways. If said number shall become lost it
shall be replaced by the City ~.~anager upon the payment of a
fee of ~!.00.
Section 9. Registration to be Transferred. it shall
be the duty of any person who sells or transfers ownership
of any registered horses to report such sale or transfer to
the City ]2anager by returning the registration card issued
to such person as license thereof~ together with the nsme
and address of the person to whom said horse was sold or trans-
ferred, and such report shall be made within five days of the
date of said sale or transfer, It shall be the duty of the
purchaser or transferee of such horse to apply for s transfer
or registration therefore within five days of said sale or
transfer. Such transfer of registration whal! be made by the
City ~[anager upon payment of a fee of ~!.00.
Section !0. Numbers and Registration Cards not to be
Mutilated. It shall be unlawful for any person to wi!fully
or maliciously remove, destroy, mutilate~ or alter the num-
ber of any horse licensed pursuant tc this ordinance. It
shall 'also be unlawful for any person to remove, destroy,
mutilate, or alter any registration card.
Section 11. Horses without Numbers to be Imoo~nded.
If any horse is found on any street, a!ley~ highway, or the
City of Coi~mbia Heights without a n~.~mber so provided it.
shall be prima facie evidence that said horse is beln~
ridden or driven ul~on the streets of the City of Columbia
Heights without ha~Ing been registered. Said horse shall
be impounded by the police department and shall be surren-
dered to the owner thereof upon proff of ownership sat~s-
factory to the Chief of Police and after payment of the
registration fee and procurement of a number and registra-
tion card as hereinbefore provided~ and after payment of a
further fee for the cost of their maintenance and care dur-
lng the time they are impounded shall be paid by the owner
thereof before their release and in default of such payment
such horses may be sold by the City to satisfy its claim for
such expense.
Section 12. Posting Streets. ;~'henever the City ~ana~er
shal~ recommend to the '~'
_ ~ity ~ouncii that any street or str~e,~s
of the City which have been or are .~.bout to be impro~-ed by ap-
plication of any form of tar treatment will be seriously
aged if permitted to be used, by horses, the City Council may
direct said City '~2anager to post conspicuous signs on said
streets prohibiting the use of thereof by persons riding or
drifting horses. Said signs shall remain posted until the said
City L~anager shall recom~:~end to the City Council that the con-
dition of the street is such that it will not be endangered
by the hooves of horses, it shall be unlawful for any person
to remove any such sign unless authorized by the City of C0i
umbla HeI~hts which is posted as herein before provided, and
it shall be unlawful for any person to cause or permit, ar~
shod horses to run at tar~e on any such street or highway.
Section 13. Private Property. No person shsli ride
or drive any horse or horses within the City of Columbia
Heights on any public property not duly dedicated for road-
way or bridle path ?ur?oses, or upon any private property
without the permission of the o~vner thereof, and any person
riding or driving a hor~se or horses unto any public or pri-
vate property not duly dedicated for road~zay or bridle path
urposes shall be de meal to be an unlawful trespasser on
said property, and the burden shall be upon such person upon
prosecution for violation thereof to ~:~rove that he has rid-
den or dri-¢en such horse or horses upon such property with
the consent or permission of the o~ner thereof.

Section !~. General Traffic Re~.!ations to be Obser~ed.
EYery person riding a horse on any str?et, alley or other

observe all traffic rules and reg~!ations ap?!icable there-
to, and shall turn only at intersections, signal all turns,
ride to the rl~ht hand side of the street, alley or other
public h~gh?ay, pass to the left when ~~ o'~-ertaking
vehiQ!es or other rifers that are slower moving, and shall
pass to the right v~hen mead-ting apuroaching traffic.

V~~enever groups of more than two persons are riding horses
together on any street, alley, or other public hi~h~vay with-
in the City of Columbia Heights, they shall not ride more
than two abreast, and shall at all times so govern and ¢on-
troi their horses as not to unnecessarily interfere with
other traffic thereon.
Section 17. Speed-Racln~. No person or persons shall
at any time race one horse again~t another while ridin~ on
any street, alley, or other public hl~hway ~ithin the City
of Columbia H~ign~s; and. no person shal? at any time
~ o a~ ~ ey
a horse at a speed greater than a ~.r.~t on any street,
or other public highway within the city.
Section !$ A~e Requirement it shall be un! ~ ~
for any person conducting a riding academy to rent or let
for hire any horse to any child under sixteen years of age
without the ?rltten consent of the parent or ~uardlan of
such child.
Section 19. Regulation of Hours. It shall be unlaw-
ful to drive or ride any horse upon any street, alley or
highway within the City of Columbia Heights before the hours
of 6 A.M. in the mornin~ and not later than i! P.~f. unless
special permission has been granted by the Chief of Police.
Seotlon 20. RegJ_stration of oatrons of Riding_Academy_~m
It shall be the duty of the owner of all riding academies
~ ~'~' to keep a register
within the Sity of Columbia H~m~hts
book which shall be ope~n to public inspection at all times.
Such register shall co~tain the names a~nd addresses of all
persons renting horses for use upon the public streets, alleys,
and highways ~.~ithin the City of Co!~mbla Heights. It shall
also sho~' the time the horse left the stable and the Time that
it was returned, the number and registration card of each
horse.
Section Zt. Duties to Horse smd Riders. It shall
be unlawful to halt, interfere or forcibly to stop without
cause any horse being ridden or driven upon any public street
alley or highway ?itkin the City of Columbia Heights. It shall
be un!av?fu! to throw stay rock, missel, or other herd substance
at any horse or its rider or driver. I~ shall be unlav.~ful for
the operator or driver of any automobile ~r approaching or pass-
ing ezay horse being ridden or driven upon any alley, street or
high.~.ay within the City of Columbia Heights, to so manipulate
any mechanica2 device on said a~to~.~obile in such a manner as
would reasonably be expected to cause any horse to become fright-
ened or alarmed to such sa~ extent as to endanger the safety or
. well being of its rider or driver.
Section 22. Conduct of Horses and ~uati,~cations of
Riders.
No horse shall be furnished for hire unless such
horse has been thorou~h!y broken~ even-tempered, and easily
mmna~ed. No horse shall be furnished for hire to s_ny person
unless the riding academy owner or operator has ascertained
that such person is capable of riding said horse, taking into
consideration the age, experience, and ability of said rider.
In the event that any horse becomes u~ar~ageable s~nd gets out
of control snd trespasses upon private property, it shall be
prima facie evidence of the fact that said horse is not well-
broken and that such person has not the ability, a~e and
experience sufficent to ride said horse and the o~ner of such
horse in such event shall be guilty of a trespass as afore-
mentioned.
Section 23. Amy person who shall violate any of the
provisions of this ordinance shall, upon conviction thereof, be
punished by the fine of not to exceed One Hundred ~md no/lO0
(~t00.00) Dollars or by imprisonment for not to exceed ninety
(90) days, plus the costs of prosecution in any case.
Ordinance No. 168 is hereby repealed.
