LIGHT COMPANY, ITS SuccESSORS AND ASSIGNS,
THE RIGHT TO MANUFACTURE, SELL AND/OR DIS-
TRIBUTE GAS FOR HEATING, ILLUMINATING AND
OTHER PURPOSES~ IN THE CITY ~OF COLUMBIA
HEIGHTS, AND TO USE THE STREETS, AVENUES
AND ALLEYS THEREOF FOR THAT PURPOSE.
as follows:
The City Council of Columbia Heights do ordain
Section 1. That permission is hereby given
and granted to the Minneapolis Gas Light Company, its succes-
sors and assigns, for the period of twenty (20) years from
and after the publication of this Ordinance, to manufacture,
sell and/or distribute gas for heating, illuminating and other~
purposes within the City of Columbia Heights, and for that pur-
pose to lay and maintain gas mains and pipes, and any other
appurtenances necessary to the maintenance of service in and
along the streets, avenues and alleys of said City. Provided,
however, that before the said Company shall establish any plant
in said City for the manufacture of gas, the approval by the
City Council of the location thereof, in the exercise of a
reasonable discretion by said Council, shall be first obtained
by said Company. Provided, further, that before laying said
mains the Company shall submit a plan showing the proposed
location thereof to the City Council, and obtain its approv-
al of such plan~
Section 2..' That the said Minneapolis Gas
Light Company, its successors and assigns, in laying or
repairing its aforesaid gas mains and pipes, shall not un-
necessarily or unreasonably obstruct or injure any street,
avenue or alley of the said Cit~ and shall restore all
streets, avenues and alleys of the said City, which shall
be opened by it, its agents or employes, for the purpose of
laying, placing or maintaining its aforesaid gas mains or
pipes, to as nearly the same order and condition as is reason-
ably possible, and shall maintain, repair and keep in good
and proper condition for a period of three (3) months that
portion of said streets, lanes, alleys and highways, dis-
turbed by it in the laying, placing or maintaining of its
said gas mains, and pipes therein or thereon. The three (3)
months period to be computed from the time of the closing
of the ditch or opening, but in case of frost the three (3)
months period shall commence when the frost leaves the
ground.
Section 3. That the said Minneapolis Gas
Light Company, its successors and assigns, shall lay such
of its mains and pipes as come within its requirements for
suburban service as soon as the Company shall find it reason-
ably possible to do so.
That the said Minneapolis Gas Light Company,
its successors, lessees or assigns, shall within thirty (30)

days from the publication of this Ordinance file with the
Clerk of the City its acceptance of the same in writing,
signed by its proper office~s, and attested by its cor-
porate sealo
Section 4. That the said.Minneapolis Gas
Light Company, its successors or assigns, shall hold the
said City harml~ess from any and all damages and costs to
which it may be put by reason of the construction, operation
and maintenance of the said gas mains and pipes~, and the
furnishing of gas to the said City and inhabitants thereof
by it.
Section 5. That the said Minneapolis Gas
Light Company, its successors and assigns, shall be subject
to all reasonable Ordinances, Rules and Regulations now in
force and that may hereafter be enacted by the said Council
concernin~ the opening of streets, avenues and alleys, and
the obstruction of travel and traffic therein.
Section 6. This Ordinance shall take effect
and be in force from and after its passage, pUblication and
acceptance.
