HomeMy WebLinkAboutOrdinance 192PREA~f~BLE TO ORDINANCE NU~iBER Being an 0rdinsmce entitled: To prohibit the maauthorized interference with the raising or producing of plant, fruit, berries, and vegetables used or intended for human consumption within the City of Columbia Heights, and providing for pen- alty of violation thereof. WHEREAS, A state of war exists between the United States and the Axis nations, composed primarily of Italy, Japan and Germany. WHEREAS, There is a shortage of food due to the creased demands of the army and feeding of people in occu- pied oountrles. '~EREAS, Said shortage of food will become more acute unless people are encouraged to raise their own garden veg- etables. THIS COUNCIL, hereby, and under this preamble declares that a public emergency exists which subjects the city to the necessity of taking extraordinary measures and that in order to promptly meet such emergency it is necessary to pass Ordinance No. /~/ as an emergency ordinance. THE CITY COUNCIL OF COLU?_BIA HEIGHTS DO ORDAIN: Sectlon't. It shall be unlawful for any person, domestic animal, or fowl, to injure or destroy in or upon, or to remove or carry away from, any plot of ground lawfully used as and for a garden within the City of Columbia Helaihts, any imple- ments used there on, or seeds or plant products thereof, used or intended for human consumpticn, not to him or her belonging and without permission so to do from the lawful owner or pro- ducer thereof; it 'being the purpose of this ordinance to en- courage and protect increased production of such said foods during the war and nationsl emergency period for the good order of the city and the health and welfare if its inhabitants. Section 2. Any person who shall violate any pro- vision of this ordinance shall, upon conviction thereof, be ~iO0. punished by a fine of not to exceed O0 or by imprison- ment, not to exceed 90 days.. Section 5. In the event any domestic animal or fowl violates any provision of this ordinance; upon conviction thereof~ the owner of such domestic animal or fowl shall be punished by a fine of not to exceed ~tOO.00 or by imprisonment of not to exceed 90 days.
