BEING AN ORDINANCE AMENDING ORDINANCE
#226, BEING AN ORDINANCE TO LICENSE AND
REGULATE GAMES OF SKILL AND PROVIDING A
PENALTY FOR THE VIOLATION THEREOF.
THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN:
Section 1. Ordinance #226 ~htch reads as follows:

AN ORDINANCE TO LICENSE AND REGULATE GAMES OF
SKILL' AND PROVIDING A PENALTY FOR THE
VI, OLATION THEREOF.
THE COUNCIL OF THE CITY OF COLUMBIA HEIGHTS
DO ORDAIN:
Section 1. Defi~ttons. The term "a game of skill"
as used herein shall include any devlce played by
manipulating spec~at equipment by hand or
mechanically and propelling balls, figures or
numbers across a board or field into respective
positions, the object of which is to secure a
special numba~ or numbers of high total score, or
to place the figures or numbers in special
positions, w'hi'ch game may be played by the
public generally at a price paid either
directly or indirectly for such privilege, whether
a prize is offered for the game or not, whether
known as a pinball game or by any other name.
Section 2. License Required. No person, firm or
corporation shall operate or keep for operation any
game of skill without having applied for and
received a license therefor from the City Council
as herein provided. Application for such
license shall be made to the City Clerk upon a
form to he supplied by the municipality, and
~hall g~ve the name and address of the owner and
applicant, the place where such game or device is
to be operated, what business is conducted at
t~at place, the name, number, and description of
the game or particular piece of equipment to be
licensed, the fee for playing the game and prize,
if any, and such other information as the Council
may require. Every such application shall be
accompanied by the annual license fee as Council
shall by ~resolution designate. Said fee shall be
paid into the general fund ~ the municipality.
Such application ~hall be considered by the Council
at ~ts next regular meeting and granted or rejected.
L~cense ~hatl expire December 31 of the year issued
and shall be for a term of one year for each ~uch
game of ~kill. It may be transferred to another
location ~n thi~ municipality upon filing notice
~ith the City Clerk of such transfer, upon the
payment of $1.00. Upon application to the City
accompanied by a fee of One Dollar, any license
i~sued hereunder may be re-issued for a game of
~k~ll maintained or kept ~n place of the game of
skill originally l~censed, provided that all
provisions of th~s ordinance shall be complied with
in re-i~suance of sa~d license.
Section 3. License to be Displayed. Every license
granted hereunder shall be ported' in a conspicious
place on or near the game so licensed and shall
identify the same, ~y number or description.
Section 4. Prohibited Practices and Restrictions.
No license hereunder shall be issued for any game
of ~k~ll w~thin 200 feet of any school building.
No person ~halt u~e any device licensed under this
ordinance as a gambling device, and no license shall
permit any person or persons to use any game
licensed hereunder for gambling purposes, and the
operation of any lottery or gambling device is
declared to be contrary to this ordinance. No minor
under the age of eighteen years, or any minor
enrolled tn a public school, s~all be permitted
to play any such device. Licensee permitting
~uch ~rson to play shall be deemed a violation of
th~s ordi~nance.
Section 5. Penalty._~ Any person violating the
provisions of this ordinance shall be guilty of a
misdemeanor, and upon conviction thereof shall be
punished by a fine not to exceed $100 or by
imprisonment for not more than ninety days. Upon
conviction for the violation of any law of the
state relating to gambling involving any such game
or devi~ce, the l~cens, e to operate the same shall be
forth~itt~ revoked.
Section 6. Any provision of ordinances passed previous
hereto and ~nconsistent herewith are hereby
superceded.
SeCtiOn 7. Effect. Thi's ordinance shall take effect
and he in force 30 .da~s after its passage.
