BEING AN ORDINANCE VACATING CALIFORNIA STREET FROH
38th AVENUE to 39th AVENUE N.E.
THE CITY COUNCIL OF THE CITY OF COLUHBIA HEIGHTS DOES ORDAIN:
Section 1.
That California Street N.E. from 38th Avenue to 39th
Avenue N.E. is not at the present time utilized as a
street and is in fact utilized for park and industrial
purposes, and therefore would not serve a municipal purpose
to have said street opened, and
Section 2.
In order for the industrial parcel on lots 16, 17, and
i8, Block lO0 (3801 California Street) be developed
in the most efficient manner, the East one-half of
the California Street right-of-way be included in said
parcel , and
Section 3.
The Burlington Northern Railroad agrees to grant the
City of Columbia Heights title to the West one-half of
California Street when vacated with the understanding
that the City is responsible for carrying proper insurance
on said property to hold Burlington Northern blameless on
any claims arising from accidents or other occurances on
said vacated right-of-way.
Section 4.
That California Street from 38th to 39th Avenues N.E.
be and the same is hereby vacated with the retention
of the necessary utility easement for existing utilities
lying thereunder.
Section 5. This Ordinance shall take effect and be in force from and
after thirty (30) days after its passage.
