HomeMy WebLinkAboutOrdinance 809CITY OF COLUMBIA HEIGHTS ADMINISTRATIVE OFFICES 788-9221 COLUMBIA HEIGHTS, MINNESOTA 55421 ORDINANCE #809 BEING AN ORDINANCE VACATING THE NORTHERLY 14 FEET OF THE 39TH AVENUE RIGHT-OF-WAY LYING SOUTH OF LOT 16, BLOCK 73, COLUMBIA HEIGHTS' ANNEX AND THE EASTERLY 15FEET OF THE CALIFORNIA STREET RIGHT-OF-WAY LYING WEST OF LOTS 16 THROUGH 22, BLOCK 73, COL'UMBIA HEIGHTS ANNEX TO MINNEAPOLIS AND RETAINING THE EASEMENT RIGHTS IN SAID VACATED SECTIONS OF 39TH AVENUE AND CALIFORNIA STREET FOR UTILITY MAINTENANCE AS REQUIRED. THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN: Sectilon 1. The Northerly 14 feet of 39th Avenue lying south of Lot t6 and tKe Easterly 15 feet of California Street lying west of Lots 16 through 22, all in Block 73, Columbia Heights Annex to Minneapolis be, and the same are hereby vacated. Section 2. That as a part of said vacating the owner of Lots 16 through 22 inclusive does agree to allow the City and ut[ltty companies to enter upon this vacated right-of-way as necessary to repair and ~intain the utility lines therein, and said utility companies or the City shall not be held liable for replacement of any shrubbery, trees, or grass damaged in the maintenance of the utility lines. Section 3. That the owner of Lots 16 through 22 inclusive, Block 73, Columbia Heights Annex does further covenant and agree to surface these areas so vacated in conjunction with the adjoining street surfacing with the vacated areas to be used for off-street parking. Alt this surfacing, including the street pavi'ng, to be done at no cost to the City of Columbia Heights with the exception of a concrete curbing on the west side of California Street and associated reconstruction on existing drains as specified by the City Engineering Department. Section 4. This ordinance shall take effect and be in force from and after thirty (30) days after its passage.
