AN ORD/~h%NCE TO P~OTECT AND PRESERVE THE PUBLIC HEALTH
BY REGULATING THE LOCATION, CONSTRUCTION AND OPERATION
OF SOIL ABSORPTION SYSTEM~ FOR THE DISPOSAL OF HUMAN
EXCRETA, AND PROVIDING A PENALTY FOR VIOLATION THEREOF.
~Se=~i. on .1.. It shall be unlawful for any person, firm or
~or~ora~ion to construct, operate or maintain any soil absorption
system for the disposal,of human excreta or to cause or permit the
same to be ~one on any premises owned, occupied or controlled by
h~m, wi~/tin the City of Columbia Heights, except in conformity with
~he provisions of ~his ordinance.
Section 2. The ~erm "soil absorption system" shall be construed
to include a~i-methods of disposing of human excreta except through
a general sewer system, flushed by water and installed under the
supervision and direc~ion of the City of co~lumbia Heights.
.Section 3; No privies shall hereafter be constructed on any
premises in the City of Columbia Heights which is adjacent or abuts
on any street or alley wherein sewer or water mains have been installed.
SectiOn 4. From and after 12 months after this ordinance shall
have ~en effe~c all privies heretofore constructed and now maintained
on any premises in the City of Columbia Heights which is adjacent Or
abuts on any s~reet or alley wherein sewers have been installed shall
be removed and their use discontinued; and no building located thereon
shall thereafter be occupied either as a dwelling or for business
purposes, un~il a wa~er closet has been installed therein and prop-
erly connected with said sewer. And provided further in any c~se
where sewer lines are ex~ended ~he use of all privies maintained on
premises adjacent to or abuting on any street or alley wherein such
new sewer lines are installed, shall be discon~nued from and after
six months after the completing of such sewer lines, and the serving
of written notice on the occupant of such premises by the City
Manager, that such sewer line has been completed. Thereafter no
building on any such premises shall be occupied for such dwelling
or business purpose until a water closet has been installed therein
properly connected with said sewer.
secti~n~ _5~ All buil~ings hereafter constructed in the City of
Columbia Heights, to be used for dwelling or business purposes, on
any premises adjacent to or abutting on any street or alley ~erein
water mains have been installed, but wherein sewers have not been
installed, shall be equipped wi~h a water closet properly connected
to a septic ~ o~f cesspool installed on said premises in accordance
with Ordinance No. 10 2.
~. From and after ~/~e passage of this ordinance no
human eu~reta shall be disposed of within the City of Columbia Heights
except in water closets properly connected with a sewer, septic tank
or uesspool, or in privies where not prohibited by this ordinance.
Section... 7. All privies heretofore or hereafter constructed
and maintained as authorize~ by the provisions of this ordinance shall
be constructed and also maintained in accordance with the following
regula~ons ~
(a) They shall not, where feasible, be located closer
than twen~j (20) £ee2 to any place of human hab~tation,
nor closer than fifty (50) feet to any well or spring
from whi~/~ water is obtained for drinking or ~ulinary
purposes, and so that seepage from the privy vault will
not drain into any such well or s~ring.
~b) Ail privy vaults must be dug to a depth of at
least five (5) feet.
(c) They shall be located and constructed so that no
surface water will drain into the privy vault.
(d) The roof shall be tight. ~%e door shall be tight
and self-closing. The privy and privy vault shall
be fly-tight. Adequate ventilations shall be provided.
(e) The privy seat shall be kept clean. Thee building
shall be kept painted on the outside and in good repair.
(f) When the vault has become filled with excreta within
One (1) foot of the surface of the ground, the privy shal
be moved if possible, over a new vault. ~ne Excreta in
the old vault shall be covered with earth to the level
of the surrounding ground and the fill shall be pro-
tected from disturbance for a period of three' months.
If it is not practical to move the privy, when the
vault if filled within one (1) foot of the surface
of the ground, and e~creta shall be treated with a
s~rong disinfectant and may be removed only by the
permission and under the direction of tl%e health
department of the City of Columbia Heights.
Section 8. Any person, firm or corporation violating any of
the provisions of this ordinance shall be guilty of a misdemeanor,.
and upon conviction ~-hereof shall be punished by a fine not exceeding
One Hundred and No/!00 (8100.00) Dollar~, or imprisonment not ex-
ceeding ninety (90) days.
Section 9. This ordinance shall take effect a~d be in force
from and after thirty (30) days after its passage.
