HomeMy WebLinkAboutOrdinance 191PREAMBLE TO ORDINANCE NO. 191 WHEREAS, a state of war exists between the United Statesof America and cer- tain other nations, and WHEREAS, the federal government has seen fit to ration the distribution of gasoline and other inflammableliquids, and WHEREAS, It is necessary pursuant to Section 20, Chapter S of the City Charter of this City to enact an emergency ordinance to prohibit the theft of gasoline and lubricating oils, and to provide for penalty for violation thereof, THIS CITY COUNCIL OF THE CITY OF COLUMBIAHEIGHTS hereby and under this pre- amble declares an emergency exists for the immediate oreservation of the public peace and safety an& that in order to promptly meet such emergency it is necessary to Dass Ordinance No. 191 as an emergency ordinance. Preamble offered by: Bentzen Preamble seconded by: Jackson Roll Call: Ayes: All Nays: None SeCretary ~o ghe Council--- ~" Mayor ORDINANCE NO. 191 TO PROHIBIT THE TKEFT OF GASOLINE AND LUBRICATING 0ILS, AND TO PROVIDE FOR PENALTY FOR VIOLATION THEREOF. THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN: Section l. No person in the City of Columbia Heights shall in any manner siphon, draw, take or carry away from any motor vehicle or other container any gas- oline or lubricating oils, as hereinafter defined, not to him or her belonging, without permission from the owner thereof. The word "gasoline" as herein used shall be deemed to include all gasoline, distillate, benzine, naphtha, benzol and other volatile and inflammable ltouids used for cleaning fluid or in producing or generating power for motors or for pro- pelling motor driven vehicles. The words "lubricating oils" as herein used, shall be deemed to mean any oil used for lubricating of any machine, motor, or motor vehicle. Section 2. Any person who s~ll violate aw provision of this ordi~nce s~ll, upon conviction thereof, be punished~ i~riso~ent for not to exceed ninety (90) days, or One H~ed ($100.00) Dollars fine, or Both.
